STAFF RECOMMENDATION
That the Planning Commission note and file this report.
STAFF DISCUSSION
At its meeting of October 13, 1987 the Planning Commission approved the
applicant's request for a UEe Permit to allow an off -sale liquor license in 4
conjunction with a grocery store. This approval was subject to a one-year S
review from the date of occupancy. A copy of the adopted resolution is
attached.
Staff has contacted the Police Department regarding this use and they are not
aware of any complaints or problems associated with liquor sales at this
location. Therefore, Staff is recommending that the Planning Commission note
and file this report.

BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A USE PERMIT
ALLOWING AN OFF -SALE LIQUOR LICENSE IN CON-
JUNCTION WITH A GROCERY STORE ON PROPERTY KNOWN AS
3495 S. BASCOM AVE. IN A C-2-S (GENERAL COMMERCIAL)
ZONING DISTRICT. (APPLICATION OF MR. JAMAL
CHALANDARI, UP 87-17).
After notification and public hearing as specified by law on the application of
Mr. Jamal Ghalandari and Mr. Reza Sarraf for a Conditional Use Permit o allow
and off -sale liquor license in conjunction with a grocery store on properly
known as 3495 S. Bascom Ave. in a C-2-S (General Commercial) Zoning District,
as per the application filed in the Planning Department on September 16, 1987;
and, after presentation by the Planning Director, proponents and opponents, the
hearing was closed. ,
After due consideration of all evidence presented, the Planning Commission did
find as follows:
1. The establishment, maintenance or operation of the use applied for will not
be detrimental to the health, safety, peace, morals, comfort or general
welfare of persons residing or working in the neighborhood of such proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
2. The proposed site is adequate in size and shape to accornodate the yards,
walls, fences, parking and loading facilities, landscaping and other
development features required in order to integrate said use with uses in
the surrounding area.
Based on the above findings, the Planning Commission does hereby grant the
requested Use Permit, subject to the following conditions:
1. Liquor sales to be restricted to the hours of 6 a.m. to 2 a.m.
2. Approval of this use permit is for liquor sales in conjunction with a
grocery store and does not permit the establishment of a store dedicated to
liquor sales only at this location.
3. Approval of this use permit is subject to a one-year review by the Planning
Commission.
The applicant is notified as part of this application that he/she is required
to comply with all applicable Codes and/or Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
PASSED AND ADOPTED this 13th day of October 1987 by the following roll call
vote:

STAFF RECOMMENDATION
That the Planning Commission ADOPT A RESOLUTION, including the attached
findings, APPROVING the applicant's request for a Conditional Use Permit
to allow off -sale liquor sales at this location.
STAFF DISCUSSION
The applicant is requesting approval of a Conditional Use Permit to allow
an off -sale liquor license in conjunction with a proposed retail grocery
store. The proposed grocery store would occupy approximately 2,900 sq.ft.
of a recently approved retail building located at 3495 S. Bascom Ave. A
letter of request is attached.
This project is situated on the west side of Bascom Ave. just south of
Shelley Ave. This commercial center is surrounded by the following uses:
North: Two story office building
South: Condominium project
East: Office development
West: Condominium project
Staff is of :he opinion that the proposed use is compatible to the
adjacent developments. This request was referred to the Police Department
for their recommendation and review. They have indicated that they do not
object to this use at this location.

offer basic food and non-food items, including beer, wine and hard liquor,
gourmet items, as well as a full line of fresh produce. We will provide cart
facilities, weekly specials, and maintenance of full, current, and well -stocked
inventory. I
The hours of operation will be from 6:00 A.M. to 2:00 A.M. The proposed f
square footage is 2,880 square feet, which is slightly half the size of a major `

We see that there is a definite need in this community for a retail grocery store,
offering fresh produce and a wide assortment of goods, as there is no such
establishment along Bascom serving the residents of this neighborhood.
To meet this need, we will bridge the gap between the inconvenience of major
food -chain shopping, providing lower prices than a neighborhood store, while
offering the benefits of a convenience store, without the unsavory elements
normally associated with same. As you can see, this type of business is unique
in its structure and services offered.

Dear City Councillors:
This letter is to delineate the details for a proposal for a Use Permit in a
retail grocery business within the Campbell city limits. Accompanying this
letter will be supporting documentation.
This business will operate as a "neighborhood grocery store," competitive with
major food -chains, while offering the benefits of a convenience store. We will
offer basic food and non-food items, including beer, wine and hard liquor,
gourmet items, as well as a full line of fresh produce. We will provide cart
facilities, weekly specials, and maintenance of full, current, ar,d well -stocked
inventory.
The hours of operation will be from 6:00 A.M. to 2:00 A.M. The proposed
square footage is 2,88C square feet, which is slightly half the size of a major
food -chain store. Its proposed location is 3495 S. Bascom Avenue, Campbell
(APN #413-77-001).
We see that there is a definite need in this community for a retail grocery store,
offering fresh produce and a wide assortment of goods, as there is no such
establishment along Bascom serving the residents of this neighborhood.
To meet this need, we will bridge the gap between the inconvenience of major
food -chain shopping, providing lower prices than a neighborhood store, while
offering the benefits of a convenience store, without the unsavory elements
normally associated with same. As you can see, this type of business is unique
in its structure and services offered.
We appreciate yocr consideration of this proposal, and are pleased to be a part
of this community. It would be our pleasure to be of service in meeting a need
that we have seen in this neighborhood, in a professional and efficient manner.
