UP 89-01 Public hearing to consider the application of
Pruneyard Inn Mr. Peter Evenhuis for approval of a
Conditional Use Permit to allow an on -sale
general liquor license on property known as

C-2-S (General Commercial) Zoning District.
Principal Planner Stafford reviewed the Staff Report of January 24, 1989,
noting that Staff is recommending approval of the applicant's request.
Discussion ensued regarding the requirement for full kitchen services; the
definition of a full service bar and of a portable bar; and, the criteria used
by the Police Department in making recommendations on liquor licenses.
Chairman Olszewski opened the public hearing and invited anyone to speak on
this item.
Mr. Peter Evenhuis, applicant, explained that a full service bar refers to
permanent fixtures; and, noted that the hotel would like to have the option of
eventually having a fixed bar facility (not a night club) for its clientele.
M/S: Kasolas, Walker - That the public hearing on UP 89-01 be
closed. Motion carried 5-1-1.
M/S: Kasolas, Walker - That the Planning Commission adopt the
attached findings and Resolution No. 2576
approving UP 89-01, subject to the following
conditions: (1) Mini -bars permitted in
guestrooms; and, (2) Portable service bars be
permitted for use in serving guests at
hotel -related functions, such as social
hors, meetings, receptions and cocktail
parties. Motion carried 6-0-1, with
Commissioner Perrine absent.

BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A USE PERMIT
ALLOWING AN ON -SALE GENERAL LIQUOR LICENSE ON
PROPERTY KNOWN AS 1995 S. BASCOM AVE.
(THE PRUNEYARD INN) (APPLICATION OF MR.
PETER EVENRUIS, UP 89-01).
After notification and public hearing as specified by law on the application of
Mr. Peter Evenhuis for approval of a Use Permit allowing an on -sale general
liquor license on property known as 1995 S. Bascom Ave. in a C-2-S (General
Commercial) Zoning District, as per the application filed in the Planning
Department on December 29, 1988; and, after presentation by the Planning
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows:
1. The establishment, maintenance or operation of the use applied for will not
be detrimental to the health, safety, peace, morals, comfort or general
welfare of person residing or working in the neighborhood of such proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City. _
2. The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate.
3. The proposed use is compatible with the uses in the area.
1 4. The proposed use is compatible with the operation of an hotel.
Based on the above findings, the Planning Commission does hereby grant the
requested Use Permit, subject to the following conditions:
1. Mini -bars permitted in guestrooms.
2. Portable service bars be permitted for use in serving guests at
hotel -related functions, such as social hours, meetings, receptions and
cocktail parties.
The applicant is notified as Dart of this application that he/she is required
to comply with all applicable Codes and/or Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.

Permit to allow an on -sale general liquor license
on property known as 1995 S. Bascom Avenue (The
Pruneyard Inn) in a C-2-S (General Commercial)
Zoning District.
STAFF RECOMMENDATION
That the Planning Commission ADOPT a RESOLUTION, including the attached
findings, APPROVING the applicant's request to allow an on -sale general liquor
license at this location, subject to the attached conditions.
STAFF DISCUSSION
The applicant is requesting approval of a Conditional Use Permit to allow an
on -sale general liquor license in conjunction with the Pruneyard Inn Hotel
which is currently under construction.
The Pruneyard Inn is located at the northerly side of the Pruneyard Shopping
Center. The Inn is surrounded on the south, east and west by the Shopping
Center. To the north, the adjacent property is planned for a Commercial use,
but is currently a High Density Residential development known as the Aloha
Apartments.
Staff is of the opinion that the proposed use is consistent with the operation
of an hotel, and is recommending approval of the application.
This request was referred to the Police Department for their review. The
Police Department is also recommending approval, subject to the attached
conditions.

We request your approval of a use permit for a on -sale general liquor license
x 47.
The purpose of this use permit is to serve liquor to our guests at the soon to
open PruneYard Inn hotel.
We are currently in negotiations with ServiSystems, a national supplier to
Hotels for the purchase of Minibars for each of our guestrooms. These bars
have become in most hotels a standard item and based on the caracter of our
clientele, consisting mainly of traveling business people, we feel in order to
remain competitive we need to provide this amenity.
Attached to this letter 1 have provided a copy of a typical minibar as seen in
most hotels.
In addition we anticipate serving liquor to those groups hosting a reception,
lunch, dinner or other social function in our meeting rooms. Again, as
mentioned above, in order to stay competitive with other hotels seeking to
sell their guestrooms to associations, groups, board meetings, weddings and
many other entities, the hotel must have the ability, not only to provide a
fine meeting facility during the day, but often must be able to accommodate
a cocktail party to complement a groups activities.
I look forward to discussing this matter with the commissioners at any time,
to clarify or answer any questions which might come up, relating to this
important phase of our pre -opening efforts.

Notice is hereby given that the Planning Commission of the City of
Campbell has set the time of 7:30 p.m., on shortly thereafter, on Tuesday,

Dear Commissioners December 29, 1988
We request your approval of a use permit for a on -sale general liquor license
K 47.
The purpose of this use permit is to serve liquor to our guests at the soon to
open PruneYard Inn hotel.
We are currently in negotiations with ServiSystems, a national supplier to
Hotels for the purchase of Minibars for each of our guestrooms. These bars
have become in most hotels a standard item and ba .d on the caracter of our
clientele, consisting mainly of traveling business people, we feel in order to
remain competitive we need to provide this amenity.
Attached to this letter I have provided a copy of a typical minibar as seen in
most hotels.
In addition we anticipate serving liquor to those groups hosting a reception,
lunch, dinner or other social function in our meeting rooms. Again, as
mentioned above, in order to stay competitive with other hotels seeking to
sell their guestrooms to associations, groups, board meetings, weddings and
many other entities, the hotel must have the ability, not only to provide a
fine meeting facility during the day, but often must be able to accommodate
a cocktail party to complement a groups activities.
I look forward to discussing this matter with the commissioners at any time,
to clarify or answer any questions which might come up, relating to this
important phase of our pre -opening efforts.

REGARDING EFFECT OF WASTEWATER
TREATMENT CAPACITY ON LAND
DEVELOPMENT APPROVALS PURSUANT TO
DEVELOPMENT OF APN
Please take notice that no vested right to a building permit
shall accrue as the result of the granting of any land development
approvals and applications. Pursuant to the adoption of Ordinance
9.045 by County Santitation District No. 4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance of a sewer connection permit to a
building, or proposed building, on the above described property,
wil`, in his opinion, cause the District to exceed its ability
to treat adequately the wastewater that would result from the
issuance of such connection permit, then said permit may not
be issued, and, hence, no building permit may be issued by
this agency.
