Please be advised that the Planning Department has conducted an inspection
of the property located at i777 South Bascom Avenue. Our inspection
revealed that the landscaping for the entice site is not consistent with the
previous approval. There is a general lack of maintenance, and planting
areas are void of landscaping. The Use Permit allowing Erik's DeliCafe
required a specific landscaping plan, as a condition of approval, which is
currently not in compliance. Please note the following landscaping
deficiencies that must be addressed:
I. The eucalyptus tree located in the northernmost corner of the
property has been removed and was not replaced.
2. The ground cover has been eliminated from the landscape frontage
along Bascom Avenue
3. Maintenance of all landscaping areas is substandard.
To bring the property in conformance with the plan, the landscaping must be
re -installed and the Eucalyptus tree replaced within three (3) weeks, on or
before April 21, 1992. Additionally, once installed, landscaping mu,t be
maintained on a regular basis. Should you wish to vary the plant varieties of
the approved landscape plan, a revised landscape plan must be submitted.

Dear Joe:
The Planniny Departnent conductea a final inspection of the
above -referenced project on December 4, 1990, to ensure completion and
compliance with your Use Permit approval.
The following inconsistencies or deficiencies were noted:
1. The finger island constructed along the Campisi Way driveway was
concreted. The approved plan called for low shrubs being planted
in this area. As an alternative to this la-ldscape treatment, the
Planning Director could be supportive of a cobble -stone treatment
similar to the other islands provided in this area.
2. The remodelled parking area's asphalt treatment has not been
completed in the southwest corner of the project. It is important
that areas that are replaced should be provided with a sufficient
base to minimize asphalt failure in the future.
3. The 36 inch planters have not been provided around the outside
seating area alcng the Bascom Avenue frontage.
4. The Heavenly Bamboo shrubs installed appear to be one gallon verses
five gallon sizes.
5. The striping of the parking area has not been completed.
6. The trash enclrsare has not been completed, and
7. The tree wells have not been completed in the rear parking area.

Please be advised that the Site and Architectural Review committee at
its meeting of November 6, 1990, conditionally approved the landscaping
plans for the above referenced project. This approval is subject to
the red -Lining on the enclosed plans.
Please note the following changes in plant materials.
1) The proposed trees in the parking area shown as T1 should be
Chinese Pistache or Red Flowering Gum, 15 gallon size. It is
also recommended that a cobble stone treatment be provided
around the base of the trees.
2) The revised plan requires the installation of two street trees
along the Bascom Avenue frontage. A London Plane tree, 15
gallon standard is also required.

I would like to request some changes on the red lined site plan.
This request is made for two reasons:
1. The cost to make the charges on the red lined version
will run approximately $25,000.00.
2. I can achieve the same amount of parking without
changing the front of the parking lot.
I would like to request the following:
1. That the front parking area remain the same.
The patio would extend straight out and not take
any parking spaces. (See enclosed)
Basically we would be changing the back parking area as shown in
the red lined drawing. The net effect would be 105 parking spaces
which is one car less than the red lined version. We feel that we
can achieve the intent of the Planning Commission at considerable
savings to Erik's DeliCafe.

approval of a Conditional Use Permit to allow the
establishment of an outside seating area and a beer/
wine license in conjunction with an existing commercial
building located at 1777 South Bascom Avenue, in a
C-2-S (General Commercial) Zoning District. APN:

Chairperson Perrine read the Application into the record.
Planning Director Piasecki reviewed the Application and discussed the Staff
Report, noting a parking deficiency due to close proximity to the Sunset
Bar and Grill. He stated that Staff is concerned about the parking
deficiency since the hours of operation for the proposed use would not
conflict with current hours of operation at the Sunset Bar and Grill.
Further, he noted redlined plans displayed and stated that Staff is
recommending approval of the application with the fol.�wing added
conditions:
- increasing parking by 15 spaces
- upgrading landscaping along the street frontages and within the
parking area.
Commissioner Alne reported on tha Site and Architectural Review Committee
meeting of August 28, 1990, noting that additional conditions were
discussed, as noted by Mr. Piasecki, and that the applicant is agreeable to
the added conditions. He stated that the Committee is recommending
approval, az redlined.
The Chairperson declared the Public Hearing open.
Mr. Joseph Appenrodt, President, Erik's DeliCafe, noted that he is in
agreement with all conditions and requested support for the project.
Chairperson Perrine asked Mr. Appendrodt if he is satisfied that the
deficiency in parking will not create a problem.
Mr. Appenrodt stated that since the Sunset Bar and Grill is primarily a
cocktail -type use, and that the proposed deli will be closing at 7:00 p.m.,
there will be :.o parking impacts.

BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE
PERMIT ALLOWING ESTABLISHMENT OF AN OUTSIDE SEATING AREA
AND A BEER/WINE LICENSE IN CONJUNCTION WITH AN EXISTING
COMMERCIAL BUILDING ON PROPERTY LOCATED AT 1777 SOUTH
BASCOM AVENUE (APPLICATION OF MR. JOSEPH APPENRODT, ON
BEHALF OF ERIK'S DELICAFE, UP 90-11).
After notification and public hearing as specified by law on the
application of Mr. Joseph Apnenrodt for a Conditional Use Permit
approving establishment of as outside seating area and a beer/wine
license in conjunction with an existing commercial building on property
located at 1777 South Bascom Avenue, in a C-2-S (General Commercial)
Zoning District, as per the application filed in the Planning Department
on July 19, 1990; and, after presentation by the Planning Director,
proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning
Commission did find as follows:
1. Scale: The proposed project use is an appropriate scale in
relationship to the adjacent developed uses.
2. Design: The site and landscape plan is well designed and blends
into the neighborhood.
1. Parking: The parking provided meets code requirements for the
restaurant use and does not increase the existing parking
deficiency.
4. es' The project will be aesthetically pleasing and add to the
interest of the streetscape.
5. Landscaping: Landscaping improvements are proposed which adds to
the aesthetics of the project and improves the project appearance.
6. Health/Safety: The establishment, maintenance or operation of the
use applied for will not be detrimental to the health, safety,
peace, morals, comfort or general welfare of persons residing or
working in the neighborhood of such proposed use, or be detrimental
or injurious to property and improvements in the neighborhood or to
the general welfare of the City.
7. Compatibility: The proposed site is adequate in size and shape to
accommodate the yards, walls, fences, parking and loading
facilities, landscaping and other development features required in
order to integrate said use with uses in the surrounding area.
8. Com atibi.lity: The proposed use is compatible with the uses in the
area.

Based on the above findings, the Planning Commission does hereby grant
the requested Use Permit, subject to the following conditions:
1• Approved Site Plan: The site plan shall be modified to accommodate
two-way aisles, sufficient backup area, realignment of curbs and
minimum 15 foot landscape area as "redlined" on the exhibit labelled
"Revised Site Plan" sheet no. C2.
2• Awnings/umbrellas: Revised elevations and/or site plan indicating
awning or umbrellas to be submitted to the Planning Department and
approved by the Planning Director upon recommendation of the
Architectural Advisor prior to application for a Building Permit.

indicated and/or added in red on the plans. Landscaping and fencing
shall be maintained in accordance with the approved plans. A

11. Signs: Sign application to be submitted in accordance with
provisions of the Sign Ordinance for all signs. No sign to be
installed until application is approved and permit issued by the
Planning and Building Departments (Section 21.53 of the Campbell
Municipal Code).
12. Trash Disposal: Ordinance No. 782 of the Campbell Municipal Code
stipulates that any contract for the collection and disposal of
refuse, garbage, wet garbage and rubbish produced within the limits
of the City of Campbell shall be made with Green Valley Disposal
Company. This requirement applies to all single-family dwellings,
multiple apartment units; to all co-mercial, business, industrial,
manufacturing, and construction establishments.
13. Trash Containers: Trash container(s) of a size and quantity
necessary to serve the development shall be 1Gcated in area(s)
approved by the Fire Department. Unless otherwise noted,
enclosures(s) shall consist of a concrete floor surrounded by a
solid wall or fence and have self -closing doors of a size specified
by the Fire Department. All enclosures to be constructed at grade

1. ADOPT A RESOLUTION incorporating the attached findings,
approving the applicant's request for a Conditional Use
Permit, subject to the attached Conditions of Approval.
2. This project is categorically exempt, since it involves
tenant improvements in an existing commercial building and
minor site improvements, hence no environmental action is
necessary.
APPLICANT'S PROPOSAL
The applicant seeks approval of a Conditional Use Permit to allow
the establishment of an 80 seat restaurant/deli which serves beer

In 1979, the Planning Commission approved an 18,600 square foot
retail building on the subject property with the provision of 92
parking spaces. Subsequent to that approval, the Planning
commission approved a cocktail bar operation in a portion of this
building and a modification to the parking ratio allowing the
elimination of 2 parking spaces.
Although only 11 years old the landscaping and trash area have not
been well maintained.
GENERAL PLAN AND ZONING CONSISTENCY_
A. General Plan Designation: The site is designated for
Commercial Land Use on the Land Use Element of the General
Plan. The proposed restaurant use is consistent with this
designation.
Zoning Designation: The site is zoned for C-2-S (General
Commercial) on the City's zoning map. The proposed restaurant
use is allowed in this zoning district if sufficient parking
is provided. The applicant also seeks approval of a Use
Permit to allow an outside seating area and a license to sell
beer and wine.

DISCUSSION
Layout; The plans propose that an outdoor dining area be
established and that the existing landscaping be upgraded. A low,
four foot, screened fence is proposed to buffer the outside
seating area. Staff recommends that a minimum of 15 ft. of the
area behind the sidewalk be retained as a publicly visible
landscape area. This requirement will necessitate a slight change
in the applicant's site plan.
Parking: The applicant intends to work with the owner t
landscape and re -stripe the parking area. The proposed c inges in
the Site Plan will increase the proposed parking to provide an
additional 16 spaces, from 90 parking spaces to 106 parking
spaces. The provision of this additional parking satisfies the
increased need of parking facilities for the seating as requested
by this applicant. The added parking does not alter the parking
deficiency previously allowed when Sunset Bar and Grill was
permitted. Staff is not aware of any parking problems caused by
the existing 43 space deficiency. Sunset Bar and Grill tends to
generate parking demand in the evenings while the other retail
uses are more active during the daytime.
The revision to the parking area requires the incorporation of a
remnant parcel which was created when Creekside Way was
constructed. The conditions will transfer this remnant parcel to
this property in conjunction with the remodel of this parking
area.
The parking lot must be modified to accommodate two-way aisles,
sufficient backup area and realign the curbing. Exhibit C2 has
been "redlined" to reflect these changes.
Landscaping/Trash Enclosure: The presented Site Plan indicates
the upgrading of landscaping along the street frontages and within
the parking area. A condition of approval requires that a more
specific landscape plan be submitted for review by the Site and
Architectural Review Committee. The plan for trash enclosures
will be submitted with the landscape plan.
SITE AND ARCHITECTURAL REVIEW COMMITTEE:
The site and Architectural Review Committee meeting of August 21,
1990 was cancelled due to vacation schedules and rescheduled for
August 28, 1990. The Committee will verbally present it's
recommendation on the site plan to the Planning Commission.

of screen wall to be submitted to the Planning Department and

fencing, and striping of parking areas within 3 months of completion
of construction; or (2) file a written agreement to complete

11. Signs: Sign application to be submitted in accordance with
provisions of the Sign Ordinance for all signs. No sign to be
installed until application is approved and permit issued by the
Planning and Building Departments (Section 21.53 of the Campbell
Municipal Code).
12. Trash Disposal: Ordinance No. 782 of the Campbell Municipal Code
stipulates that any contract for the collection and disposal of
refuse, garbage, wet garbage and rubbish produced within the limits
of the City of Campbell shall be made with Green Valley Disposal
Company. This requirement applies to all single-family dwellings,
multiple apartment units; to all commercial, business, industrial,
manufacturing, and construction establishments.
13. Trash Containers: Trash container(s) of a size and quantity
necessary to serve the development shall le located in area(s)
approved by the Fire Department. Unless otherwise nosed,
enclosures(s) shall consist of a concrete floor surrounded by a
solid wall. or fence and have self -closing doors of a size specified
by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to
service these containers.

following three items:
1. Permission to sell beer and wine.

3. Increase of seating to 80 seats both inside and out.
1. Beer and Wine Permit: Erik's currently has •iineteen (19)
De iCa es a o which sell beer and wine. Beer and wine as a
percentage of our sales represents 3.5%. we do not currently
plan to haN-c any happy hours or any other events that would
encourage driiking. We have beer and wine as a service to our
customers who may enjoy a glass of wine or beer with their
sandwich. In )ur seventeen (17) years of business we have not
had any problems with our beer and wine license.
2. Outside Seating Area: We are requesting an outside patio (see
arawiny) t at wou a have sixteen (16) seats. We feel the
outside area would provide a benefit to our customers as well
as enhance the center. We propose to install an awning and to
provide landscaping to mitigate the noise from Bascom Avenue.
With our outside seating there would still be a buffer between
sidewalk and the seating area.
Increase in Seatin to 80 Seats Both Inside and Outside: We
feel this is a reasonab a request due to several factors:
a. The amount of office space nearby would create a great
deal of walkin traffic, thereby reducing the amount of
cars.
b. Our peak hours are 11:30 - 1:30 Monday through Friday
which do not represent the peak hours of the other
tenants in the center.
C. Our research has shown that, unlike fast food restaurants,
Erik's customers come to lunch in groups thus reducing
the number of cars.

We feel that with the number of offices nearby and with multiple
riders the current parking will be sufficient for 80 seats.
Erik's DeliCafe, Inc. has been in business since 1971 and we
currently have 19 DeliCafes. We take a great deal of pride in
making sure the DeliCafe represents the standards of the company.
Our plan in Campbell is to take the premises we have leased and
create a setting that is comfortable and visually appealing. We
plan to invest not only in our tenant improvements, but in the
total presentation of the center.
We are very excited about this location and would not have entered
into the lease if we thought the parking was insufficient.
We hope the Planning Department and Commission agrees with our
reasoning.
