PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBEIL APPROVING A USE PERMIT
ALLOWING THE AN ON -SALE BEER AND WINE LICENSE, IN
CONJUNCTION WITH A FULL SERVICE RESTAURANT, ON PROPERTY
LOCATED AT 1875 SOUTH BASCOM AVENUE, IN A C-2-S (GENERAL
COMMERCIAL) ZONING DISTRICT. (APPLICATION OF MR. DENNIS
NOBLE, ESQ., ON BEHALF OF STRINGS RESTAURANT, UP 90-16).
After notification and public hearing as specified by law on the
application of Mr. Dennis Noble for a Use Permit allowing an on -sale
beer and wine license, in conjunction with a full service restaurant on
property located at 1875 South Bascom Avenue, in a C-2-S( General
Commercial) Zoning District, as per the application filed in the
Planning Department on December 14, 1990; and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning
Commission finds as follows with regard to the Application No. UP 90-16.
1. The Campbell Municipal Cde, Section 21.22.030, allows an on -sale
beer and wince license, in a C-2 zoning district, upon approval of a
Conditional Use Permit.
2. The site of the proposed use is designated for commercial uses.
3. Minor changes in the operation of an existing structure are exempt
from the California Environmental Quality Act.
Based upon the foregoing findings of fact, the Planning Commission
further finds and concludes that:
1. The establishment, maintenance, or operation of the use applied for
will not be detrimental to the public health, safety, peace, morals,
comfort or general welfare of persons residing or working in the
neighborhood of such proposed use, or be detrimental or of such a
proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the
City.
2. The proposed use is consistent with the General Plan and zoning for
the City of Campbell.
3. The proposal meets the requirements of the Campbell Municipal Code,
Section 21.24.030, for approval of a Conditional Use Permit.
4. A Notice of Exemption is appropriate as this project is
Categorically Exempt from the environmental review process.
Based on the above findings, the Planning Commission does hereby grant

STAFF RECOMMENDATION
That the Planning Commission take the following action:

this restriction patrons could not purchase beer or wine for
consumption off the premises.
