COMMERCIAL) ZONLN(, DISTRICT; APPLICATION OF MS.
JERI PETERSEN, ON BEI IALF OF FRESH CHOICE, INC., FILE
NO. UP 91-05.
After notification and Public Hearing as specified by law on the application of Ms.
Jeri Petersen, on behalf of Fresh Choice allo�,ing a Conditional Use Permit for
the a beer and wine license, in conjunction with the establishment of a 7000
square foot restaurant, on property fixated at 1650-1750 South Bascom Avenue,
in a C-2-S (General Commercial) Zoning District, as per the application filed in
the Planning Department on Nfarcn 1, 1991, and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows with respect to File No. UP 91-05:
1. The proposed restaurant is permitted in the C-2-S Zoning District.
2. The provision of 24 seats outside the restaurant will not be detrimental to the
shopping center and will contribute to the aesthetic appearances for this portion of
the center.
3. The applicant has submi,ted a parking analysis which concludes that the shopping
center has excess parking and that adequate parking is provided for the use.
4. The sale of beer/wine at this location is incidental to the main restaurant operation
and is found to be compatible to other uses in the shopping center.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The establishment, maintenance, or operation of the use applied for will not be
detrimental to the puhlic health, safety, peace, morals, comfort or general welfare of
persons residing or working in the neighborhood of such proposed use, or be
detrimental or injurious to property and improvements in the neighborhood or to
the general welfare of the City.
The proposed site is adequate in size and shape to accommodate the yards, walls,
fences, parking and loading facilities, landscaping and other development features
required in order to integrate said use with uses in the surrounding area.

3. The proposed site is adequately served by streets of sufficient capacity to carry the
kind and quantity of traffic such use would generate.
4. The proposed use is compatible with the uses in the area
Based upon the above findings, the Planning Commission does hereby grant the
requested Use Permit, subject to the following Conditions of Approval.
1. Approved Project: This approval is for a restaurant of a 7000 square foot, located on
a site identified as Assessor's Parcel Number 288-11-056. Development shall
substantially conform to the applicant's description and plans submitted as a portion
of this application. Project drawings and description limit this use to a restaurant of
180 interior seat and 24 exterior seats.
2. (lours of cperation to be limited to:
Sun. - Thurs. 11:00 a.m., to 9:00 p.m.
Fri. - Sat. 11:00 a.m., to 10:00 p.m. (Planning)
3. Beer and Wine License: Beer and wine licenses to be restricted to alcohol sales in
conjunction with a restaurant operation. (Planning)
4. Number of Employees: Use Permit Approval to limit number of employees to 35
per the applicant's description.
OUTSIDE SEATING
5. Design: Applicant to submit design of outside seating and umbrellas for approval of
the Planning Director prior to the building occupancy. (Planning)

6. Building Permits: Applicant to obtain any necessary Building Permits for proposed
tenant improvements. (Building)
PUBLIC SAFETY/WELFARE
7. Handicapped Requirements: Applicant shall comply with all appropriate State and
City requirements for .he handicapped. (Building)
8. Equipment Screening: All mechanical equipment on roofs and all utility meters to
be screened as approved by the Planning Director. (Planning)
9. Utility Connections: Plans submitted to the Building Division for plan
check shall indicate clearly the location of all connections for
underground utilities including water, sewer, electric, telephone and

report of April 1, 1991, stating that the Committee is delighted to see a Fresh
Choice restaurant at the location proposed. The Committee recommended
approval.

There was minor Commission decision regarding the banner sign on
Winchester Boulevard and Latimer Avenue. Chairperson Meyer-Kennedv
requested that efforts be made to ensure that the banner sign located there
does not turn upside down in the wind.
MOTION: On motion of Commissioner Fox, seconded by
Commissioner Dougherty, it was unanimously ordered that the temporary
sign request be approved. (6-0-1) Commissioner Wilkinson being absent for
the vote.

Petersen, J. Jeri Petersen, on behalf of Fresh Choice, Inc., for
approval of a Conditional Use Permit to allow a
beer and wine license, in conjunction with a 7000
square foot restaurant, on property located at 1650
- 1750 South Bascom Avenue, in a C-2-S (General
Commercial) Zoning District.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
1. ADOPT a Resolution, incorporating the attached findings
approving the applicant's request for a Conditional Use Permit,
subject to the attached Conditions of Approval.
The project is Categorically Exempt, henc no environmental
determination is required.
APPLICANTS PROPOSAL
The applicant seeks approval of a Conditional Use Permit to allow the
establishment of a restaurant in approximately 7000 square feet of an
existing shopping center. The applicant's proposal indicates that 180
seats would be provided inside, and 24 seats outside of the building.

A. General Plan Designation:
The site is designated a Commercial Land Use on the Land Use
Element of the City's General Plan. The proposed restaurant use
is consistent with this land use designation-

The property is zoned C-2-S (General Commercial). The
proposed restaurant use is a permitted I -se in this zoning district.
The applicant seeks approval of a Conditional Use Permit to

Shopping Center Approval: The Planning Col.imission, at its meeting
of September 11, 1990, approved the application of Hunter Properties to
remodel and expand the Hamilton Plaza Shopping Center. The

Hamilton Plaza Shopping Center. Based upon this analysis, the
applicant's consultant concludes that t.iere is a surplus of 74 parking
spaces during a peak Saturday demand for the shopping center. This
analysis assumes approximately 13,000 square feet of restaurant use in
the shopping center and that the remainder of the shopping center is
retail uses. Staff is comfortable with the conclusions of the parking
analysis and concludes that it reasonable to expect joint use of parking
facilities and various parking demand peaks for the variety uses in the
shopping center.
Beer and Wine License: The applicant is requesting approval to allow
beer and wine sales, in conjunction with the restaurant operation.
This use appears incidental to the main restaurant use that is propose
and has been reviewed by the Police Department. The Police
Department has no objection to the requested beer and wine license at
this location.

outside seating: The applicant's proposal includes the provision of 6
tables outside the stere, which allows 24 seats. Staff finds that the
walkway areas in front of the building are sufficient to accommodate
this use and that the outside seating will provide a more pedestrian
appearance to this I-)rtion of the shopping center. Staff is
recommending that the umbrella and table design be approved by the
Planning Director.

The Planning Commission finds as follows with regard to File No.. UP 91-05,
for a variance from the City Zoning Ordinance:
1. The proposed restaurant is permitted in the l -2-S Zoning District.
2. The provision of 24 seats outside the restaurant w 11 not be detrimental
to the shopping center and will contribute to the aesthetic appearances
for this portion of the center.
3. The applicant has submitted a a parking analysis which concludes that
the shopping center has excess parking demand tables and that

Based upon the foregoing findings of fact, the Planning Commission further

This letter presents the results of the parking analysis conducted by Barton-Aschman
Associates, Inc. for the Hamilton Plaza shopping center The purpose of the parking
analysis is to determine whether the future parking supply will be sufficient to accommo-
date the future parking demand.
Hamilton Plaza has 112,270 s.f of existing retail area and 9,500 s f. of existing service
area. At the end of the Phase 1 expansion, 24,750 s.f. of retail area will be added. An
additions! 7,600 s.f. of retail area w+II be added at the end of Phase it A total of 725
parking spaces will be provided.
The City of Campbell's parking requirements arc 1 space per 200 s.f. of retail space and 1
space per 350 &C of service space. According to these requirements, 712 spaces are
needed for Phase 1 and 750 spatrs for Phase 11.
The projected parking demands for the two phases were estimated by applying peak -
parking demand rates to the sizes of the center with the expansions. The peak rates were
obtained from the Institute of Transportation Engineers larking Generation manual. The
parking rates for shopning centers from this manual are 3.2J spaces per 1,000 s.t. (1 space
per 310 s.f) on weekdays and 3.97 spaces per 1,000 s.f. (1 space per 252 s.f) on Satur-
days. The center also includes restaurants, a total of 12.925 sT of the retail area. The
parking rates for family restaurants are 9.08 spaces per 1.000 s.f. (1 space per 110 s.f) on
weekdays and 6.96 sp ices per 1.000 s.f. (1 space per 144 s.f) on Saturdays. The manual
does not provide parking rates for service areas. The rates for retail :pace were applied to
the service area. The results of the estimated parking demands using these rates are
presented in Table 1.

The projected parking demand at the completion of Phase 1 is estimated to be 550 spaces
on weekdays and 621 spaces on Saturdays. At the end of Phase 11, the parking demand is
projected to be 574 spaces on weekdays and 651 spaces on Saturdays. The parking supply
of 725 spaces is approximately 10 percent highor than 0- preyed Saturday demand
after Phase 11. The parking supply should be more than sufficient to accommodate the
peak demand.

proposed seating for this particular use indicates a deficiency in the provided
parking. The Planning Commission has authority to adjust the parking
requirements for a specific use at a specific location, if it determines the
circumstances are such to warrant an adjustment.
Parking analysis of the shopping center, documentation of joint use of
parking facilities, and a discussion of other parking demand issues all have a
bearing on the adequacy of parking for this use. A part of the Conditional Use
Permit application, will require a parking analysis. As of this date, the
