ZONING DISTRICT; APPLICATION OF FABISCO
INDUSTRIES, FILE NO. UP 91-11.
After notification and Public Hearing as specified by law on the application of
Fabisco Industries allowing a beer and wine license for an existing restaurant,
in a C-2-S (General Commercial) Zoning District, as per the application filed
in the Planning Department on April 26, 1991; and, after presentation by the
Planning Director, proponents and opponents, the hearing was dosed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 91-11:
I. The site of the proposed use is designated for commercial ases.
2. The site of the proposed use i- ❑ot adjacent to a residential zoning
district.
3. The proposed use will not constitute an over concentration of similar
uses in the project area.
4. Additional police services will net be needed for the proposed use.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:

not be detrimental to the public health, safety, peace, morals, comfort or
general welfare of persons residing or working in thr neighborhood of

Based upon the foregoing findings, the Planning Commission approves the

1. This approval is for a Use Permit for a "on -sale' beer and wine license
located at 1875 South Bascom Avenue, No. 118.
2. Food service must be available at all times beer an.i wine is available.
3. No live entertainment is permitted.
4. Use is limited to "on -sale" teer and wine only in conjunction with the
full service restaurant. Saie )f veer and wine is limited to the hours of
11:00 a.m. to 10:00 p.m., Monday through Saturday, and 12:00 noon to
9:00 p.m on Sunday.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Farther, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinance of the City of Campbell
and the State of California which pertain to this development and are not

Chairperson Meyer -Kennedy read the application into the record.
Gina Garcia -Hunter, Planning Assistant, presented the staff report noting the fol!owing:
• Revised findings for 2.pproval.
• Applicant's request.
• Location of the proposal.
There are currently 10 establishments within the Pruneyard that have a beer
and wine license.
• Consistency with the General Plan and Zoning Designation.
• Staff is recommending the license be restricted to allow the sale of beer and
wine to restaurant customers only.
Chairperson Meyer -Kennedy opened the public hearing.

Broiler's Garden is a sit down restaurant specializing in flame broiled foods.
The purpose of this request is to provide beer and wine for their patrons. No
live entertainment is proposed.
The proposed hours of operation are:
Monday - Saturday 11:00 AM - 10:00 PM
Sunday 12:00 PM - 9:00 PM

patrons could not purchase beer or wine for consumption off the
premises.

1 - BROILERS GARDEN will provide health conscious. fat free
diet minded, and barbecue, flame broiled food lovers with a
fast service Menu and dishes such as SHISH KABOB. SIRLOIN
steaks, BURGERS. as well as saecially marinated BONELESS,
SKINLESS CHICKEN BREAST KABOB, SEA FOOD, all FLAME BROILED
and on SKEWERS. and also an appetizing SALAD BAR.
Menu is targeted to those food lovers who have desire but not
resource- ( time and/or money ) to go to either high cost
and/or time consuming restaurant. The menu will attract those
who are tired of greasy prefabricated mass produced looking
Burgers and battered chicken, warmed in a microwave oven.
The food will be flame broiled over direct gas flamer covered
with Lava rocks and delivered in a maximum time of 5 minutes.
Some of the marinated, prepared, but uncooked foodr will be
sold to thosr who would prefer to barbecue it at homy or in a
park, saving time and troubles of marinating or preparation
in the evening or early in the morning, as the case may be.
OBVIOUSLY, no Flame Broiled food dining would be complete
without Wine-ing.

Please take notice that no vested right to a building permit
shall accrue as the result of the granting of any land development
approvals and applications. Pursuant to the adoption of Ordinance
9.045 by County Santitation District No. 4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance of a sewer connection permit to a

will, in his opinion, cause the District to exceed its ability

Notice is hereby given that the Planning Commission of the City of Campbell
has set the time of 7:30 p.m., or shortly thereafter, on Tuesday, June 11, 1991,
in the City Hall Council Chambers, 70 North First Street, Campbell,
California, for public hearing to consider the application of Fabisco Industries,
Inc., for approval of a Use Permit to allow a beer and wine license in
conjunction with an existing restaurant, on property located at 1875 South
Bascom Avenue #118, in a C-2-S (General Commercial) Zoning District.

been prepared for this project.
5. Public Heariny to consider the application of Trammell
Crow Residential South Bay Associates, Inc., for a
Planned Development Permit to construct 348
multiple -family residential units or a 12.4 acre site,
located at 500 Railway Avenue, in a PD (Planned
Development) Zoning District. A Mitigated Negative
Declaration has been prepared for this protect. APN:
412-01-017, 412-03-003 S 004 File No. PD 90-07.
Notice is further given that Draft Negative Declarations have
been prepared for the above designated projects. This certifies
that no significant environmental impacts are anticipated with
the associated projects. Copies of the Draft Negative
Declarations, Initial Studies, project plans and other
documentation are available fc,- review at the Planning Department
located at 70 North First Street, Campbell, California. The
Public Review period for the Negative Declarations ends on June
10, 1991. All written comments should be received by the
Campbell Planning Department by this date.
The Public Hearings on the projects and the Draft Negative
Declarations will be held during the Planning Commission meeting
on Tuesday, June 11, 1991, as mentioned above.
Interested persons may appear and be heard at this hearing.
Please be advised that if you challenge the City's decision on
this matter in court, you may be limited to raising only those
issues you or someone else raised at the Public Hearing described
in this notice, or in written correspondence delivered to the
Campbell Planning Commission, at or prior to the Public Hearing.
