S.A. 76-10 Appeal by Fred L. Neeleman of a decision of the Planning
Life Style Dinette Director which gave -onditional approval to an application
and Den for signing to identit; Life Style Dinette and Den
lo,ated on property known as 1719 S. Bascom Avenue in a
C-2-S (General Commercial) Zoning District. (Applicant's
letter, copy of sign application and map attached).
STAFF RECOMMENDATION:
That .he Site and Architectural Review Committee review the proposed sign,
a- well as the recommendations of the Sign Review Committee, and make a
recommendation to the full Planning Commission.
STAFF DISCUSSION:
The applicant is appealing a decision of the Planning Director which required
the removal of: (1) the words "Bars - Stools" from a 4' x 8' sign, attached
to a pole and (2) an illustration (table and three chairs) from a 4' x 16'
sign attached to the building.
The Director's decision was based upon the opinion of the Sign Advisor and
the Sign Review Committee that the inclusion of the word, and illustration
made these signs larger than "necessary to adequately identify the occupants
of the premises and indicate the products or services offered." (Campbell
Municipal Code 21.68.060 (3) (A).

Dear Sirs:
This is an appeal as to the decisions that ycu made in regards
to our signs. We would ask at this time if y ou .,ould reconsider
two of the decisions that you made.
Our requests are as follows, along with our reLsons.
1. We ask that you allow us to leave the words Burs and Stools,
on our 4 x 8 street sign due to the fact that these words are ver•/
much helping to identify our business and products offered. Our
building sits too far off of the street to be properly be seen
by passin;; motorists. It +ould very much hamper the identity
of our business, and dossibiy cause a lose of business to us.
We will also be oxen for business in the evenings and our building
sign will not be illuminated. So it is very im,)ortait to have these
words added to our sign on the street.
2. We also ask that you all,w us to leave the dinette illustration
on our 4 x 16 building sign as we also feel that it helps in
identifying our business acid uroducts offered. It is a very
attractive illustration, and we have been using this sign as a
temporary sign and have had very favorable commen s on it.
We also invite ,,ou to come to our store and inspect it for
yourselves and we are sure you will agree that the sign is very
attractive and in no way would detract from the beauty of the
community.
We hope the move will convince you of the importance of these signs
to our business and that you will reconsider your decision.

Commissioner Pack reported that the Architectural Review Committee met with the
applicant and reconmends that the Planring Commission review a colored render-
ing of the proposed signs.

Councilman Hammer proposee and moves that the Appeal be granted
and that the decision of the Planning Coc!nission be reversed,
seconded by Councilman Paul e.,d granted by a majority vote, with
Couneilwaa Podgursek voting No.

To Whom it May Concern:
This is an appeal to the City Council of Campbell in regards
to the decision of the Planning Commission dening us a
dinette illusstration on our building sign on March 19, 1976. 4
The decision was based on section 21.68.060, of the
Campbell Municipal Code.
After reviewing the decision we feel that the above code
does not apply to our sign and that the decision was based
entirely on the Commissions personal thoughts, rather
then based on the law, and also feel the declsioi. was
unconstitutional.
The dinette illustration helps in tha identification of our
business and products offered and is not an individual sign
as stated in the above mentioned Municipal Code. We feel
the sign conforms to the law and we make this appeal in
hopes of getting a just and fair decision.

Please be advised that the Planning Commission of the City of Campbell, at
the regularly scheduled meeting of March 18, 1976, in considering your appeal
of a decision of the Planning Director:
(1) Approved your request for Bars and Stools" on the 4' x 8' sign to be
attached to the pole.
(2) Denied your request for a dinette illustration on the 4' x 161 sign to
u be attached to the building.
This denial was based on Section 21.68.060 (3) (A) of the Canpbeli Municipal
Code (C.M.C.) which states that:
(A) The number and size of indiviudal signs shall be no greater than is
necessary to adequately identify the occupants of the premises and
indicate the products or services offered. Unless essential for the
operation of the business, such signs shall be attached to or painted
on the building and parallel to the adjoining street.
Please be advised that Section 21.64.050 of the Campbell Municipal Code
provides that:
21.64.050 Appeals to City Council: Any person aggrieved by any decision of
the Planning Commission made under the provisions of this title may within ten
days from the date of such decision appeal to the City Council by written
notice of appeal filed in duplicate and shall set forth spec;fically wherein
the Commission's findings and decisions were in error.

Please be advised that Section 21.68.110 of the C.M.C. provides that:
21.68.110 Appeals from decisions. Any decision of the planning director,

commission. Such appeal shall be in writing and shall set forth the
reason(s) for the appeal and must be filed with the secretary of the+�A
planning commission within ten days from the date of decision of the
planning director. Any decision not appealed within ten days shall be
final.
