Commissioner Campos reported that the Architectural Review Committee recommends 4 approval of the application of James T. Harper subject to the conditions recommended by staff and with a change to Condition No. 3 which pertains to landscaping. Mr. Kee advised that it is the recommendation that the application be approved and that detailed plans showing elevations and additional landscaping come back to the Architectural Review Committee for review, Mr. Kee presented the plans for review by the Commission and he advised that the Architectural Advisor is of the opinion that the project is a very good one. The site laycut shows an entrance and some parking to the front and the major new building would be to the rear of the existing Jack -in -the -fox. The Site Approval Committee asked to see more detail of the building toi,er. The approval tonight would allow the project to go forward and the plans would come back to the committee showing more detail. Commissioner Pack reported that Mr. Boyce, owner of the property, is most anxious to c;o ahead with the project and is willing to go along with any stipulation t+,at the Commission makes. Harper, on behalf of the Harper, J. T. Bascom Avenue Associates, for approval of plans to construct two commercial buildings in the rear of property known as 1707-1725 South Bascom Avenue in a C-2-S (General Commercial) Zoning District. (See map attached). STAFF RECOMMENDATION: 1. Approval if landscape and elevation concerns can be resolved at site approval meeting, or 2. Continuance in order that the applicant may submit revised plans. 3. If approved, subject to the attached conditions, STAFF DISCUSSION: The applicant is proposing to remodel two existing commercial buildings and to construct two new commercial buildings. The four structures will cover approxi- mately 18'of the 189,200 square foot site. Building materials are indicated as stucco and wood walls with wood trim and flat tile roofing. The applicant is providing 255 parking spaces which would result in a ratio of one space for every 206 square feet of gross building area. The site plan indicates that approximately 18-: of the net lot area will be landscaped. The existing development is non -conforming in that it does not have the required 5'-0" of landscaping between the east property line and the parking area. Staff is of the opiniun that either this landscaping should be provided or the applicant should secure an exception to Section 21.51.040 (2) of the zoning code by providing a higher quality of landscaping. The Architectural Advisor is of the opinion that the new buildings look very good ani tie in well with the existing remodeled buildings. However, he has expressed some concern with regard to the lack of detailing of the location of the entry structures and tower. I did receive on Friday your letter and enclo- sures of March 14, 1990. I am reviewing with my client the detail of the Stipulated Judgment, but I wanted to make the following preliminary comments. First, the amount of settlement is $387,500 as confirmed in your letter of December 22, 1989, not the sum of $378,500 stated in Paragraph 2. I believe that the digits simply got transposed on typing. Seco;.d, I am not certain of the current interest rats as maintained by CalTrans. Your letter of January 17, 1990, states the rate of 8.336%, 'which is the nunber I aet forth in the letter of July 17, 1989. Under CCP Section 1268.350, the rate of interest for each six-month period (January 1 - June 30, and Jilt' 1 - December 31) is calculated by the Controller as the rate of earnings of the Surplus Money Investment Fund for each six-month period. Further, it is important to note that CCP Section 1268.360 provides for the compounding of interest for six- month periods. Thus, simple interest from December 1, 1988, as provided in Paragraph 2(a), is not correct. Page Two Fourth, it would be preferable that the City withdraws all money from the State Treasurer's Office, including any i-terest to which it is entitled, and then pay directly to the Defendant the total judgment together with interest. The way I read the proposed judgment, Plaintiff will deposit additional monies, including interest, and then the Defendants will have to withdraw the money from the State Condemnation Deposit Fund. Sine the City of Campbell has to withdraw its own funds, I would think the City would simply state the case has been settled and ask to withdraw all monies and then make the payment directly. Fifth, is the City not in a position to graft the ingress and egress easement now instead of waiting for the development agreement? In any event, I believe we should have some exhibit defining the ingress and egress now instead of awaiting a development agreement. CITY CF CAMPBELL PLANNIND DEPARTMENT Dear Norm: I have reviewed the settlement proposal outlined in your letter of July 17, 1989 with the City Council. Overall, your proposal does, in fact, appear reasonable, but the City has some concerns about specific aspects of your client's offer. With regard to the proposed parking credit, the City is in agre!ment that sixty (60) spaces would appear to be a suitable compromise. The proposed settlement offer with respect to the monetary compensation for the take, however, is a little more complicated. W;.th regard to the proposed compensation for the improvement.:, the City's updated appraisal reflecting the reduction in the take area from 15,639 square feet to 14,538 square feet places the compensation for the improvements at $27,300.30, which I have previously represented to you. The City presently believes that this appraised value is more accurate than the rough figure used to compute the compensation for the construction easement. This position seems consistent with your client's present request for $25.00 per square foot for the land value, even though we used the $23.00 per square foot for purposes of computing the rental value for the construction easement. August 4, 1989 Page two With respect to the land value, the City is somewhat more sympathetic to your client's position. However, although i have a great deal of respect for Mr. Desmond Johnson, I am presently unaware of any information that would tend to support his estimate of the property value. Furthermore, given that the City will be providing additional compensation in the form of the parking credit, it is difficult for the City to justify expending further consideration for the property in excess of the amount determined by our appraisal. Nevertheless, setting aside this latter point, I am presently authorized to offer the sum of $375,000.00 in compromise for the land and improvements, together with interests thereon from the date of possession. Similarly, your client's request for a directional sign as part of the settlement is also a point of concern for the City. It is the City's position that since your client did not have any directional sign directing traffic off of Campisi Way, the City does not feel obligated to provide such a sign to direct traffic off of Creekside Way. Of course, your client would be free to apply for an appropriate directional sign through the normal permit process. Finally, the City will naturally cooperate as necessary in providing an access easement from Creekside Drive to your clients property, and defining that easement. As you can see from the letter, Mr. Matteoni believes that he can convince his client to settle for $390,000.00 if this amount is agreeable to us. In reviewing this offer, it appears that the Defendants have accepted our figure for the cost of the improvements, while pegging the land costs at slightly under $25.00 square foot. Given that our appraisor has appraised the PG&E property just across the Creek at $25.00 per square foot. The proposal seems reasonable. I,n addition, the Defendants are legally entitled to interest on the compensation from the date of possession. The State of California would be responsible for the interest on the $362,300.00 which we deposited with the Court, and we would only then be responsible for the interest on the remaining amount. At present, the applicable interest rate appears to be. 8.336 %. At this juncture, I believe that it will prudent to accept the current offer. It appears that Mr. Matteoni is sincere about this being his client's final position, and proceeding to trial would undoubtedly cost at least $30,000.00 in additional attorney's fees and expert's costs. Furthermore, if our refusal of this offer was judged by Lhe. Cour` to be unreasonable, we could also be held liable for the attorney's fees of the opposite side. Taking all of this information into account, I believe that accepting the offer is the most prudent course of conduct. At the present time, we have agreed or the following terms in consideration of the transfer of clear title on the subject property to the City of Campbell: 1. The plans are generally satisfactory; however, we recommend that the 12-inch storm drain outfall be connected to the existing storm drainage system rather than cutting a hole in the exi-ting retaining wall. The area is not subject to flooding from the 18 flood flow on Los Gatos Creek. The creel: banks are protected, at present, by an old concrete retaining wall. The ability of this wall to with- stand earthquake forces, erosion, etc, is unknown. Therefore, we recommend that a 28-foot-wide strip of right of way be dedi- cated to the District, the limit of which would be l3cated 40 feet from the wall. An additional 23-foot easement for ingress and egress of District maintenance equipment should be dedicated adjacent to this easement. Parking would be satisfactory in the 23-foot easement, however, no planters or raised curbs should be installed. Also, an ingress and egress easement from Bascom Avenue to the above easement should be dedicated. At a meeting with the developer on July 26, 1977, it was s•:g- gested by the developer that the proposed road within the 28- foot right of way be allowed. However, if the wall ever failed in the future, this road would be abandoned and the bank sloped at a 2 horizontal to 1 vertical slope from the toe of the wall. The developer proposed this solution and will sign an agreement to this effect. Please make right of way arrangements with t1r. Don Lawrie of our Rcll Estate Division at extennion 261.
