Weisel, Hyman on the application of Hyman Weisel (filed by

property known as 1305 South Bascom Avenue.
Chairman Scott called on Mr. Kee for his comments.

The proposal is for a zone change from C-2-S to P-D to allow the
construction of 155 apartment units on 6.62 acres of land. The
resulting density would be 23 units per acre. The a -,a i; indicated
on the Specific Area Plan N4 for commercial land use, bit staff
is of the opinion that this would be a logical extension to the
north of residential land use, and it would not seem to dis^upt
the commercial land use on Bascom Avenue and future commercial to
the north.
Commissioner Hebard asked why the applicant was asking, for P-D.
Mr. Kee advised there was discussion between the applicant and staff
regarding planned development zoning and this would give review
of the plans by the Planning Commission and City Council. The
City would have better control of the development in terms of
density, location of the buildings on the property, etc.
Chairman Scott asked if anyone wished to speak in favor of the
application.
Mr. Ruth. of the firm of Ruth and Going, stated there are t1ro
separate parcels involved - one parcel is narrow and would be
difficult to develop in an apartment complex, but with the

addition of the other parcel a compatible development could be
accomplished. Fie stated that with the Prune Yard developing as
it is, it appears unlikely that the property to the north is
going to develop into a great commercial area. However, it can
be developed into a quality apartment complex. The Los Gatos
Creek makes an excellent buffer to the PG&E installation to the
rear. lie further stated that limited access to Bascom Avenue
would be insufficient to handle traffic that would be venerated
for a commercial complex on this site. He stated that the P-D
would give the Commission and Council snore control in the final
concept of the development and stated he would be happy to
answer any questions the Commission might have.
Commissioner Paul moved that the hearing be closed, seconded
by Commissioner Pack and unanimously adopted.
Resolution Commissioner Larson moved that Resolution

t presented a map delineating the area of the pro-

complex. Mr. Kee stated that the Planning Commis-
sion had approved this anplication by a 6-1 vote.
�- yr. Leo Ruth, Civil Engineer or Ruth and Goinv_,
represented Mr. Weisel. He spoke in behalf of the
application and explained the proposed development.
i Mr. Ruth introduced Mr. McLaren the architect, who
presented a rendering of the proposed apartment
complex.

There being no other persons present to speak
for or against the anplication, Councilman Podgorsek
proposes and moves that Vie hearing be closed,
seconded by Councilman Rogers and unanimously
adopted.
Councilman Podgorsek stated that he is opposed
to giving up commercial zoning in favor of P-D,
that we already have 2,500 units of apartments in
the City of Campbell.
Councilman Rogers stated that he agreed that
a smaller commercial development near the Fruneyard
would not be advisable.

Councilman Ropers proposes and moves that the
zoning as requested be granted, seconded by Council-
man Smeed and unanimously adopted with Councilman
Podgorsek voting No. j

STAFF RECOMMENDATION:
Approval, subject to approval of architectural and site plans
by the Planning Commission.
STA"F DISCUSSION:
the applicant is proposing a zone change from C-2-S to P-D (Planned
Development) for the purpose of constructing i55 apartment units
on 6.62 acres of land which will result in a density of approxi-
mately 23 units per acre.
Although the area is shown on the recently adopted Specific Area
Plan k4 for commercial land use, the staff is of the opinion that
this proposal would be appropriate at this location. The subject
area received considerable discussion when the plan was under con-
sideration by the Planning Commission and the land use recommended
by staff at that time was high -density residential or commercial.
Some of the main comments from the ciscussion related to the
fact that the property was now zoned commercial and because of
the ownership pattern multi -family residential would lik.:ly be
difficult to accomplish. The property immediately north of the
existing Aloha Apartments presented problems in relation to the
plan. The parcel has a relatively narrow width, the long depth and
access to frontage alcng Bascom Avenue. The parcel is under owner-
ship other than the area on to the north.

STATEME14T OF JUSTIFICATION

The subject property is basically undevelopable in its present
C-2S zoning located as it is behind existing strip commercial
developments and within one block of two existing shopping
centers. One of these shopping centers, the Pruncyard, is a
major new development still in the process of completion and
fulfills most all of the commercial needs cr the area. FDrther
commercial development would seem inappropriate.
The limited access to Bascom Avenue would be insufficient to
handle traffic that would be generated for a conmlercial project
on this site.
Multi -family residential use, particularly as would be per-
mitted under a planned development zone, appears to be a
logical economic land use. Only limited access to Bascom
Avenue is required to support a development of this size and
type and a residential use would be compatible with the neigh-
borhood as the present development along the southerly property
line Is multi -family residential.
It is felt that multi -family residential use for this property
will not only add to the tax base for a plrce of land that
might otherwise go undeveloped, but by mc..ns of the planned
development zone will prove an asset to the total coomwnity
environment.
As requested the attached Statement of Justification In connection
with thu suuject rezuning application is forwarded for inclusion as
a required exhibit. It is envisioned that construcCion on this pro-
ject would begin within one year from the date of 'IS" approvals,

DESCRIPTION OF PORTIONS OF THE LANDS
NOW OR FORMERLY OF LENA CAMPISI AND JOSEPN GIANNINI
TO BE REZONED FROM C-2-S TO C2S-PD
All that certain real property situate in the City of Campbell, County of Santa
Clara, State of California, being more particularly described as follows:
BEGINNING at the intersection of the Westerly line of South Bascom Avenue
with the Southerly line of that certain parcel of land described in the
Deed from Salvador Thomas Campisi, et at, to Jack -In -The -Box Develop.nent
Corp, recorded August 9, 1966 in Book 7467 of Official Records, page 706,
Santa Clara County Records; said Westerly line being parallel and distant
47.00 feet Westerly from the original centerline of former San Jose -Los
Gatos Road (60 feet wide); thence from said point of beginning along said
Southerly line and along the Southerly line of that certain parcel of land
conveyed by Salvadore Thomas Campisi, et al, to Mason Shaw, et al, by Deed
recorded August 13, 1968 in Book 8224 of Official Records of page 687,
Santa Clara County Records, North 89' 52' West 610 feet more or less to the
Southeasterly line of that certain strip of land 30 feet wide described
in the Deed from Mrs. Lena Campisi, et al, to County of Santa Clara, recorded
April 9, 1941 in Book 1029 at page 478 Santa Clara County Records; thence
Southwesterly along the general Southeasterly lines of said strip of land
589 feet more or less to intersection with the Southerly line of that cer-
tain 3.88 acre parcel of land described as Parcel One in the Deed from E.
Larsen to Joseph Giannini, et ux, recorded November 18, 1954 in Book 3011
at page 427, Santa Clara County Records; thence along said last named
Southerly line South 89' 52' East 687 feet more or less to the intersection
with a parallel line distant 250.00 feet westerly measured at right angles
from said Westerly line of South Bascom Avenue; thence Northerly along
said last named parallel line 153.12 feet more or less to the intersection
with the Northerly line of said 3.88 acre parcel; thence along said Northerly
line South 89' 52' East 50.00 feet to a parallel line distant 200.00 feet
Westerly measured at right angles from said Westerly line of South Bascom
Avenue, thence Northerly along said last named parallel line 279.90 feet
nr,e or less to the intersection with a parallel line distant 60.00 feet
Southerly measured at right angles from the first course in this description;
thence along said Iasi -named parallel line South 89' 52' East 200.00 feet
to the intersection with said Westerly line of South Bascom Avenue; thence
Northerly along said Westerly line 60.00 feet to the point of beginning,
containing approximately 6.6 acres.
