PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF C114PBELL APPROVING A USE PERMIT
ALLOWING THE ON -SITE SALE OF BEER AND WIFE IN
CONJUNCTION WITH A FULL SERVICE RESTAURANT, ON PROPERTY
LOCATED AT 2099 A. SOUTH BASCOM AVENUE, IN AN C-2-S
(GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF
MR. FARSHID REZAZADEH, UP 90-14.
After notification and public hearing as specified by law on the
application of Mr. Farshid Rezazadeh for a Use Permit and approval of
on -sale of beer and wine in conjunction with a full service restaurant,
on property located at 2099 A. South Bascom Avenue, in a C-2-S (General
Commercial) Zoning District, as per the application filed in the
Planning Department on October 19, 1990,; and, after presentation by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all the evidence presented, the Planning
Commission did find as follows:
1. The proposed use is incidental to the main operation of the full
service restaurant.
Restrictions placed on the hours of operation and on premise beer
and wine sales will enhance the compatibility of the use within a
the center, and the surrounding development
There is not an over -concentration of liquor licenses in the
immediate area.
4. There have been some disturbances to adjoining residences from
the shopping center due to the lata evening loitering.
Based on the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The establishment, maintenance, or operation of the use applied
for will not be detrimental to the public health, safety, peace,
morals, comfort or general welfare of persons residing or working
in the neighborhood of such proposed use, or be detrimental or
injurious to property and improvements in the neighborhood or to
the general welfare of the City.
2. The proposed site is adequate in size and shape to accommodate
the yards, wall, fences, parking and loading facilities,
landscaping and other development features required in order to
integrate said use with uses in the surrounding area.
3. The proposed site is adequately served by streets of sufficient
capacity to carry the kind and quantity of traffic such use would
generate.

4. The proposed use is compatible with the uses in the area.
5. The Conditions of Approval provide measures which reasonable
discourage late night loitering in the parking lot.
Based on the above findings, the Planning Commission does hereby grant
the requested Use Permit, subject to the following conditions:
1. Hours of Operation: Hours of operation are limited as follows:
- Sunday through Thursday - 11:00 a.m. t,.) 10:00 p.m.
- Friday and Saturday - 11:00 a.m. to 11:00 p.m.
2. Food vig_g: Food service must be available at all times when
beer and wine are available.
3. Entertainment: No live entertainment is permitted.
4. Beer and Wine sales: Use is limited on on -sale beer and wine
only, in conjunction with the full service restaurant. Sale of
beer and wine is permitted for patrons dining on the premises
only. Sale of beer and wine to be taken off the premises is
prohibited.
5. Security: Applicant to provide the following security measure
as approved by the Planning Director to mitigate parking lot
disturbances prior to issuance of the liquor license:
a. Retain security lighti.rg o` tha parking lot throughout
night time hours.
6. Six-Morth Review: If complaints relating to this application
are received by the City, the Planning Commission may review
this use permit in six -months and impose additional security
measures to mitigate said impacts.
The applicant is notified as part of this application that he/she is
required to comply with all applicable Codes and/or Ordinances of the
pity of Campbell and the State of California which pertain to this development and are not herein specified.

The Chairperson read the application into the record.
Director of Planning, Steve Piasecki presented the Staff Report noting that the
continuance was recommended in hopes that the property owner would discuss
security mitigation measures with the planning staff relative to problems
existing at the center. He reviewed the following:

Surrounding uses
Staff's changes to the Conditions of Approval tnat require the
applicant to 1) extend the perimeter wall height, 2) retain security
lighting of the parking lot, and 3) install a security gate.
Commissioner Alne asked Staff if the security gate would cause problems for the
Fire Department.
Mr. Piasecki stated there would be no problem since the lock would be one used
by the Fire Department under these circumstances.
Commissioner Wilkinson asked why so many security conditions were requested of
the applicant. Mr. Piasecki reviewed the testimony received at the last
meeting, and noted that, although problems were associated with other businesses
within the shopping center, it is Staffs belief that the sale of beer and wine
would increase the problems.
Discussion ensued relating to the appropriateness of requiring this applicant to
be responsible for security measures since:
He would have t3 depend on businesses closing after he closed to shut
and lock the gate.
The situation would exist whether or not Mr. Rezazadeh were allowed an
on -sale use of beer and wine or not.
Some of the expense should be absorbed by the owner of the shopping
center.
Commissioner Wilkinson suggested that amendments be made to the Conditions of
Approval eliminating Item No. 5, numbers I and 3.
The. Chairperson declared the Public Hearing open.
Public comments:
Mr. John Firueroa, 3404 Ridgemont Drive, Mountain View, owner of the adjoining
residential apartments, approached the Commission requesting that the problems
be resolved.

Mr. Farshid Rezazadeh addressed the Commission requesting approval of the
application. He noted the following:
He spoke with the property owner and the prrperty Owner would
extend the hours of night fighting and would provide a brighter
watt light bulb.
It would not be advantageous for the landlord to provide a higher
fence or a security gate, since he will not benefit from the
applicant's sales of beer and wine.
He will ensure that no one will leave his establishment drunk and
disorderly.
Further, Mr. Rezazadeh expressed the following concerns:
Problems occur after the Pizzeria is closed.
Problems occurred before his business began and will continue
whether or not I serve wine with meals.
He clarified the fact that the adjoining business did have a beer
and wine license approved by

of December 11, 1990, so that Staff and the applicant could contact the
property owner regarding further eevelopment of the security plan.

The applicant seaks approval of a Conditional Use Permit to allow
on -sale beer and wine license in conjunction with an existing Italian
Restaurant.
The applicant has contacted the owner since the previous Planning
Commission meeting and has stated that the owner intends to keep the
lighting on all evening for this development and intends to invzstigate
the provision of a security gate for the parking area.
SECURITY PLAN
Staff is recommending a condition of approval that requires the
applicant or property owner to implement a security plan including the
following features:
1) Extend the hours of security lighting which is mounted on the
building;
2) Install a security gate to prevent access to the rear parking
area during non -business hours; and,
3) Extend the rear fence height a minimum of 2' with a sight
obscuring treatment which is architecturally compatible to the
existing wall.

Mr. Tim J. Haley, Planner 11, presented the Staff Report, discussed Police
Department's review of the proposal, and noted the following opposition
received from two members of the public relating to the parking lot area,
as follows:
Excessive drinking
Loitering by youth
Throwing bottles/cans over tite fence
Trespassing onto private property
Mr. Haley stated that Staff will recommend approval with the addition of
conditions to resolve problems associated with parking lot activities by
submitting a security plan to the Police Chief and the Planning Director's
approval.
Cnairperson Perrine declared the Public Hearing open.
Public Comments:
Ms. Debra Nolan, Manager of apartments located at 52 Michael Drive,
addressed the Commission to express concerns relating to:
Loud music in the parking lot at late hours
Cars burning rubber in the parking area
People throwing beer cans over the fence
Tenants cars being scratched
She suggested that the fence between the parking area and the apartment be
raised to eliminate trash being thrown over the fence; and prevent people
entering the apartment parking area by climbing over the fence; and, that
better lighting of the parking area be required.
Commissioner Fox asked about the hours of operation and Mr. Haley reported
that the restaurant would not be open later than 10:00 p.m.
Chairperson Perrine asked Ms. Nolan if she believed the disturbances were
coming from patrons of the pizza parlor and Ms. Nolan responded that the
disturbances were caused by young adults drinking beer and wine in the
parking area as late 2:00 or 3:00 in the morning.

Commissioner Higgins suggested that a security gate would help to mitigate
Problems occurring at the apartment complex, that the problems are
occurring after the pizza parlor is closed.
Mr. Haley stated that since the problems are associated with improper
lighting and low fences, are inherent with the parking lot area itself,
and attractive to young adults for parking and drinking in the late
evenings and early mornings.
Discussion ensued between Commissioners and itaff regarding the following:
Continuance of the item

Mr. John Figueroa, 3404 Ridgemont Drive, Pruneyard Apartment Owner,
discussed the following:
Height of the fence
Presented two police reports relating to incidents in the
parking lot, a letter from the Police Chief requesting removal
of the chain link fence, and a letter from a tenant who
apprehended a burglar
Provided a petition sigma by the tenants requesting improved
security, all night lighting, and raising of the fence in the
rear parking lot area.
Mr. Figueroa requested that the applicant's request be denied until a
security plan is provided.
Commissioner Fox indicated that these problems are with the lot and not
associated with the pizza parlor business.
Chairperson Perrine stated that he would like to see the security plan,
and Commissioners Higgins concurred.
Commissioner Fox stated that he is not interested in placing the entire
burden on the applicant since the problems are relative to the lot.
Further, he asked the applicant if the Commission's continuation of this
application to the January g, 1991, meeting, would place an unnecessary
hardship on his business operation.
Mr. Razazadeh, the applicant, made the following comments:
Has experienced violations in the parking lot that required
Police intervention
The proposal is to provide, to the patrons of the restaurant,
wine or beer with the pizza and not as s. take out item
His business has only been in operation for four months, and the
problems have occurred for several years
A billiard hall has existed in the area for several years which
stays open until 2:00 a.m., and is attractive to young adults
Kids do not come into the Pizzeria to buy beer, adults come into
the restaurant to eat
Noted the expense to raise the fence and also noted that since
the property owner has no interest in the s31e of beer and wine
in conjunction with meals, that the property owner may not be

interested in raising the fence. Further, that the fence does not
belong to him and his business closes at 10:00 p.m., well before
the problems begin.
There are only 7 tables within the restaurant
Chairperson Perrin asked the applicant if he would object to continuing
the application in order to provide staff with time to investigate where
the problems are coming from. Mr. Razazadeh stated he would agree to a
continuance to the January 8, 1991, meeting. Mr. Razazadeh added that
problems will continue to occur whether or not his request is granted.
Mr. Piasecki indicated that additional time would provide Staff with the
opportunity to investigate mitigation measures with the property owner and
discuss Police patrol of the area.

The restaurant occupies approximately 1,200 square feet of an
existing retzil building and is located on the west side of Bascom
Avenue mid -block between Campbell Avenue and Apricot Avenue.
A. General Plan Designation: The site is designated for
commercial uses. The proposal is consistent.
B. Zoning Designation: The site is zoned C-2-S (General
Commercial). The proposal is consistent with the zoning
designation.

An aerial map is attached which illustrates the surrounding uses,
which serve alcohol: (1) Denny's; (2) Stuft Pizza; and, (3) Hickory
Pit.
The applicant is currently operating an Italian restaurant and
purposes to provide beer and wine for patrons dining on the
premises. No live entertainment is proposed. No other
establishment in the retail building sells alcoholic beverages on or
off sale.
The proposed hours of operation are:
Mondry - Thursday - 11:00 a.m. to 10:00 p.m.
Friday - 11:00 a.m. to '1:00 p.m.
Saturday - 12:00 p.m. to 11:00 p.m.
Sunday - 12:00 p.m. to 10:00 p.m.
This application was referred to the Police Department for review
and recommendation. The Police Department has not received any
calls for service to the business or the complex in general.
However, they have increased patrols to the residential developments
on Michael Drive behind the commercial property, due to concerns
expressed by residents of loitering and trespassing, located in the
parking lot area, of the retail center.
ISSUS
The Planning Department has received two communications (one written
and one verbal) from residents behind the commercial development.
Both have expressed concern regarding the existing problem occurring
in the parking lot area. This includes loitering by youth,
drinking, throwing bottles/cans over the fence, trespassim by
climbing over the fence, and noise from activity.

These same issues were raised last year when Campbell Billiards
applied for an on -sale beer and wine license. Due to the
restrictions imposed, the owner did not activate the Use Permit.
The Police Department has increased patrols of the adjacent
reLidential development due to these problems. However, it appears
the source of these problems stems from the parking lot activity.
Staff is recommending that some additional security measures be
developed to reduce these incidences as a condition of the Use
Permit.
Legally an "on sale" beer and wine license permits on premise sales
of beer and wine, and also sales of unopened six packs of beer AD$
bottles of wine for take out service. Staff recommends that the Use
Permit restrict sales of beer and wine to patrons eating 2D the

Dear Ms. Grennan:
Thank you for the copy of your recent letter to the Planning
Commission regarding the request by Tagliaccio Pizzeria for a beer
and wine license. I have recently been in contact with your
landlord, Ms. Pat Figueroa regarding this issue, as well as the
general security of 5: Michael Drive.
I have recommended to Ms. Figueroa that the old cyclone fencing in
the rear lot of 52 Michael Drive he removed. This will greatly deter
the use of your parking area as a "cl.t-through" or escape route.
As you have already noticed, we have begun aggressive patrols of that
back lot near the billiard parlor. I have also personally spoken to
the owners of the billiard parlor and pizzeria. They have promised
to call us whenever they observe loitering in that back lot. You and
other tenants of 52 Michael should do this also, anytime, day or
night.
As far as at the beer and wine license is concerned, my
recommendation is that the owner agree to on -premise sales only and
not allow any beer or wine in open or closed containers leave the
premise. Legally, a beer and wine "on -sale" license allows the
licensee to sell six packs of beer or bottles of wine, unopened, "to
go". The people causing the problem in the rear lot are bringing in
their own beer, probably purchased at the 7-11.
Please let me or Pat know how things go in the future. You may rest
assured we will be keeping a close watch on this.

The Planning Commission at its meeting of December 11, 1990, continued
the consideration of the application for your tenant for a beer 'and
wine license in conjunction with his pizza restaurant. The Commission
requested that you or the applicant address the following issues:
1) Extending the fence heightn along the rear of the property;
2) Providing additional lighting in the parking area during the
evening hours;
3) Providing security fencing to preclude the loitering in the
rear parking area; and,
4) Providing a security plan to address loitering in the
parking area.
The Commission requested that the Planning Staff contact you as the
property owner in that some of the items would be better addressed by
the property owner than by the tenant.

On November 7, 1990, SgL. Milosovich completed an inspection of the premises.
Inspection revealed that business was light, with no signs of unruly patrons.
Discussion with the owner disclosed that owner is looking for "on -sale" beer and
wine only, for two reasons:
1. Is in keeping with ambiance of pizza/Italian food items
2. Does not wish to contribute to problems of off -site beer drinking
There is some concern expressed that the adjacent business, Campbell Billiards,
sells alcoholic beverages to minors, and that these minors sometimes congregate
in the common parking area.
In researching our galls -for -service files, I find no responses to this business, nor
to the complex in general.
Based on above, I have no addenda items which should be included in any proceeding on
your part.

REGARDING EFFECT OF WASTEWATER
TREATMENT CAPACITY ON LAND
DEVELOPMENT APPROVALS PURSUANT TO
DEVELOPMENT OF APN
Please take notice that no vested right to a building permit
shall accrue as the result of the granting of any land development
approvals and applications. Pursuant to the adoptiin of Ordinance
9.045 by County Santitation District No. 4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance of a sewer connection permit to a
building, or proposed building, on the above described property,
will, in his opinion, cause the District to exceed its ability
to treat adequately the wastewater that would result from the
issuance of such connection permit, then ,;aid permit may not
be issued, and, hence, no building permit may be issued by
this agency.
If the sewer connection permit is issued, it may contain
substantive conditions designed to decrease the wastewater
associated with any land use approval.
