amended. Said amendments being outlined on the map attached hereto

Mayor Paul advised that he is abstaining from voting
on this application.
Discussion followed Mr. Kee's presentation with regard
to uses for the property.
Mayor Paul declared the public hearing open and asked
if anyone in the audience wished to speak for or against
the proposed amendment to the General Plan,
Mrs. Barbara McNally, representing BW Construction Company,
spoke in behalf of the proposed amendment.
Mrs. Lynn Mitchell, 16329 Mozart Avenue, spoke in favor of
the proposed development.
Mr. John Miller stated that be was in favor of the
development.
Mr. Don Rose, 1095 Hazelwood, inquired if this property was
in the Los Gatos sphere of influence. He was informed
that it was in the City of Campbell sphere of influence.
M/S: Chamberlin, Doetsch - to close the public hearing
Motion unanimously adopted.
Lenghty discussion followed with regard to uses for
the property.
M/S: Doetsch, Chamberlin - to go back 200 feet from
Bascom Avenue for PO development and the balance to be
used for low -medium density residential. Motion carried
by 2-1-1-1 - Councilman Podgorsek voted No.
M/S: Doetsch, Chamberlin - to intruduce ordinance
approving GP 80-1 - Motion adopted by 2-1-1-1 vote,
Councilmen Podgorsek voted No.
M/s: Doetsch, Chamberlin - to waive further reading of

RECOMMENDATION
That the City Council adopt the attached ordinance approving an amendment to the
Land Use Element of the General Plan from "Professional Office" and "Low Density
Residential" to "Professional Office and/or Lew -Medium Density Residential" for
the property having frontage on Bascom Avenue and on Mozart Avenue, as shown in
Exhibit A.
DISCUSSION
At the present time, the Land Use Element of the Leneral Plan in this area indicates
a "Professional Office" land use for those properties having frontage on Bascom
Avenue. The depth of this professional office designation is approximately 200
feet from the westerly line of Bascom Avenue. The balance of the area, including
;1. of the properties having frontage on Mozart Avenue is presently indica—d as
"LCM' Density Residential".
The applicant requested that the Land Use Element of the General Plan be amended
from "Professional Office" and "Low Density Residential" to "Professional Office
and/or Low -Medium Dens`*!. Residential".
The existing land uses for;Oe surrounding properties are as follows: to the
north - townhouses; to the west and south - orchard; and to the east - orchard
and townhouses.
The Council may recall that a similar request for an amendment to the General
Plan was considered for the property to the north in 1978. At that time, the
applicant was requesting an amendment to allow a "Medium Density Residential"
land use in addition to "Professional Office". The staff had recommended that
the medium density be allowed for those properties having frontage on Bascom
Avenue. On May 16, 1978, the Planning Commission adopted Resolution No. 1700,
which recommended the "Professional Office and/or Medium Density Residential"
land use. On June 12, 1978, the Council gave first reading to an ordinance
approving the requested amendment. On July 24, 1978, when this matter was
considered for second reading, the Council amended its earlier action and
voted to allow only professional office use for the properties fronting on
Bascom Avenue. Due to the fact that the County zoning for this area allows
residential development, the applicant continued to process an application at
the County level, resulting in approval of the 64-unit development.

It is the Commission's opinion that the current proposal to allow "Professional
Office and/ur Low -Medium Density Residential" is compatible with the residential
development, both existing and planned, frr properties on Bascom Avenue to the
north of the subject property. The proposed combination of uses would also be
consistent with the present County zoning ordinance which allows residential
development in the P-0 (Professional Office) zone.
At its meeting of January 15, 1980 the Planning Commission adopted Resolution
No. 1858, by a 6-0-1 vote, recommending approval of this General Plan,
amendment.

We respectfully request a change in your General Plan
for the corner of Saouth Bascom Avenue and Mozart Avenue.
This property is currently located in the County,
"Campbell Sphere of Influence".
We would like the General Plan to continue to reflect
offices for up to 200 feet to the West from South
Bascom and roughly 292 feet from Mozart North to the
Gutierez property.
On the remainder of the indicated property, we would
like the designation to be low -medium density (6-13 DU/AC).
It is our objective to build Townhomes for owner occupancy.
The office portion of our request seems to represent
no conflict with your current. General Plan designation
as an appropriate use for South Bascom Avenue.
We submit a low -medium density on the remaining two
acres would serve the community in several ways. Town -
homes provide an excellent buffer between office use and
single family detached dwellings. Although there will not
be a large number of units, this change will help
provide some of the housing which is critically needed
in the community. Townhomes can do this at a much
more reasonable cost than single family detached, and
therebv open the housing market to a larger number
of people. It has been our policy, and will continue
to be, to make every effort to sell with owner
occupancy intended. Building housing in already
established urban areas is the goal of the municipalities
as well as that of the County. This location is close

Mr. Kee concluded that it is the staff's opinion that the current proposal
to allow "Professional Office and/or Low Medium Density Residential" is
compatible with the residential development, both existing and planned, for
properties on Bascom Avenue to the north of the subject property. The

Chairman Campos opened the public hearing and invited anyone in the audience
to speak for or against this item.
Mrs. Barbara McNally, representing BW Construction, appeared before the
Commission to answer any questions they might have. She explained that
the frontage on Bascom is proposed for Professional Office use and the
remainder is proposed for residential use.
Ms. Martha Freitas of 1618 Mozart appeared before the Commission to speak
in favor of the lower density for Mozart, noting that the traffic has s
become a problem in that area with the recent construction of condominiums
in the area.

No one else wishing to speak, Commissioner Pack moved that the public
hearing be closed, seconded by Commissioner Meyer and unanimously adopted.

CITY OF CAMPBELL CALIFORNIA
PROJECT DESCRIPTION: General Plan Change
Per Planning staff, questions 8-20: Since this -is a
general plan change request, the particulars of the
project are unknown. The project on the site will
be dependant on the Campbell General Plan. The
current intent is for office use along the Bascom
frontage and a townhome development on the remaining
acerage.
33• The attached photos show views of the site --In its
current vacant state. The site is underlain by
Pleasanton gravelly loam. It has good natural drainage,
no erosion hazards, and the shrink/swell capacity is
only moderate.
There are no identified earthquake faults on the site.
It is not in an Alquist-Priolo zone -
There are no historic, cultural, or known archaelogical
sites on site, nor are there any natural features of
significant scenic value with rare or unique
characteristics.
The on site structures in addition to the main house
and Kelly Kennels are seven single family detached
dwellings, three of yhich are move-ons.
34. Land uses surrounding the property include: one single
family detached home to the North west and some high
density for sale units under construction; vacant to
the West (adjacent to the Transportation Corridor);
vacant and older single family detached to the East;
vacant to the South (see attached photos). No known
rare or endangered species inhabit the area and there
are no significant cultural, historical or scenic
features in the vicinity.
