Chairman Kasolas reported that the Site and Architectural Review Committee
is recommending approval of this item.
Planning Director Kee stated that Staff is in agreement with the
recommendation for approval.
Chairman Kasolas opened the public hearing and invited anyone in the
audience to speak for or against this item.
Mr. Larry Laguire, Prodis Architects, appeared before the Commission to
answer questions. Mr. Laguire pointed out that the average length of stay
at the facility is three da7s; that the facility will have a 20 bed
capacity; and, that the applicant is in agreement with Staff comments and
redlining of plans.
Dr. Harvey Knoerachild explained that this use is a pilot study recently
authorized by the State, and this facility will be one of six in
California. The concept is to put patients in a quiet atmosphere which
will allow :hem to become ambulatory at a faster rate, at a lesser cost
than a hospital. The facility will have a full medica'. staff, have it's
own van, and will be completely self-contained.

BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL APPROVING A USE PERMIT
ALLOWING THE CUNSTRUCTION OF A NON -HOSPITAL
FACILITY FOR THE POSTOPERATIVE CARE OF HEALTHY
AMBULATORY SURGICAL PATIENTS ON PROPERTY KNOWN AS
14351 S 14371 S. BASCOM AVE. (APPLICATION OF
RECOVERY INNS OF AMERICA, INC., OF 86-16).
After notification and public hearing as specified by law on the application of
Recovery Inns of America, Inc. for a Use Permit and approval of plans to allow
the construction of a non -hospital facility for the postoperative care of
healthy ambulatory surgical patients with as average stay of 3 days on
property known as 14351 S 14371 S. Bascom Ave. in an R-3-S (High Density
Residential) Zoning District, as per the application filed in. the Planning
Department on November 13, 1986; and, after presentation by the Planning
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
'Ind as follows:
1. The proposed project is an appropriate scale in relationship to the
adjacent developed uses.
2. The building design is considered acceptable and interesting by the
Architectural Advisor.
3. Substantial landscaping has been provided which adds to the aesthetics of
the project.
4. The establishment, maintenance or operation of the use applied for will not
be detrimental to the health, safety, peace, morels, comfort or general
welfare of persons residing or working in the neighborhood of such proposed
use, or be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
5. The proposed use is compatible with the uses in the area.
6. The use is essential or desirable to the public convenience or welfare, and
is in harmony with the various elements or objectives of the City's General
Plan.
Based on the above findings, the Planning Commission does hereby grant the
requested Use Permit, subject to the following conditions:
1. Revised elevations and/or site plan indicating Porte cochere to be
submitted to the Planning Department and approved by the Planning Director
upon recommendation of the Architectural Advisor prior to application for a
building permit.

2. Property to be fenced and landscaped as indicated and/or added in red on
the plans. Landscaping and fencing shall be maintained in accordance with
the approved plans.
3. Landscaping plan indicating type and size of plant material, and location
of irrigation system to be submitted to the Planning Department and
approved by the Site and Architectural Review Committee and/or Planning
Commission prior to issuance of a building permit.
4. Fencing plan indicating location and design details of fencing to be
submitted to the Planning Department and approved by the Planning Director
prior to issuance of a building permit.
5. Applicant to either (1) post a faithful performance bond in the amount of
$5000 to insure landscaping, fencing, and striping of parking areas within
3 months of completion of construction; or (2) file written agreement to
complete landscaping, fencing, and striping of parking areas. Bond or
agreement to be filed with the Planning Department prior to application for
a building permit.
6. Applicant to submit a plan to the Planning Department, prior to
installation of PG&E utility (transformer) boxes, indicating the location
of the boxes and screening (if boxes are above ground) for approval of the
Planning Director.
7. All mechanical equipment on roofs and al: utility meters to be screened as
approved by the Planning Director.
8. Building occupancy will not be allowed until public improvements are
installed.
9. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
10. Underground utilities to be provides as required by Section 20.16.070 of
the Campbell Municipal Code.
11. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
12. Sign application to be submitted in accordance with provisions of the sign
Ordinance for all signs. No sign to be installed until application is
approved and permit issued by Planning and Building Departments (Section
21.69.030 of the Campbell Municipal Code).

13. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single-family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
14. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self -closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to tFc trash enclosure area to service
these containers.
15. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from
the property. Sect. 11.201 6 11.414, 1979 Ed. Uniform Fire Code.
16. Applicant shall comply with all appropriate State and City requirements for
the handicapped.

facility.
The applicant is notified as part of this application that he/she is required

STAFF RECOMMENDATION
1. That the Planning Commission accept the Negative Declaration which has
been prepared for this project; and
2. That tho Planning Commission adopt the attached findings and adopt a
resolution approving this project, subject to the attached conditions.
STAFF DISCUSSION
The applicant is requesting approval of a conditional use permit to allow
the construction of a short-term convalescent hospital on the project
site. The site is located along the west side of Bascom Ave. in an area
shown for high density residential on the City's General Plan. A
convalescent hospital or hospital use is a permitted use in any zoning
district subject to the approval of a conditional use permit.
The subject properties involved in this project include approximately .87
acres with a 215 foot frontage along Bascom Ave. The existing land uses
surrounding the site are as follows:
North: townhome project
Scuth: single family residential
East:
West: single family residential
The proposed project will accomodate a 20 patient facility which handles
the postoperative care of healthy ambulatory surgical patients. A staff
of six employees is estimated.
The site plan indicates that approximately 32 percent of the project will
be covered by the building. Landscaping is shown to encompass 33 percent
of the project site. The majority of `.he landscaping is provided along
the street frontage and in proposed courtyards, however, a substa,tial
perimeter landscape area is provided around the parking area. Two
existing trees or the site have been retained.

Building elevations indicat- the provision of 29 parking spares (27
standard, 2 handicapped) for this project. The provided parking eceeds by
4 the required number of parking spares for a hospital use of 1.25 spaces
per bed. The proposed project additionally provides a circular driveway

Bascom Ave. frontage.

Ordinance for all signs. No sign to be installed until application is

13. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with O.,en Valley Disposal Company. This requirement applies to all
single-family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
14. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid all or fence and have self -closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to service
these containers.
15. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall he secured by having
windows boarded up and doors sealed shut, or be demolished or removed from

Item 19.
Institutional Use
The primary function of the project is to provide a non -
hospital facility for the postoperative care of healthy
ambulatory surgical patients. The average length of stay will
be 8 days.
The estimatednumber of employees per shift will be approximately
six people. The facility will house 20 patients in private
rooms which will include a private bathroom in each room.
The facility will benefit the community by providing a cost-
effective health-care facility for healty, ambulatory patients
who do not require acute -care hospitalization after surgery.
The facility will also provide a first class, quiet, appealing,
"Private Inn" environment in the community.

The site currently contains two single-family residences
which will be removed by this development.
The site is virtually flat, with stable soil conditions,
and contains no endangered flora or fauna. There are
no historical or scenic aspects of the buildings and site
that would require preservation,.
