Accessibility Letter of Opinion

INTRODUCTION
At the request of Springbridge International School (Client), Marx|Okubo Associates, Inc.
(Marx|Okubo) has prepared a Letter of Opinion regarding the elevator requirements at the
altered property located at 1625 West Campbell Avenue. According to the information
provided to us from the Client on July 18, 2019, the project is an existing two-story private
school building that was renovated in 2017. In March 2019, the Client submitted an application
to modify a previously-approved Conditional Use Permit to allow an increase in capacity for the
existing commercial daycare facility. Marx|Okubo has reviewed limited construction drawings
for compliance with the 2010 Americans with Disabilities Act Standards (ADAS) and Chapter
11B of the 2016 California Building Code as it relates to elevator requirements at the altered
property.

FINDINGS
Section 36.404(a) of the 2010 ADAS states the following:
(a) This section does not require the installation of an elevator in an altered facility that
is less than three stories or has less than 3,000 square feet per story, except with respect
to any facility that houses a shopping center, a shopping mall, the professional office of
a health care provider, a terminal, depot, or other station used for specified public
transportation, or an airport passenger terminal.
(1) For the purposes of this section, professional office of a health care provider means a
location where a person or entity regulated by a State to provide professional services
related to the physical or mental health of an individual makes such services available to
the public. The facility that houses a professional office of a health care provider only
includes floor levels housing by at least one health care provider, or any floor level
designed or intended for use by at least one health care provider.
Section 11B-202.4 of the 2016 CBC states the following:
9. Certain types of privately funded, multistory buildings and facilities were formerly
exempt from accessibility requirements above and below the first floor
under this code, but as of April 1, 1994 are no longer exempt due to more restrictive
provisions in the federal Americans with Disabilities Act. In alteration
projects involving buildings and facilities previously approved and built without
elevators, areas above and below the ground floor are subject to the
20-percent disproportionality provisions described in Exception 8, above, even if the
value of the project exceeds the valuation threshold in Exception 8.
The types of buildings and facilities are:
1. Office buildings and passenger vehicle service stations of three stories or more and
3,000 or more square feet (279 m2) per floor
2. Offices of physicians and surgeons
3. Shopping centers
4. Other buildings and facilities three stories or more and 3,000 or more square feet (279
m2) per floor if a reasonable portion of services sought and used by the public is
available on the accessible level

CONCLUSION
The building was not originally constructed with an elevator and is less than three stories. In
addition, the building does not meet any of the building types accepted from the elevator
exemption. In our opinion, the project as presented, complies with the requirements for
alterations to existing buildings as it relates to the installation of an elevator.
