Realty Co. Hamilton on behalf of Cooper-Challen Realty Co. for
a use permit and approval of plans and slevations.to
establish a professional office in an existing office
structure on property known as $55 U. Campbell Avenue
in a P-F (Public Facilities/Public, Semi -Public) Zoning
District.
Mr. Kee reported that the subject property was the location of the administrative
offices of the Campbell Water Company. When San Jose Water Works took over the
Campbell Water Company earlier this year, all administrative and office personnel,
as well as records, were relocated to the San Jose Water Works main offices in
downtown San Jose.
At the present time, the applicant is requesting approval of a use permit to allow
the continued use of the building at 555 West Campbell Avenue for general offices.
The reason the use permit is required is because of the fact that the property is
zoned P-F (Public Facilities). Section 21.35.030(8) of the Zoning Ordinance allows
"Other uses which are compatible with the semi-public character of the district"
subject to approval of a use permit.
it is the staffs opinion that the continued use of this property for general
offices is compatible with the intent of the Zoning Ordinance and with the
surrounding land uses. The total area of the existing office building, and
what was formerly the meter repair building, is 2.520 square feet. Seventeen
parking spaces (six of which are covered) are provided for this site. resulting
in a parking ratio of one space for every 148 square feet of gross floor area.
The applicant is not proposing any changes to the exterior of the building except
for signing, which will be reviewed under a separate application.
City Attorney Dempster explained that the City Council decided that it would be
best for the present owners to apply for a use permit and go through the public
hearing process for this use.
Vice Chairmen Kasolas opened the public hearing and invited anyone in the audience
to speak on this item.
Mr. Jerry Hamilton, applicant, appeared before the Commission to speak in favor
of this application.
Mr. Homer Hyde also appeared to speak in favor of this application. noting that
the proposed use is no more intense than the previous use.
No one else wishing to speak, Commissioner Pack moved that the public hearing
be closed, seconded by Commissioner Meyer and unanimously adopted.
RESOLUTION NO. 1913 Commissioner Pack moved that the Planning Commission
adopt Resolution No. 1913 approving UP 80-15, seconded
by Commissioner Meyer.
Discussion
Commissioner Dickson stated that he 1s in opposition to this motion since he
does not feel the use is semi-public.

RESOLUTION NO. 1913
After notification and public hearing as specified by law on the application
of Mr. Jerry Hamilton on behalf of Cooper-Challen Realty Company for a use
permit and approval of plans and elevations to establish a professional
office in an existing office structure on property known as 555 M. Campbell
Avenue in a P-F (Public Facilities) Zoning District, as per application filed
in the Office of the Planning Department on June 18, 1980. and after presentation
by the Planning Director, proponents and opponents, the hearing was closed (UP 80-15).
After due consideration of all evidence presented, the Commission did find as follows:
That the establishment, maintenance, and operation of the proposed use
will not be detrimental to the health, safety, peace, morals, comfort,
or general welfare of persons residing or working in the neighborhood
of such use, or be detrimental or injurious to the property and improve-
ments in the neighborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby grant the
requested use permit.
The applicant is notified as part of this application that he/she shall comply
with all applicable Codes or Ordinances of the City of Campbell which pertain
to this development and are not herein specified.
PASSED AND ADOPTED this 15th day of July, 1980 by the following roll call

As you well know, the Campbell Water Works has, for
approximately twelve years, occupied the single -story office
building at the above address and located on approximately 2.79
acres at the northeasterly corner of Campbell Avenue and San
Thomas Expressway.
The Campbell Water Works will be totally owned and
operated by the San Jose Water Works on and after May 9, 1980.
In that all administrative and general office personnel and
records will be relocated immediately to the main offices of the
San Jose Water Works at 374 West Santa Clara Street, San Jose,
the above office building will be vacant except that . . .
On or about June 9, 1980, my corporation has leased and
will occupy it. Yes, after some 93 years in downtown San Jose,
we will relocate to your City!
For your information, we have been and are the property
consultant and agent for the San Jose Water Works and our occu-
pancy of this property will therefore not conflict but rather
compliment the continued functions on -site relative to water stor-
age, transmissions and the computer control thereof. Security is
most -important to the Water Works and in that a great deal of
common ingress and egress will continue, the Water Works did not
desire a non -afflicted tenancy in the office building.
Further, and ultimately, the vacant and surplus area of
the property will be evaluated as to its development potential.
This, of course, will require considerable interface with you and
all other departments of your City and will require, undoubtedly,
a change to the General Plan Land Use Designation and Rezoning.

This being the law and place for public hearing on the
application of The Campbell Water Company for a Use permit
to construct an office building with off-street parking and
related appurtenances on property located at 547 W. Campbell
Avenue, Chairman Woodfill declares the hearing open.
Commissioner Hyde disqualifies himself for personal
reasons.
Homer H. Hyde, representing the Camptell Water Company
was present and stated that his company wished to consolidate
their office and othe, existing water company •ises In this
area, In order to expand their office facllitl,.s and better
serve the public. This would provide better and more economical
service over a period of time. This operation, he feels,
will be compatible with the future development of the area
due to the San Tunas Expressway Intersection to the West. He
further stated that there would be no drive -In window In
connection with this operation.
There being no further persons to spak for or against
the proposed Use Permit, Commissioner Tomlinson moves that
the hearing be closed, seconded by Caenlssloner Mosley and
unanimously adopted.

Discussion
Pursuant to our discussion of June 4, 1980, you requested that a chronology
of City actions pertaining to the subject property be prepared. You may
recall that a question was raised by Councilman Paul regarding the use of the
building for a real estate office once the Campbell Water Company vacated the
premises. After reviewing the record, the following information may be of
some assistance to you in arriving at your interpretation of the Code.
1. January 22, 1963
On this date the Planning Commission approved a Use Permit to allow
construction of an office building on the subject property, subject
to the condition that plans be presented for architectural approval
prior to construction. A copy of the Planning Commission minutes of
January 22, 1963, pertaining to this matter, is attached as Exhibit A.
Also attached, as Exhibit B. is a copy of Use Permit No. 143. The
notice of hearing is attached as Exhibit C.
2. The Zoning on the referenced property at the time the use permit was
approved was R-1 (Simile -Family Residential).
3. On March 2, 1965, the Planning Commission approved S 65-12, approving
plans for an office building. A copy of the pertinent Planning
Commission minutes is attached as Exhibit D.
4. On January 28, 1974. the City Council adopted Ordinance No. 927,
which established P-F (Public Facilities Zoning) on the subject
property. A copy of the P-F section of the Zoning Ordinance
is attached as Exhibit E.
5. On May 6, 1980, a letter was sent to me from Cooper-Challen Realty
Company (Exhibit F) indicating that the Campbell Water Company
would be totally owned and operated by the San Jose Water Works
after May 9, 1980. The letter also indicated that the Campbell
Water Company offices and personnel would be relocated to the
San Jose Water Works offices.
6. The letter referred to in No. 5, above, indicates that Cooper-Challen
Realty is the property consultant and agent for the San Jose Water
Works. In addition, the Water Works did not desire a non-affiliated
tenancy in the office building since common ingress and egress will
continue.

The following comments may be helpful:
(1) It would seem that an office use could probably be continued under
provisions of the Use Permit which indicates approval "to construct
In office building..." on the subject property. The application
was, however, filed by a public utility in an R-1 zone. A npw use
permit would certainly clarify the situation, if in fact, San Jose
Water Works or their representative (Cooper 6 Challan Realty) could
obtain approval from the Planning Commission.
(2) Since the property is currently owned by a public utility, it would
not seem appropriate to propose a rezoning of the property at this
time. In talking with Mr. Hyde of the San Jose Water Works, no
plans are in progress to subdivide or sell a portion of the property.
(3) A change from one office use to another office use may qualify under
the non -conforming section of the ordinance since the original office
use was established in an R-1 zone.
(4) Cooper Challan Realty Co. has indicated that they are property
consultants and agents for San Jose Water Works and that their
occupancy of this property would not conflict but rather compliment
the continued functions on site relative to water company operations.

This being the time and place for public hearing on the
application of The Campbell Water Company for a Use permit
to construct an office building with off-street parking and
related appurtenances on property located at 547 W. Campbell
Avenue, Chairmen Woodfill declares the hearing open.
Commissioner Hyde disqualifies himself for personal
reasons.
Slower M. Hyde, representing the Campbell Water Company
was present and stated that his company ,ylshed to consolidate
their office and other existing water company uses In this
area. In order to expand their office facilities and better
serve the public. This would provide better and more economical
service over a period of tin , This operation, he feels•
will be compatible with the future development of the area
due to the San Tomas Expressway Intersection to the West. He
further stated that there would be no drive -In window In
connection with this operation.
There being no further persons to spok for or against
the proposed Use Permit, Commissioner Tomlinson moves that
the hearing be closed, seconded by Commissioner Healey and
unanimously adopted.
Commissioner Smeed moves that the Use Permit appl btion
be approved subject to the following conditions:
1. Applicant to present plans for "S" Approval prior to
construction of office.

to insure landscaping in accordance with plan,
within 6 months after completion of construction.
S. Landscaping plan to be submitted to Planning Direc-

It was also noted that on-rtrest parking would be
prohibited in front of this property.

21.35.010 Reserved. The P-F public facilities district
is reserved for the construction, use and occupancy of gov-
ernmental, public utility and educational building% and
facilities, and other uses compatible with the semi-public
character of the district. (Ord. 853 (part), 1972).
21.35.020 Permitted uses. Uses permitted without use
permits shall e as follows:
(1) Buildings and facilities owned, leased or operated
(whether in a governmental or proprietary capacity) by the
city, the county, the state, the United States of America,
any public school district or any other public district with-
in the city. (Ord. 853 $a. 1972). A

21.35.050 Uses subject to conditions and standards.

(3) The maximum structural coverage shall not exceed

The fo ow ng •pecia visions shall apply to all commer-
cial and industrial districts within the city. Where any
use within a specific zoning district is deemed to be an out-
door business activity as defined in Section 21.02.115, the
following provisions, in addition to all other requirements
of the ordinances and codes of the city shall apply.
Such uses shall be permitted only if located and designed
as provided in Sections 21.36.020 through 21.36.060. Any out-
door business activity legally existing at the time of enact-
ment of this section, however, shall be considered as a permitted
use, but it may not be extended, expanded, enlarged, remodeled
or replaced with the same or any other outdoor business ac-
tivity unless and until a permit is first obtained as pro-
vided in Sections 21.64.010 through 21.64.060 and the plan-
ning commission finds that the use will not impede the proper
development of the area. Unless a variance is granted in ac-
cordance with Chapter 21.66, any extension, expansion, an-
largament, remodeling or replacement shall meet all other pro-
visions of this code. (Prior code f9315.6.2(part)).

As you well know, the Campbell Water Works has, for
approximately twelve years, occupied the single -story office
building at the above address and located on approximately 2.79
acres at the northeasterly corner of Campbell Avenue and San
Thomas Expressway.
The Campbell Water Works will be totally owned and
operated by the San Jose Water Works on and after May 9, 1980.
In that all administrative and general office personnel and
records will be relocated immediately to the main office• of the
San Jose Water Works at 374 West Santa Clara Streit, San Jose,
the above office building will be vacant except that . . .
On or about June 9, 1980, my corporation bas leased and
will occupy it. Tea, after some 93 years in downtown San Jose,
we will relocate to your City!
For your information, we have boon and are the property
consultant and agent for the Son Jose Water Works and our occu-
pancy of this property will therefore not conflict but rather
compliment the continued functions on -site relative to water stor-
