Eliminate Parking Exception (reducing seating capacity)
Reinstate Parking in-Lieu Fee
Background
Current Requirement: CUP required if a restaurant includes:
Sale of distilled spirits (not beer and wine)
A separate bar area (eg., Aqui’s “Saddle Bar”)
Operation after 11:00 PM (“late night” hours)
Live entertainment in association with any of the above
Subject to Downtown Alcohol Policy
New CUP Requirement
Suggested Requirement:
List “restaurant” as a conditionally permitted use in the C-3 Zoning District , requiring a Conditional Use Permit.
Exempt restaurants locating within a tenant space currently occupied by a non-conforming office or salon.

Foster a balance of day and evening activity in the downtown;
Maintain a balanced mix of permitted uses in the downtown;
Contribute to the diversification of eating
establishments in the downtown;
Not result in an over concentration of restaurants in the immediate vicinity.
Restaurant Definition
Definition: Maintain existing “restaurant” definition:“…establishments whose primary business is the sale of food and beverages to customers for their consumption
within the restaurant or restaurant patio area…"
Traditional restaurants
Cafes
Ice-cream shops, delis, and bakeries with on-site seating.
