Zoning Text Amendment –CUP
As recommended by the Planning Commission:
•List “restaurant” as a conditionally permitted
use in the C-3 Zoning District , requiring a
Conditional Use Permit.
•Exempt restaurants locating within a tenant
space currently occupied by a non-conforming
office or salon, or other restaurant.
Zoning Text Amendment -Findings
•Foster a balance of day and evening activity in
the downtown;
•Maintain a balanced mix of permitted uses in
the downtown;
•Contribute to the diversification of eating
establishments in the downtown;
•Not result in an over concentration of
restaurants in the immediate vicinity.
Zoning Text Amendment -Other
•Incorporate Alcohol Beverage Policy by reference.
•Clarify that restaurants with existing CUP’s are
“conforming” and unaffected by the ordinance.
•Clarify drive-through/in restaurants are prohibited.
•Establish that motor-vehicle sales (within a
enclosed building) is a conditionally permitted use.

restaurants and motor vehicle sale
establishments (within an enclosed building)as
conditionally permitted uses subject to
approval of a Conditional Use Permit and
specifically prohibiting drive-through and drive-
in restaurants within the C-3 (Central Business
District)Zoning District.
