Square-Footage for Restaurants •Prohibit New Restaurants (Moratorium) •Require a CUP for conversion to Restaurant Use •Modify DT Alcohol Policy to address Over- Concentration •Eliminate Parking Exception •Reinstate Parking in-Lieu Fee Zoning Text Amendment –CUP As recommended by the Planning Commission: •List “restaurant” as a conditionally permitted use in the C-3 Zoning District , requiring a Conditional Use Permit. •Exempt restaurants locating within a tenant space currently occupied by a non-conforming office or salon, or other restaurant. Zoning Text Amendment -Findings •Foster a balance of day and evening activity in the downtown; •Maintain a balanced mix of permitted uses in the downtown; •Contribute to the diversification of eating establishments in the downtown; •Not result in an over concentration of restaurants in the immediate vicinity. Zoning Text Amendment -Other •Incorporate Alcohol Beverage Policy by reference. •Clarify that restaurants with existing CUP’s are “conforming” and unaffected by the ordinance. •Clarify drive-through/in restaurants are prohibited. •Establish that motor-vehicle sales (within a enclosed building) is a conditionally permitted use.
