The Planning Commission meeting of August 25, 1998, was called to order at 7:30 p.m., in the
Council Chambers, 70 North First Street, Campbell, California by Chairman Lowe, and the
following proceedings were had, to wit:

APPROVAL OF MINUTES
Motion: On motion of Commissioner Gibbons, seconded by Commissioner
Kearns, the Planning Commission minutes of June 23, 1998, were
approved. (4-0-3; Commissioners Jones, Francois and Meyer-
Kennedy abstained.)
Motion:
On motion of Commissioner Meyer-Kennedy, seconded by
Commissioner Gibbons, the Planning Commission minutes of July 14,
1998, were approved. (4-0-3; Commissioners Lowe, Francois and
Kearns abstained.)

Motion:
On motion of Commissioner Meyer-Kennedy, seconded by
Commissioner Kearns, the Planning Commission minutes of July 28,
1998, were approved. (4-0-3; Commissioners Jones, Gibbons and
Linstrom abstained.)
COMMUNICATIONS.

AGENDA MODIFICATIONS OR POSTPONEMENTS
There were no agenda modifications or postponements.

PUBLIC HEARING
Chairman Lowe read Agenda Item No. 1 into the record.

Mac Martin, P.
Public Hearing to consider the application of Ms. Patricia
Karen Mac Martin for approval of a Reinstatement (R 98-03) to
a previously-approved Conditional Use Permit (UP 97-08) to
allow a large family day care facility (6-12) children on
property located at 570 Corliss Way in an R-l-6 (Single
Family Residential) Zoning. This project is Categorically
Exempt. Planning Commission decision final, unless appealed
in writing to the City Clerk within 10 days.
Ms. Sharon Fierro, Senior Planner, presented the staffreport as follows:
· Applicant is seeking approval of a Reinstatement of a Use Permit allowing a large family day
care facility, with up to 12 children, at a single family residence located at 570 Corliss Way.
· On August 26, 1997, the Use Permit was approved by the Commission.
· At that hearing, concerns were raised regarding the impacts of additional traffic in the
neighborhood.
· This evening, the applicant has provided seven letters from parents which verify that the
applicant is providing transportation to the site through the use of a mini-van for 9 of the 12
children as well as for the employee.
· This use meets all criteria.
· There have been no complaints to the Police or City Engineer as a result of this use in the last
year with the exception of one general traffic complaint that Police was unable to substantiate
and which was not in relation to the child care facility.
· The original approval was for one year.
· Staff is recommending approval of an unrestricted Use Permit, relying on the provisions
available within the Municipal Code to handle any potential problems in the future and
preventing additional costs to the applicant caused by the need to renew more often.
· SARC did not review this project as there are no site or design changes.

Chairman Lowe sought assurances that the residents within 300 feet had been notified of this
hearing.
Ms. Sharon Fierro replied that the notification had been sent and no response or comment
resulted.
Chairman Lowe opened the Public Heating for Agenda Item No. 1.
Ms. Patricia Karen Mac Martin, Applicant:
· Advised that the day care formerly located directly behind hers has relocated.
· Informed the Commission that she has purchased a mini-van that is being used to transport 9
of 12 children as well as her assistant.
Commissioner Gibbons expressed her appreciation for all of Ms. Mac Martin's efforts in
handling the concerns of her neighbors.
Chairman Lowe closed the Public Hearing for Agenda Item No. 1.
Motion:
Upon motion of Commissioner Meyer-Kennedy, seconded by Commissioner
Francois, the Planning Commission adopted Resolution No. 3173 approving
a Reinstatement (R 98-03) to a previously-approved Conditional Use Permit
(UP 97-08) to allow a large family day care facility (6-12) children on
property located at 570 Corliss Way, by the following roll call vote:
AYES: Francois, Gibbons, Jones, Kearns, Lindstrom, Lowe, Meyer-
Kennedy
