APN: 279-53-009 82 Cannery Circle, Campbell, CA 95008 RELEASE OF AFFORDABILITY RESTRICTIONS AND OPTION PURCHASE THIS RELEASE OF AFFORDIBILITY RESTRICTIONS AND OPTION TO PURCHASE (the "Release") is executed as of November �, 2022 (the "Effective Date") by the City of Campbell, a municipal corporation (the "City). 1. Property. The City, through that certain Affordability Restriction and Option to Purchase (the Resale & Restriction Agreement") by and between Stephen V. Newlin and Suzette Mendonca and the City, dated June 1, 2004 and recorded June 18, 2004, as Instrument No. 17853323, in the official records of the County of Santa Clara, State of California, inserted certain restrictive covenants in regard to the use and sale of that real property located in the City of Campbell, County of Santa Clara commonly referred to as 82 Cannery Circle, Campbell, CA 95008, and more particularly described in Exhibit A attached hereto and incorporated herein by this reference (the "Property"). 2. Release. The City, by this Release, hereby withdraws, rescinds, and declares of no further force and effect each and all of those restrictive covenants or promises of Stephen V. Newlin and Suzette Mendonca, to the City, as set out in the Affordability Restriction and Option to Purchase recorded in the official records of the County of Santa Clara.
