WORKS NOTICE INVITING BIDS FOR CONSTRUCTION
Of JOHN D. MORGAN (JDM) PARK IMPROVEMENT
(BUDD) PROJECT NO. iB-PP
1. Date and Place of Opening Bids. Notice is hereby
given that seated bids will be received at the Office of
the City Clerk of the City of Campbell (City or Owner),
7o N. First Street, Campbell. CA 95008.1423 until 3:00
PM, November 4, 2020, for the foregoing project. The
bids so submitted will be pubticlyopened and read
aloud at that time. (BIDS RECEIVED AFTER THE DATE
AND TIME STATED ABOVE WILL BE REJECTED AS
NONRESPONSIVE. IT IS HIGHLY RECOMMENDED
THATALL BIDS BE HAND DELIVERED).
2. Location of Work. The work that is to be performed
at Jahn D. Morgan Park (Budd Avenue side) within the
City of Campbell.
3. Description of Work. The work to be performed, in
genera(, consists of furnishing all labor, tools.
equipment. transportation, and materials required to
complete the PROJECT NO. 18-PP:JOHN D. MORGAN
(JDM) PARK IMPROVEMENT (BUDD). The Project No,
18- PP: John D. Morgan (JDM) Park Improvement
(Budd) scope of work generally includes, but is not
limited to the following: surveying and construction
staking, clear, grub and demolition of existing
hardscape paving, fencing, play equipment, site
furnishings and softscape. Contractor to complete:
earthwork, material export, grading, site drainage,
playground area, paving, sidewalk, fencing, signage,
walls, site furnishings, play equipment, irrigation and

5. Bid Security. Each bid shalt be accompanied by one
of the following forms of bidder's security: cash,
certified or cashiers check drawn upon a responsible
bank, or Bid Bond executed by an admitted surety
insurer, made payable to the City of Campbell. The
bidder's security shalt be in an amount equal to at
least ten percent (logo) of the total bid price and shall
be conditioned to be forfeited to the City of Campbell
in the event that the bidder, if their bid is accepted,
does not execute the Contract for this project and
provide the required bonds (including, but not limited
to, payment and performance bonds), certificates of
insurance, and endorsements within eight (8)
working days of the mailing to the bidder of the
Notice of Award. A bid will not be considered unless
one of the approved forms of bidder's security is
enclosed with it.
6. Award of Contract. All terms and condition,
contained in the contract documents shall become a
Part of the Contract for this project. The Contractor
agrees to honor the submitted Bid Proposal for a
period of at least 90-catendar days after the opening
of the Bid Proposal. It is anticipated that the Contract
for this project will be awarded to the lowest
responsible responsive bidder in December 2020. A
bid may be rejected if the City determines that arty of
the bid item prices are materially unbalanced to the
potential detriment of the City. To the fullest extent
permitted by law, the City reserves and maintains the
rightto reject any and all bids and to waive any bid
informality or irregularity at its discretion.
7. Prevailing Rate of Wage. The work contemplated by
the contract documents is a public work subject to
prevailing wages under California Labor Code Section
1770 et. seq. Pursuant to Section 1773 of the Labor
Code, the general prevailing wage rates in the county,
or counties, in which the work is to be done have been
determined by the Director of the California
Department of Industrial Relations. In accordance
with Sections 1770 through 1780 inclusive of the
California Labor Code, the City has obtained from the
Department of Industrial Relations the general
Prevailing rates of wages in the locality in which the
work is to be performed. The Contractor to whom the
Contract forthii project is awarded and any
subcontractors must pay not less than the specified
prevailing rates of wages to all workers employed in
the execution of the Contract. Pursuant to Section
'773.2 of the Labor Code, general prevailing wage
rates included in the Bid Proposal and Contract for
the project shall be posted by the Contractor at a
prominent place at the site of the work. Copies of the
prevailing rates of wages for this project are found in
Appendix G of the Project Specifications,
8. Substitution of Securities. Pursuant to Section
22300 of the California Public Contract Code, the
Contractor may substitute certain securities for
moneys withheld by the City to ensure performance
underthe Contract, or, in the alternative, may request
the City to make payment of retentions earned
directly 10an escrow agent at Contractor's expense.
9. Licenses. All bidders, contractors and
subcontractors shaft be licensed in accordance .Kith
the laws of the State of California. All contractors and
subcontractors shall have and maintain a current and
valid contractor license of the required classification
from the Stale of California throughout the course of
this project. In addition, the bidder/contractor shall
Possess a valid Class "A" General Engineering
Contractor License at the time of bid, except that on a
joint venture bid a joint venture license may be
obtained by a combination of licenses after bid
opening but before award in accordance with
California Business and Professions Code Section
7029.1. For a federal -aid contract, the bidder must be
Property licensed as a contractorfrom Contract award
through Contract acceptance (Cal. Pub. Cont. Code
420103,5)• Bidder/contractor shall maintain said
license throughout the entire project until Notice of
Final Acceptance has been issued. Failure to possess
'he specified license at the time the bid is submitted
shall renderthe bid non -responsive and shall act as a
bar to award of the Contract to any bidder not
possessing said license at bid submission and result
in a forfeiture of the bid security. Bidderlcontraetor is
required to provide with its bid satisfactory proof of
licensure to the City.
W. Business License. All contractors and
subcontractors working in the City of Campbell most
have a valid City of Campbell Business License at the
time the Contract is awarded. Business Licenses may
be purchased at the Finance Department at 70 N. First
Street, Campbell. California.
11, Mandatory Pre -Bid Meeting. Prospective bidders
are required to attend a mandatory pre- bid meeting
which will be conducted via Zoom at 1130 PM on

will not he accepted from bidders/contractors that did
not attend the Mandatory Pre -Bid Meeting. it is
highly advisable for prospective bidders to conduct a
Pre -Bid Site Review prior to attending the meeting.
12. Pre -Bid Site Review. Prospective bidders are
required to conduct a review of the project site prior
to bid -The purpose of the site visit is to acquaint the
bidders with the site conditions and other local
conditions that may affect the performance and costs
of the work prior to submitting a bid proposal_ The
submission of a bid shalt be conclusive evidence that
the bidder has investigated and is satisfied as to the
conditions to be encountered, as to the character,
quality, and scope of work to be performed and the
quantities of materials to be furnished, and as to the
requirements of these Notice Inviting Bids,
instructions to bidders, plans and specifications,
drawings, special provisions, and the Contract.
13, Apprentices. Attention is directed to Sections
1777.5.1777.6 and 1777.7 of the California Labor Code
and Title 8, California Administrative Code, Section
200 et seq. to ensure compliance and complete
understanding of the law regarding apprentices.
Contractors and subcontractors shall comply with all
such requirements concerning the employment and
wages of apprentices. Bidder/contractor is
responsible for the compliance of its subcontractors
will, California Labor Code Sections 1777.5,1777.6 and
1777.7.
14. State of California Department of industrial
Relations (DIR) Registration. This project is subject to
compliance monitoring and enforcement bythe DIR
pursuant to the California Labor Code Section 1771.4,
No contractor or subcontractor may be listed on a bid
proposal fora public works project (submitted on or
after March 1, 2015) unless registered with the DIR
Pursuant to Labor Code section 1725.5 [with limited
exceptions from this requirement for bid purposes
only under Labor Code section 1771.1(a)). The
Contractorand subcontractors (as listed on the
Statement of Subcontractors Form) shall provide
proof of DIR registration at the time of Bid. No
contractor or subcontractor may be awarded a
contract for public work on a public works project
(awarded on or after April 1, 2015) unless registered
with the DIR pursuant to Labor Code section 1725.5,
15• Resolution of Construction Claims. Each bidder is
hereby notified of California Public Contract Code
Section 9204 (a copy of which is included as Appendix
H in the Project Specifications) as such section relates
t0 resolution of construction claims. All provisions of
Public Contract Code Section 9204 are incorporated
into and form an integra(part of the contract
documents for this project. Failure of a public entity
to respond to claim within the time periods
described in Public Contract Code Section 9204 shalt
result in the claim being deemed rejected in its
entirety.
