CC Resolution 13193 - Vacating Portion of Peggy Avenue (1361 Peggy Avenue) RESOLUTION NO. 13193 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL VACATING A PORTION OF PEGGY AVENUE, AND DIRECTING THE CITY CLERK TO RECORD THE RESOLUTION (1361 PEGGY AVENUE) WHEREAS, on May 16, 1949, the Board of Supervisors of the County of Santa Clara accepted, the street easement dedication of Peggy Avenue as a 50-foot right-of-way width (25-foot half- street), which included the frontage of 1361 Peggy Avenue as part of the larger dedication; and WHEREAS, the San Tomas Area Neighborhood Plan identifies this segment of Peggy Avenue as only requiring a 40-foot right-of-way width (20-foot half-street), thereby eliminating the need for the additional five (5) feet of right-of-way along the frontage of 1361 Peggy Avenue; and WHEREAS, the San Tomas Area Neighborhood Plan includes Transportation Policy B.5 — Return of Excess Right-of-Way, that allows for property owners to request the return of excess right-of-way; and WHEREAS, the portion of Peggy Avenue to be vacated is considered to be excess right-of-way; and WHEREAS, on July 23, 2024 the City of Campbell approved the construction of a new home on the property at 1361 Peggy Avenue (PLN-2023-89), including the vacation of a portion of Peggy Avenue considered to be excess right-of-way; and WHEREAS, all public utility companies have been contacted and have indicated no objection to said vacation; and WHEREAS, the City Council of the City of Campbell adopts the finding that pursuant to Section 892 of the Streets and Highways Code of the State of California, the portion of Peggy Avenue proposed for abandonment is not useful as a non-motorized transportation facility; and WHEREAS, the vacation is to be made pursuant to Chapter 4, Summary Vacation, of Part 3 of Division 9 of the California Street and Highway Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby vacate this excess right-of-way, and directs the City Clerk to record this Resolution for the property at 1361 Peggy Avenue as shown on Exhibits A and B.
