PC Res 4717RESOLUTION NO. 4717 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT MODIFICATION TO FORMALIZE OUTDOOR SEATING WITHIN A REAR PATIO OF AN EXISTING QUICK SERVICE RESTAURANT WITH A FULL-SERVICE BAR, AND LATE-NIGHT HOURS (EL GUAPO'S), ON PROPERTY LOCATED AT 266 E. CAMPBELL AVENUE. THE APPLICATION(S) UNDER CONSIDERATION INCLUDES A CONDITIONAL USE PERMIT. FILE NO.: PLN-2023-129. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The Planning Commission finds as follows with regard to the approval of a Site and Architectural Review Permit: 1. The Project Site is zoned CB-MU (Central Business Mixed-Use) on the City of Campbell Zoning Map. 2. The Project Site is designated Central Business Mixed-Use on the City of Campbell General Plan Land Use diagram. 3. The project site is composed of two parcels (APNs: 412-06-033 and 412-06- 035), located on the south side of E. Campbell Avenue between First Street and S. Second Street in Downtown Campbell, within the CB-MU (Central Business Mixed-Use) Zoning District. 4. The parcels are under the same ownership and separated by a 15-foot wide alleyway that runs parallel to E. Campbell Avenue often referred to on maps as Pine Avenue. The alleyway serves adjacent parking areas and provides garbage pickup access for multiple commercial properties fronting primarily East Campbell Avenue, including the project site. 5. The front parcel is approximately 6,720 square-feet, developed with a 3,941 square-foot single-story building divided into two tenant spaces. In addition to the subject business, El Guapo’s Tacos (“El Guapo’s”), the building also accommodates the Cardiff Lounge, a stand-alone bar. 6. El Guapo's (formerly Chacho's) was established in 2009 and operated under a 2004 Conditional Use Permit allowing late-night hours and beer and wine sales until 2 AM. On April 12, 2011, the Planning Commission approved a new permit for general alcohol sales and an expansion into an adjacent space, increasing the restaurant capacity to 40 seats (30 dining, 10 bar). In 2012, the Commission modified the permit to extend closing time to 1:30 AM and increase capacity to 64 seats (48 dining, 19 bar). The tenant also has an Outdoor Seating Permit for the front sidewalk area. 7. In response to the COVID-19 pandemic and state of emergency declared by California Governor Newsom, the City of Campbell implemented "Flexible Planning Commission Resolution No. 4717 Page 2 of 4 Approving a Conditional Use Permit 266 E. Campbell Avenue ~ Project File No.: PLN-2023-129 Business Operation Guidelines" in September 2021 to support economic recovery by allowing modifications like outdoor seating. Under these guidelines, the subject restaurant established a compliant rear patio to expand its operations outdoors. 8. In 2023, following the lifting of County Public Health Officer Orders and the rescinding of the City's COVID-19 Pandemic Guidelines, the City notified the subject tenant on February 27 and March 20 that their use of private outdoor space for dining must end by March 27, unless city approvals were obtained. The tenant then entered a compliance agreement with the City to retain the patio while seeking a Conditional Use Modification Permit to legalize the outdoor seating and patio. 9. The application for a Conditional Use Modification Permit seeks to formalize outdoor seating in the rear patio of El Guapo's, an existing quick-service restaurant with a full-service bar and late-night hours. The patio will feature 19 seats, equating to 30% of the current indoor capacity, with business hours from 8:00 AM to 11:00 PM daily. 10. The proposed restaurant with a standalone bar and outdoor seating is allowed in the CB-MU Zoning District, meeting the definition of a “pedestrian-oriented activity” per CMC Sec. 21.10.060.B. It complies with all provisions, including outdoor seating requirements. 11. The proposed use aligns with the Central Business Mixed Use land use designation, promoting an active, pedestrian-oriented environment. It supports policies for maintaining a distinctive downtown, encouraging outdoor dining, and ensuring pedestrian-oriented design features. Policy LU-2.1: Ground Level Commercial: Develop and maintain the ground floor space along East Campbell Avenue between Third Street and the light rail tracks as a distinctive retail, restaurant, and pedestrian oriented experience with ground floor uses that are diverse and interesting and contribute strongly to a distinctive and unique downtown environment. Policy D-2.1: Ground-Level Design Features: The Ground-Level in the Downtown shall include design features, such as consistent streetscape patterns, outdoor areas, display windows, and building articulation, which is attractive and pedestrian oriented. Strategy D-2.1a: Buildings facing East Campbell Avenue shall be designed to maintain a consistent development pattern that promotes retail activity and an active pedestrian-oriented environment. Recessed buildings, particularly on corner lots, may be allowed to provide for outdoor dining, public areas or design excellence determined to contribute to the overall benefit of the Downtown. Policy LU-4.4 Establish inviting and attractive commercial centers that are exceptionally well designed. Policy LU-5.2 Maintain East Campbell Avenue as a pedestrian-oriented street. Policy LU-5.4 Encourage restaurant and specialty retail uses in the Downtown commercial area that will foster a balance of day and evening activity. Campbell Avenue ~ Project File No.: PLN-2023-129 Policy CD-2.10 Promote crime prevention through site and building designs that facilitate surveillance of communities by putting “eyes on the street.” Design sites and buildings to promote visual and physical access to parks and open space areas. Support safe, accessible, and well- used public open spaces by orienting active use areas and building facades towards them. 12. The site provides sufficient parking, leveraging nearby public facilities and its proximity to the Downtown Light Rail station under SB 2097. The existing trash enclosure, although not fully compliant with current standards, will be managed through a stormwater management plan approved by the City's Environmental Programs Specialist. 13. The proposed use will not significantly impact traffic, as it does not exceed the thresholds for a traffic study or a Vehicles-Miles-Traveled (VMT) analysis. The anticipated daily vehicle trips are within the acceptable limits defined for a "small project." 14. The restaurant’s design and operation, including outdoor seating with restricted hours, will not create a nuisance or disturb nearby residential areas. Standard conditions of approval will ensure compliance with the Downtown Alcohol Beverage Policy, maintaining alcohol service as ancillary to food service and addressing potential noise complaints. The establishment is consistent with the Policy’s operational standards, including restrictions on bar area size and operational hours. 15. No substantial evidence has been presented which shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. Based upon the foregoing findings of fact and pursuant to CMC Section 21.42.020 the Planning Commission further finds and concludes that: Site and Architectural Review Permit Findings (CMC Sec. 21.42.060.B): 1. The project will be consistent with the General Plan; 2. The project conforms with the Zoning Code; 3. The project will aid in the harmonious development of the immediate area; 4. The project is consistent with applicable adopted design guidelines, development agreement, overlay district, area plan, neighborhood plan, and specific plan(s); and Environmental Findings (CMC Sec. 21.38.050): 5. This project is Categorically Exempt under Section 15301 of the California Environmental Quality Act (CEQA) pertaining to existing facilities and Class 1 consisting of the minor alteration of an existing private structure; 6. There are no unusual circumstances that would prevent the project from qualifying as Categorically Exempt per Section 15300.2c of the CEQA Guidelines. Campbell Avenue, subject to the attached Conditions of Approval (attached Exhibit A). Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT PLANNING DIVISION 1. Approved Project: Approval is granted for a Modification (PLN-2023-129) to a previously approved Conditional Use Permit formalize outdoor seating within a rear patio of an existing quick service restaurant with a full-service bar, and late-night hours (El Guapo's),on property located at 266 E. Campbell Avenue. The project shall substantially conform to the Project Plans included as Attachment B in the July 23, 2024, Planning Commission Staff Report, except as may be modified by the Conditions of Approval contained herein. 2. Approval Expiration: The approval is valid in perpetuity with continued operation of the use. Abandonment, discontinuation, or ceasing of operations for a continuous period of twelve months shall void the Conditional Use Permit approved herein. 3. Plan Revisions: Within 60 days of approval, the applicant will submit an updated patio plan that contains the following revisions, as in the redlined plans included as an attachment to the July 23 planning commission staff report: a. Remove truncated domes b. Install a new 36-inch wide gate with a locking mechanism that allows egress but prevents ingress. Ensure the gate complies with all relevant building codes and safety standards, providing a secure one-way exit for individuals while restricting unauthorized entry. c. Bicycle Racks: Bicycle racks shall be permanently installed and secured in-place. 5. Minor Revisions: Architectural refinements and other minor revisions to the Approved Project Plans may be administratively reviewed and approved by the Community Development Director pursuant to CMC Sec. 21.56.060. 6. Planning Inspection Required: An inspection with the Planning Division is required within 60 days of approval. Operations not in substantial compliance with the approved project plans shall not be referred to the Code Enforcement Division. 7. Operational Standards: Consistent with the Downtown Alcohol Beverage Policy and other City standards, any restaurant operating pursuant to the Conditional Use Permit approved herein shall conform to the following operational standards. a. Approved Use: The approved use is a "pedestrian-oriented activity" operating as a "bona fide public eating place" as defined by Section 23038 of the California Business and Professions Code (i.e., restaurant), with "late-night activities" as defined by the Campbell Municipal Code and limited by the operational standards listed herein. At no time shall the restaurant be operated as a stand-alone bar/tavern. b. Restaurant Seating/Patron Occupancy (Indoor): Total indoor patron occupancy shall be limited to 64 seated persons, consistent with the 48 dining area seats and 16 bar area seats, subject to the maximum occupancy capacities of certain rooms as determined by the California Building Code (CBC). At no time shall there be more than 64 patrons within the establishment. It is the responsibility of the business owner to provide adequate entrance controls to ensure that patron occupancy is not exceeded. Maximum Occupancy signs shall be posted conspicuously within the premises. Future Conditions of Approval Page 3 of 8 Conditional Use Permit 266 E. Campbell Ave ~ Project File No.: PLN-2023-129 changes to the bar area configuration shall not increase the bar seating to more than 25% of the restaurant's total seating (dining and bar areas combined). c. Restaurant Seating/Patron Occupancy (Outdoor): Total outdoor patron occupancy shall be limited to 19 seated persons within the rear outdoor patio. At no time shall there be more than 19 patrons within the rear outdoor patio. It is the responsibility of the business owner to provide adequate entrance controls to ensure that patron occupancy is not exceeded. Maximum Occupancy signs shall be posted conspicuously within the premises. Any future modifications to the indoor seating configuration must ensure that the outdoor seating does not exceed 30% of the restaurant's total seating capacity (including both dining and bar areas). This limit excludes any outdoor seating located within the public right of way. d. Maximum Occupancy Sign: The business owner shall install a maximum occupancy sign of a size to be determined by the Community Development Director, conspicuously posted within the premises, which shall include the maximum seated occupancy and include a visual depiction of the floor plan included in the approved construction drawings submitted for a Building Permit. It is the responsibility of the business owner to provide adequate entrance controls to ensure that patron occupancy is not exceeded. e. Floor Plan Layout: All chairs and tables within the dining area shall consists of standard-height furniture. All tables and chairs shall be placed in such a manner to allow sufficient area for dining and shall not be stacked or removed from the dining area or placed outside. At no time shall the seating be reconfigured to created large open spaces for patrons to congregate, or dance. f. Hours of Operation: Hours of operation shall be as follows. By the end of Business Hours all patrons shall have exited the restaurant. By the end of the Operational Hours all employees shall be off the premises (except for emergencies). • Business Hours (indoor): 8:00 AM – 1:00 AM, Sunday - Wednesday 8:00 AM – 1:30 AM, Thursday - Saturday, and special occasions that may fall on other days (e.g., holidays, downtown festivals, etc.). Special occasion dates shall not exceed ten (10) in any calendar year, subject to condition of approval 7g. • Business Hours (outdoor): 8:00 AM – 11:00 PM, daily. • Operational Hours: 7:00 AM to 2:00 AM, Sunday - Wednesday 7:00 AM to 2:30 AM, Thursday - Saturday, and special occasions g. Special Occasions: By the second week of January each year, the business owner shall submit a list of the ten special occasion dates for that calendar year, for review and approval by the Community Development Director. The Community Development Director may impose reasonable restrictions for particular special occasion dates. Conditions of Approval Page 4 of 8 Conditional Use Permit 266 E. Campbell Ave ~ Project File No.: PLN-2023-129 Allowance for extended business hours on special occasion dates applies only to food service and does not allow for the service or consumption of alcohol after 12 AM. h. Alcohol Beverage Consumption: Alcohol beverage consumption shall be limited to 8:00 AM to 12:00 AM, Sunday through Saturday. Alcohol shall not be sold after 12:00 AM and it is the responsibility of the business owner to ensure that no patrons consume alcohol after 12:00 AM. Further, within the dining area, alcohol beverage consumption shall only be allowed in conjunction with food service. The dining area shall not be converted to a bar area. i. Liquor License: The applicant shall obtain and maintain in good standing a license from the State Department of Alcoholic Beverage Control for the sale of alcoholic beverages for on-site consumption in association with a bona fide public eating place (limited to a Type 41 or Type 47 license). The sale of alcoholic beverages for off-site consumption is prohibited. j. Food Service: Full menu meal service shall be provided at all times during the Business Hours in the dining, outdoor seating, and bar areas (i.e., the kitchen shall not be closed). k. Alcohol Beverage Service: Alcohol beverage service in the dining area shall only be allowed in conjunction with food service. l. Live Entertainment: No live entertainment is permitted as part of the Conditional Use Permit approval, including live music, disc jockey, karaoke, and dancing. Future requests for live entertainment shall be through approval of a Modification to the Conditional Use Permit and shall be limited to live musicians complimentary to the primary purpose of proving meal service. m. Alcohol Sales: The monthly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period, consistent with ABC licensing regulations. The business owner shall provide sales records on demand to the City to verify compliance with this standard. n. Loud Speakers: Exterior loud speakers, exterior audio sound systems, and/or public address systems are prohibited within the rear patio. o. Outdoor Seating: Outdoor eating shall be limited to private property, except as subject to an outdoor dining permit, and be considered part of the dining area subject to all restrictions herein. In addition, the following requirements apply: i. All outdoor patio furniture (including tables, chairs, umbrellas, and heaters) shall be in substantial conformance with the details and specifications provided in the Approved Project Plans. ii. Total patron occupancy in the rear patio outdoor seating area shall be limited to 19 seated patrons. Conditions of Approval Page 5 of 8 Conditional Use Permit 266 E. Campbell Ave ~ Project File No.: PLN-2023-129 iii. Use of the rear patio outdoor seating area shall cease by the end of the approved "Business Hours (outdoor)". At such time, all chairs shall be stacked, stored, or otherwise secured to prevent unauthorized use. iv. All outdoor furniture shall be kept clean and in good repair and replaced and/or fixed as necessary. v. Exterior heaters shall be electric or natural gas. Propane heaters are prohibited unless the Santa Clara County Fire District approves a canister enclosure. vi. All areas where alcoholic beverages are served outside must comply with the demarcation standards established by the State Department of Alcoholic Beverage Control. Any perimeter fence and/or landscaped planter shall be designed to clearly suggest that alcohol is not allowed outside the seating area. vii. The rear patio outdoor seating area shall be surrounded by a fence, landscape planters, or similar appropriate barrier as necessary to buffer the seating area from the adjoining outdoor uses. The fence, landscape planters, or other approved barrier shall be maintained in good appearance, function and vitality. viii. Tables, chairs, and associated umbrellas shall be secured so as not to be moved by the wind. However, they may not be bolted into the ground or secured to outdoor lights, trees, a building, or other furniture or objects. ix. Umbrella canopies. The canopies of umbrellas associated with outdoor tables shall provide a minimum vertical clearance of seven feet, unless the umbrella does not extend beyond the outside edge of the table, and shall not extend into walkways. p. Smoking: "No Smoking" signs shall be posted on the premises in compliance with CMC Section 6.11.060. q. Taxicab Service: The establishment shall post in a conspicuous place the telephone numbers of local taxicab services. r. Loitering: There shall be no loitering allowed outside the business and within the outside dining area. The business owner is responsible for monitoring the premises to prevent loitering. s. Storefront Glazing: All storefront glazing shall remain unobscured, except for the 25% of window area permitted to be occupied with window signage. t. Noise: Any noises, sounds and/or voices, including but not limited to interior audio sound systems, generated by the establishment shall not be audible to a person of normal hearing capacity from any residential property. In the event of legitimate complaints as verified and documented by City staff are received regarding such noise, the Community Development Director may immediately modify the business hours/hours of operation, subject to the project being brought back to the Planning Commission for review, pursuant to Condition of Approval No.8. u. Lighting: On-site lighting shall be shielded away from adjacent properties and directed on-site. The final design and type of lighting fixtures and lighting intensity of any proposed exterior lighting for the project shall be reviewed and approved by the Conditions of Approval Page 6 of 8 Conditional Use Permit 266 E. Campbell Ave ~ Project File No.: PLN-2023-129 Community Development Director for compliance with the City of Campbell Lighting Design Standards (CMC Sec. 21.18.090). v. Trash Disposal and Clean-Up: Refuse and recycling receptacles shall be kept within the trash enclosure except during collection in compliance with CMC Chapter 6.04 (Garbage and Rubbish Disposal). Emptying of trash receptacles and placement of refuse and recyclable materials into the trash enclosure receptacles shall occur only during the approved "Operational Hours". w. Property Maintenance: All exterior areas of the business free from graffiti, trash, rubbish, posters and stickers placed on the property, in compliance with CMC Section 21.16.110 (Site Maintenance). x. Landscape Maintenance: All landscaping shall be maintained in compliance with Campbell Municipal Code Section 21.26.040 (Landscaping Maintenance Requirements) and Section 21.16.110.C.2 (Landscape Maintenance). Dead or unhealthy plants shall be replaced with healthy plants of the same or similar type. y. Employee Training: The establishment shall use an employee training manual that addresses alcoholic beverage service consistent with the standards of the California Restaurant Association and the Department of Alcoholic Beverage Control. z. Designated Driver Program: The establishment shall maintain and actively promote a designated driver program (e.g., complimentary non-alcoholic beverages for designated drivers). aa. Parking and Driveways: All parking and driveway areas shall be maintained in compliance with the standards provided in CMC Chapter 21.28 (Parking and Loading). All parking areas shall be regularly swept and cleaned to remove litter and debris from the parking areas and driveways. The business owner may designate non-accessible stalls as time limited "Take Out Parking Only". bb. Outdoor Activity/Storage: Other than outdoor seating, no outdoor activity (e.g., cooking) is permitted in association with the restaurant. Outdoor storage, including but not limited to, linens, kegs, cartons, is also prohibited. cc. City Meetings: At the discretion of the Police Chief, periodic meetings will be conducted with representatives from the Police Department and Department of Alcohol Beverage Control for on-going employee training on alcoholic beverage service to the general public. 8. Revocation of Permit: Operation of the restaurant with alcohol service pursuant to this Approval is subject to Sections 21.68.020, 21.68.030 and 21.68.040 of the Campbell Municipal Code authorizing the appropriate decision making body to modify or revoke a Conditional Use Permit if it is determined that the sale of alcohol has become a nuisance to the City’s public health, safety or welfare or for violation of this Approval or any standards, codes, or ordinances of the City of Campbell. Conditions of Approval Page 7 of 8 Conditional Use Permit 266 E. Campbell Ave ~ Project File No.: PLN-2023-129 At the discretion of the Community Development Director, if the establishment generates three (3) legitimate complaints as verified and documented by City staff related to violations of conditions of approval (e.g., noise, etc.) and/or related to the service of alcohol within a twelve (12) month period, a public hearing before the Planning Commission may be scheduled to consider modifying conditions of approval or revoking of the Approval. The Community Development Director may commence proceedings for the revocation or modification of the Approval upon the occurrence of less than three (3) complaints if the Community Development Director determines that the alleged violation warrants such an action. The Director may also at such time immediately restrict the establishment's Hours of Operation to address complaints in a timely manner. In exercising this authority, the decision making body may consider the following factors, among others: a. The number and types of Police Department calls for service at or near the establishment that are reasonably determined to be a direct result of patrons actions; b. The number of complaints received from residents, business owners and other citizens concerning the operation of an establishment, c. The number of arrests for alcohol, drug, disturbing the peace, fighting and public nuisance violations directly associated with an establishment; d. The number and kinds of complaints received from the State Alcoholic Beverage Control office and the County Health Department; and e. Violation of conditions of approval. PUBLIC WORKS DEPARTMENT Engineering Division 9. Trash Enclosure Requirements: The following are standard trash enclosure requirements pursuant to NPDES Permit No. CAS612008 (CRWQCB), C.3.a.i. (7). For all new development and redevelopment projects that are subject to the Permittee’s planning, building, development, or other comparable review, but not regulated by Provision C.3, encourage the inclusion of adequate source control measures to limit pollutant generation, discharge, and runoff. These source control measures should include: a. Campbell Municipal Code 14.02.030 "Stormwater Pollution Control / Requirements". The code states that no pollutants or water containing pollutants can be discharged into the City's storm drain system. Trash enclosures contain pollutants. During a rain event (or during general cleaning) water washes over and into roofless enclosures, collecting pollutants and discharging to the City's storm drain system. Applicants are required to show how new trash enclosures will not discharge pollutants into the storm drain system. Note: The tallow bin must be removed from the existing enclosure and placed within the storage area as identified on the Project Plans. The tallow bin must be equipped with a metal pan secondary containment bin to prevent leakage of grease Conditions of Approval Page 8 of 8 Conditional Use Permit 266 E. Campbell Ave ~ Project File No.: PLN-2023-129 10. Stormwater Management Plan: Stormwater management strategies shall align with the stormwater management plan provided by the applicant, and included as attachment B in the July 23 Planning Commission Staff Report. 11. Implementation and Monitoring Costs: Prior to the Building Permit Final, the applicant must execute a stormwater maintenance agreement in accordance with the stormwater management plan submitted by the applicant and referenced in the Planning Commission staff report dated July 23. This initial review as well as any subsequent reviews or modifications to the stormwater management plan shall incur a Trash Enclosure Plan Check fee. This fee shall be billed at an hourly rate specified in the City’s fee schedule, with a maximum of 2 hours, and be paid within 60 days of approval. See included invoice. The stormwater maintenance agreement shall stipulate annual inspections and quarterly reporting. These services will be billed at the Environmental Program Specialist rate as specified on the City’s adopted Fee Schedule, not to exceed a maximum of 5 hours per instance. All fees associated with the stormwater maintenance agreement, including plan check, inspections, and reporting, shall be collected by the City’s Environmental Services Division, as administered by the Public Works Department. 12. FIRE DEPARTMENT 13. Gas Heater Storage: The maximum individual capacity of gas containers used in connection with portable outdoor gas-fired heating appliances shall not exceed 20 pounds (9 kg) in accordance with CFC 905.5.2.3.3.
