Central Ave. (74-10) MEMORANDUM CITY OF CAMPBELL To: Honorable City Council Date: December 21, 1977 From: Planning Commission Subject: PD 77-20 CENTRAL 93 ASSOCIATES ---------------------------------------------------------- RECOMMENDATION That the City Council adopt the attached ordinance, approving plans, elevations and development schedule for a parking structure and revised occupancy use as shown on plans marked "Exhibit A". DISCUSSION This item has been before the Planning Commission since November 15, 1977 where considerable discussion has been held wJth regard to existing use, and future use of the Factory in relation to the proposed parking structure. The Commission voted 6-0-1, recommending approval of the parking structure and revised ocçupancy use of the Factory. The conditions of approval include provisions to help insure adequate parking for the Factory in the event the parking structure is not built through the proposed parking district. BRP:sk RESOLUTION NO. 1657 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA Being a Resolution of the Planning Commission of the City of Campbell recommending approval of plans, elevations and development schedule to allow the construction of a parking structure and a revision to occupancy uses for the Factory located at 93 South Central Avenue in a P-D (Planned Development/Commercial) Zoning District (application of Mr. William H. MacLaughlin on behalf of the Factory, PD 77-20). After notification and public hearing as specified by law on said proposed amendments, as filed in the office of the Planning Department on October 25, 1977 and after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all the evidence presented, the Planning Commission did find as follows: 1. That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. 2. That t~e proposed development is consistent with the General Plan of the City of Campbell. Based on the above findings, the Planning Commission did recommend approval of the requested plans, elevations and development schedule as presented and further recommends that the City Council enact the Ordinance attached hereto as Exhibit "A" adopting said plans, elevations and develop- ment schedule for that portion of the above mentioned Planned Development Zone. The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended by adopting the attached "Exhibit A" entitled "Plans and Elevations," Exhibit "B" entitled "Development Schedule," Exhibit "C" entitled "Map of said property," and Exhibit "D" entitled "Conditions of Approval" as per application of Mr. William H. Maclaughlin on behalf of the Factory. SAID APPROVAL SUBJECT TO THE ATTACHED CONDITIONS ("EXHIBIT D"). These plans and specifications are presently being drawn now and we anticipate completion and submittal to your office no later than December 20. In turn we hope that your department will approve these plans no later than January 30 so we can be under construction with these parking lot improvements no later than March 1.1978. Assurnm1ng 120 days schedule, the entire work should be completed by July 1,1978. If you should need any clarification as to these dates or the nature of this construction., please advise. Site and Architectural approval for the proposed parking structure. (detai led plans) 2. Provide an agreement satisfactory to the City Attorney that in the event the proposed parking district for this area fails, the parking structure shall be constructed at the owner1s expense within one year of ordinance approval by the City Council. 3. No additional food and/or beverage establishments shall be permitted; however, existing food and/or beverage establishments may be replaced with like uses or with retail sales uses in the event of vacancies. 4. Relocate trash enclosure as approved by Fire Marshal. 5. Lower level of parking garage shall have an automatic fire extinguishing system. 6. Provide one street fire hydrant on the west side of South Central Avenue 70+ feet north of Orchard City Drive. 7. 8. Provide portable fire extinguishers for parking structure. Restriping of front parking area to be approved by Department of Public Works. ~~SOLUTION NO. 3711 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING A USE PERMIT FOR A PORTION OF THE INTERIM ZONE AS ESTABLISHED BY ORDINANCE NO. 916 ON THE 24TH DAY OF SEPTEMBER, 1973, AND AS EXTENDED BY ORDINANCE NO. 930 ADOPTED ON THE 14TH DAY OF JANUARY, 1974. (Application of Richard B. Millen on behalf of The Factory Management Corporation) The City Council of the City of Campbell does hereby ordain as follows: SECTION ONE: That a use permit is hereby approved on that portion of the Interim Zone as shown on Exhibit "A" attached hereto as per the application of Richard B. Millen, on behalf of The Factory Management Corporation. Said approval granted subject to the following conditions: 1. Landscape plan indicating type of plant material, location of hose bibs or sprinkler system and type of fencing to be submitted for approval of the Planning Director at time of application for building permit. Faithful performance bond in the amount of $1,000 to be posted to insure landscaping, fencing and striping of parking lot area within three (3) months of comple- tion of construction or applicant may file written agreement to complete landscaping, fencing and striping of parking area prior to final building department clearance. 2.
