Cristich Ln. (1961) r . . 1 RESOLUTION NO. BEING A RESOLUTION AUTHORIZING MAYOR TO EXECUTE AGREEMENT WITH ROBERT R. WALKER AND FRANCIS PARK. WHEREAS, there has been submitted to the City Council by Messrs. ROBERT R. WALKER éJ:\ d FRANCIS PARK an agreement in conformance with conditions of "s" zone approval heretofore granted them, and, WHEREAS, the said agreement is in all respects fair and equitable and in full compliance with conditions attached to said "S" approval, and the said agreement having been approved by the City Attorney, NOW, THEREFORE, BE IT RESOLVED by the City Council that the Mayor be and he is hereby authorized to execute the said agreement on behalf of the City of Campbell. BE IT FURTHER RESOLVED that the deed tendered to City of Campbell in connection with said agreement be and the same is hereby accepted. AGREEMENT ------.--,- THIS AGREEMENT, made and entered into this day of , 1961, by and between ROBERT R. WALKER and FRANCIS PARKS hereinafter referred to as "DEVELOPERS" and the CITY OF CAMPBELL, a municipal corporation of the State of California, hereinafter referred to as "CITY" WITNESSETH, WHEREAS, DEVELOPERS are secur ing "S II approval from Planning Commission of CITY in order to obtain a building permit from CITY to construct an office building on that certain parcel of land leased to Robert R. Walker and Francis Parks by James D. Griffiths and Virginia Griffiths by lease recorded September 14, 1960 in Book 4915 Official Records Page, 335, Santa Clara County Records; and WHEREAS DEVELOPERS will cause to have dedicated certain land as well as other conditions of Ordinance No. 260 as adopted at Planning Commission meeting on January 17, 1961; now therefore, IT IS HEREBY AGREED, by and between, the parties hereto as follows, to wit: (1) DEVELOPERS agree to cause to be conveyed to said CITY, for street purposes, a strip of land 5 feet wide throughout the frontage of 150.00 feet on Cristich Lane. This dedication to be performed when called for by the City Council. ,~ \.. .. .. 1 (2) It is further agreed that DEVELOPERS shall indemnify and save harmless the City of Campbell, the City Council and the City Engineer, and other officers and/or employees of City of Campbell from any suits, cla~s or damages to persons or property sustained or arising in the construction of the work due to any acts omissions or negligence of DEVELOPERS, their officers, agents, employees or contractors. (3 ) This Agreement shall bind the heirs, successors and assigns of the parties hereto. IN WITNESS WHEREOF, said CITY has caused its name to be hereunto affixed by its Mayor and City Clerk thereunto duly authorized by resolution of the City Council, and said DEVELOPERS have hereunto caused their names to be affixed the day and year first above written.
