2024.4.23 PC Min PLANNING COMMISSION REGULAR MEETING MINUTES Tuesday, April 23, 2024 I 7:30pm City Hall Council Chamber CALL TO ORDER The Regular Planning Commission meeting of April 23, 2024, was called to order at 7:30 pm by Chair Zisser, and the following proceedings were had to wit. ROLL CALL Staff Present: Rob Eastwood, Director Bill Seligmann, City Attorney Roger Storz, Senior Civil Engineer Daniel Fama, Senior Planner Larissa Lomen, Assistant Planner Ken Ramirez, Administrative Analyst APPROVAL OF MINUTES 1. Approval of Minutes of April 9, 2024 (Roll Call Vote) ➢ Meeting Minutes, 4/9/2024 (Regular Meeting) Meeting Minutes were approved, Commissioner Majewski abstained. COMMUNICATIONS Planning Commissioners Present: Alan Zisser, Chair Matt Kamkar, Vice Chair Adam Buchbinder Davis Fields Michael Krey Maggie Ostrowski Cori Majewski Planning Commissioners Absent: Campbell Planning Commission Meeting Minutes – April 23, 2024 Page 2 of 5 Director Eastwood informed the Planning Commission that a resolution to modify the start time of the Planning Commission Regular Meeting would be brought before the Planning Commission at the next meeting. AGENDA MODIFICATIONS OR POSTPONEMENTS ORAL COMMUNICATIONS This portion of the meeting is reserved for individuals wishing to address the Planning Commission on matters of community concern that are not listed on the agenda. In the interest of time, the Chair may limit speakers to five minutes. Please be aware that State law prohibits the Commission from acting on non-agendized items, however, the Chair may refer matters to staff for follow-up. PUBLIC HEARING Note: Members of the public may be allotted up to two (2) minutes to comment on any public hearing item. Applicants/Appellants and their representatives may be allotted up to a total of five (5) minutes for opening statements and up to a total of three (3) minutes maximum for closing statements. Items requested/recommended for continuance are subject to Planning Commission’s consent at the meeting. 2. 1192 Lenor Way – Site and Architectural Review Permit (Resolution/Roll Call Vote) Public Hearing to consider the request of Ramin Zohoor on behalf of Ken Mermoud to allow the construction of an approximately 258 square-foot first-story addition and a 270 square-foot second-story addition to an existing single-family residence, with a reduction to the 2nd-story side-yard setback from approximately 9 ½ feet to 6-feet, for property located at 1192 Lenor Way. The application(s) under consideration include a Site and Architectural Review Permit. File No.: PLN-2024-38. Staff is recommending that this item be deemed Categorically Exempt under CEQA. Planning Commission action is final unless appealed in writing to the City Clerk within 10 calendar days. Project Planner: Larissa Lomen, Assistant Planner. Recommended Action: That the Planning Commission adopt a resolution approving a Site and Architectural Review Permit Assistant Planner Larissa Lomen presented staff report to consider the request to allow the construction of an approximately 258 square-foot first-story addition and a 270 square-foot second-story addition to an existing single-family residence for property located at 1192 Lenor Way. Commissioners received clarification that other applications that similarly proposed a reduced in second-story, side yard setback had to follow a similar process in the past that required approval by the Planning Commission. The Community Development Director informed commissioners that the Department is looking to streamline the process through an administrative decision for future applicants. Campbell Planning Commission Meeting Minutes – April 23, 2024 Page 3 of 5 The applicant’s architect, Ramin Zoohoor, stated that it was their intent to follow all zoning regulations, while achieving the maximum floor area allowed, as desired by the Client. Commissioners were in support of the item and would like items like this be administrative in the future. Motion: Upon motion by Commissioner Buchbinder, seconded by Commissioner Krey, the Planning Commission motioned to grant approval of a Site and Architectural Review Permit to allow construction of an approximately 258 square-foot first- story addition and a 270 square-foot second-story addition to an existing two story, single-family residence, with a reduction to the second-story side-yard setback from approximately 9 feet to approximately 6-feet on property located at 1192 Lenor Way. PLN-2024-38, by the following roll call: AYES: Fields, Ostrowski, Krey, Buchbinder, Kamkar, Zisser, Majewski NOES: None ABSENT: None ABSTAIN: None 3. 68 Page Street – Variance and Site and Architectural Review Permit (Resolution/Roll Call Vote) Public Hearing to consider the request of SVEP Consultants LLC to allow construction of a 2-story approximately 1,471 square-foot single-family dwelling, with substandard street- side and interior-side setbacks and an increase to the allowable floor area ratio (FAR), including retention and alteration of an existing detached non-conforming garage, for property located at 68 Page Street. The application(s) under consideration include a Variance and Site and Architectural Review Permit. File No.: PLN-2024-3. Staff is recommending that this item be deemed Categorically Exempt under CEQA. Planning Commission action is final unless appealed in writing to the City Clerk within 10 calendar days. Project Planner: Daniel Fama, Senior Planner. Recommended Action: That the Planning Commission adopt a resolution approving a Variance and Site and Architectural Review Permit Senior Planner Daniel Fama presented start report to allow construction of a 2-story approximately 1,471 square-foot single-family dwelling for property located at 68 Page Street. Commissioners were informed by staff that the previous determination by City Council to deny the application was based on City Council’s decision that none of the findings for approving the variance could be determined. Campbell Planning Commission Meeting Minutes – April 23, 2024 Page 4 of 5 Commissioners were also advised by Senior Civil Engineer Roger Storz that the Municipal Code does not permit owners to fill in the park strip located adjacent to the home near the sidewalk. Chair Zisser opened public hearing. Javier Campos with SVEP consultants stated that they brought before the Planning Commission a significantly different project that fits the aesthetic of the neighborhood. Jonathan Dixon, neighbor, stated that a window looks at the entirety of his backyard. Wants application to provide more privacy of the backyard. Suggested also including windows in the garage for pedestrian visibility. Adrian Somento, neighbor, stated that she was concerned about the homeowners' true intentions and doesn’t trust that they will follow through with the project as designed and proposed. Leann Haniken, neighbor, stated that she sees the modern home fitting into neighborhood, and distrusts the owners. Stated that they tried to previously build a 5- bedroom motel in the past. Stated that she was opposed to the project. Senior Planner Fama stated that currently the common fence was built illegally, and as such the City could address the issue through a Code Enforcement action. Senior Planner Fama informed the Commissioners that the owner could add two ADU’s per state guidelines and one JADU ministerially if the owner chose to do so. Confirmed for Planning Commission that exempt ADU’s are not subject to front setbacks. Commissioners were supportive of the project and recommended that the City follow through with a Code Enforcement action on the illegally built common fence between the applicant’s property and the adjacent neighbor. Commissioners noted that the staff report justifies recommendations, some Commissioners believed the application was an improvement from what was previously before the Planning Commission, some did not. Commission also advised the public of the Traffic Calming program currently offered by the Public Works department if there are concerns about traffic safety in their community. Motion: Upon motion by Commissioner Buchbinder, seconded by Commissioner Fields, the Planning Commission motioned to grant approval of a Variance and Site and Architectural Review Permit to allow construction of a two-story, approximately 1,471 square-foot single-family dwelling, with substandard street-side and interior-side setbacks and an increase to the allowable Floor Area Ratio (FAR), Campbell Planning Commission Meeting Minutes – April 23, 2024 Page 5 of 5 including retention and alteration of an existing detached non-forming garage, on property located at 68 Page Street. File No.: PLN-2022-101, by the following roll call: AYES: Fields, Ostrowski, Krey, Buchbinder, Kamkar, Zisser, Majewski NOES: None ABSENT: None ABSTAIN: None REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR Commissioner Kamkar requested that the Planning Commission be given a presentation on the Annual Progress Report. Interest and request will be forwarded to Community Development Department Director Senior Planner Fama informed the Planning Commission that an Ordinance Code update is in process and will be presented to the City Council in the near future. The intent of the Ordinance Code update is to improve the speed and efficiency of the permitting process. Chair Zisser inquired about the status of major projects in the pipeline. Senior Planner Fama stated that the Planning Commission could be provided a link to the City’s GIS map of permits. Commissioners were informed that the Cresleigh project will be breaking ground next month. Chair closed public hearing.
