CALL TO ORDER
The Regular Planning Commission meeting of April 9, 2024, was called to order at 7:30 pm by
Chair Zisser, and the following proceedings were had to wit.

Received information from Commissioner Kamkar for the Adhoc Subcommittee report.
ORAL COMMUNICATIONS
This portion of the meeting is reserved for individuals wishing to address the Planning
Commission on matters of community concern that are not listed on the agenda. In the interest
of time, the Chair may limit speakers to five minutes. Please be aware that State law prohibits the
Commission from acting on non-agendized items, however, the Chair may refer matters to staff
for follow-up.
PUBLIC HEARING
Note: Members of the public may be allotted up to two (2) minutes to comment on any public
hearing item. Applicants/Appellants and their representatives may be allotted up to a total of five
(5) minutes for opening statements and up to a total of three (3) minutes maximum for closing
statements. Items requested/recommended for continuance are subject to Planning
Commission’s consent at the meeting.
2. PLN-2024-20 – 1796 Grace Avenue
Public Hearing to consider the request of Ramin Zohoor on behalf of Tilman Wekel to allow
the construction of an approximately 534 square-foot second-story addition to an existing
single-family residence, with a reduction to the 2nd-story side-yard setback from 9 ½ feet to
approximately 5-feet, 3-inches. The application under consideration includes a Site and
Architectural Review Permit. File No.: PLN-2024-20. Staff is recommending that this project
be deemed Categorically Exempt under CEQA. Planning Commission action is final unless
appealed in writing to the City Clerk within 10 calendar days. Project Planner: Larissa
Lomen, Assistant Planner.
Recommended Action: Adopt a Resolution (reference Attachment A), approving a Site and
Architectural Review Permit.
Assistant Planner Larissa Lomen presented staff report to consider the request of Ramin
Zohoor on behalf of Tilman Wekel to allow the construction of an approximately 534
square-foot second-story addition to an existing single-family residence, with a reduction to
the 2nd-story side-yard setback from 9 ½ feet to approximately 5-feet, 3-inches.
Commissioners asked how many other applicants had to go through a similar approval
process and if applicants looking at changing setbacks outside of City standards would also
need to go through this process.
Assistant Planner Larissa Lomen clarified that if an applicant wanted to seek a proposed
reduction to the existing standards, they would need to apply for the SAR permit and go
through this process.

Director Eastwood noted that it is part of the long term workplan to look at improving
streamlining and efficiency measures single-family neighborhoods.
Commissioners asked whether staff recommendations would change if the neighbors of the
applicant had issues with the proposed project.
Assistant Planner Lomen clarified that any issues or concerns would be evaluated on case-
by-case basis. The project did in fact go through the proper and established noticing
process, and no public comments were received in association with this specific request
The applicant, Ramin Zohoor, was online but had no comments.
Commissioners demonstrated support for project and noted that applications like this
should be approved ministerially.
Motion: Upon motion by Commissioner Krey, seconded by Commissioner Fields, the
Planning Commission motioned to grant approval of a Site and Architectural
Review Permit to allow construction of an approximately 534 square-foot
second-story addition to an existing single-family residence, with a reduction to
the 2nd-story side-yard setback from 9 ½ feet to approximately 5-feet, 3-inches
on property located at 1796 Grace Avenue. File No.: PLN-2024-20, by the
following roll call:

3. PLN-2023-125 – 57-101 Gilman Avenue & 60 Dillon Avenue
Public Hearing to consider the request of Richard Yee on behalf of Robson Homes, LLC to
allow the construction of a residential planned development including 25 townhomes
with 12 junior accessory dwelling units (JADUs) and one 10-unit apartment building, the
creation of 26 private lots and 7 common lots (33 new lots), with use of a 35% density
bonus (10 additional units) and waivers from the Zoning Code and East Campbell Avenue
Master Plan, and removal of five (5) trees on property located at 57-101 Gilman Avenue
and 60 Dillon Avenue. The applications under consideration include a Planned
Development Permit, Density Bonus Request, Tentative Subdivision Map, and Tree
Removal Permit, submitted under an SB-330 preliminary application filed in compliance
with Government Code § 65941.1. File No.: PLN-2023-125. A Mitigated Negative
Declaration has been prepared for this project. Tentative City Council Date: May 7, 2024.

Recommended Action: Adopt a Resolution (reference Attachment A), recommending that
the City Council adopt a Mitigated Negative Declaration and approve a Planned

Development Permit, Density Bonus Request, Tentative Subdivision Map, and Tree
Removal Permit.
Assistant Planner Nishant Seoni presented staff report to consider the request of Richard
Yee on behalf of Robson Homes, LLC to allow the construction of a residential planned
development including 25 townhomes with 12 junior accessory dwelling units (JADUs) and
one 10-unit apartment building at 57-101 Gilman Avenue and 60 Dillon Avenue.
Commissioners inquired about causes that resulted in the perceived delay of the project.
Assistant Planner Nishant Seoni stated that it was a combination of significant back and
forth with other agencies, the process itself, and the changes from the applicant.
Richard Walker, Principal Planner with Interwest, stated that current Assessment & Interim
Remedial Action that requires that the applicant to secure a final closure confirmation from
San Francisco Bay Regional Water Quality Control Board (RWQCB) . Vapor from soil is
needing to be mitigated. A volatile organic compound was found.
Senior Planner Daniel Fama stated that originally there was an HCD issue with the
application because the application had a lower unit count than anticipated under the new
General Plan but applicant were allowed to submit their application as the City’s Housing
Element had not been adopted yet, under an SB-330 pre-app.
Assistant Planner Nishant clarified that some units will be sold and the JADU’s will still be
able to get rented. Commission were also informed that soil and water will be tested for
contamination.
Applicants stated – Richard Yee presented for Robson homes. Updated design reached 47
units. Requesting several waivers but no concessions. Clarified there is no requirement to
install for vapor barrier.
Commissioner asked applicant what took the application so long to get submitted.
Applicant stated that they to revisit the site plan and made some changes to further refine
the project. Wanted to create the right type of homes for the community.
Applicant clarified that the apartment building would not have elevators and that any EV
requirements will be met per City and state code.
Commissioners were in support of project and the project design. Excited to see it come to
fruition.
Motion: Upon motion by Commissioner Buchbinder, seconded by Commissioner Kamkar,
the Planning Commission motioned to adopt a resolution to allow Richard Yee

LAND USE SUBCOMMITTEE – PROGRESS REPORT
Commissioner Kamkar presented a status report on the subcommittee.
Commissioners stated that if there is a recommendation to undo or further review work already
approved then more information and details are needed. Subcommittee agreed to return at a
later day with more information.
REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
Director Eastwood reported that:
• City Council approved the AHOZ and Housing Zones. Zoning districts were also approved.
• City Council approved adoption of the 2024 Economic Development Plan.
• City Council approved in tandem with Economic Development Plan the Code Updates.
• City Council acknowledged Community Development week.
• Planning Division was awarded and recognized with the Regional CalAPA Award of Excellence.
Planning Commission was asked if they would like to mirror the start time of the City Council
meetings. This would mean that Planning Commission meetings would start at 7:00pm and
that SARC meetings would respectively need to move up as well. c
Commissioners showed a general consensus that a 7:00pm start time for Planning Commission
Regular Meetings would be okay.
Commissioners asked if there was a need for SARC.
City Attorney stated that commercial and industrial projects still require SARC review.
