2024.8.27 PC Min PLANNING COMMISSION REGULAR MEETING MINUTES Tuesday, August 27, 2024 I 7:00pm City Hall Council Chamber CALL TO ORDER The Regular Planning Commission meeting of August 27, 2024, was called to order at 7:00 pm by Chair Zisser, and the following proceedings were had to wit. ROLL CALL Staff Present: Rob Eastwood, Director Bill Seligmann, City Attorney Larissa Lomen, Assistant Planner Ken Ramirez, Administrative Analyst APPROVAL OF MINUTES 1. Approval of Minutes of August 13, 2024 (Roll Call Vote) ➢ Meeting Minutes, 8/13/2024 (Regular Meeting) Commissioner Krey abstained. All present approved. COMMUNICATIONS none AGENDA MODIFICATIONS OR POSTPONEMENTS none Planning Commissioners Present: Alan Zisser, Chair Matt Kamkar, Vice Chair Davis Fields Adam Buchbinder Michael Krey Planning Commissioners Absent: Maggie Ostrowski Cori Majewski Campbell Planning Commission Meeting Minutes – August 27, 2024 Page 2 of 4 ORAL COMMUNICATIONS This portion of the meeting is reserved for individuals wishing to address the Planning Commission on matters of community concern that are not listed on the agenda. In the interest of time, the Chair may limit speakers to five minutes. Please be aware that State law prohibits the Commission from acting on non-agendized items, however, the Chair may refer matters to staff for follow-up. PUBLIC HEARING Note: Members of the public may be allotted up to two (2) minutes to comment on any public hearing item. Applicants/Appellants and their representatives may be allotted up to a total of five (5) minutes for opening statements and up to a total of three (3) minutes maximum for closing statements. Items requested/recommended for continuance are subject to Planning Commission’s consent at the meeting. Disclosures – Commissioners visited the project site. 2. 67 Sunnyside Avenue – Historic Recission (Resolution/Roll Call Vote) Public Hearing to consider the request of Glenn Kinsey to remove a Structure of Merit from the Historic Resource Inventory (HRI) commonly known as the Emile and May Fritz House, on property located at 67 Sunnyside Avenue. The application under consideration includes a Historic Recission. File No.: PLN-2023-170. Staff is recommending that this project be deemed Categorically Exempt under CEQA. Tentative City Council Meeting Date: September 17, 2024. Project Planner: Larissa Lomen, Assistant Planner Recommended Action: That the Planning Commission adopt a resolution recommending that the City Council approve a Historic Recission. Assistant Planner Larissa Lomen presented staff report to consider the request of Glenn Kinsey to remove a Structure of Merit from the Historic Resource Inventory (HRI) commonly known as the Emile and May Fritz House, on property located at 67 Sunnyside Avenue. Commissioners received clarification that the item is before them because the Historic Preservation Board does not have decision-making authority and could only make a recommendations . Director Eastwood stated that the Department will consider in the future looking at the Historic Preservation Ordinance and determine if any valuable revisions can be identified. Assistant Planner Lomen informed the Planning Commission that structures of merit and historic buildings have to follow specific criteria before making any repairs or changes. Demolition of a historic resource can be seen as a violation of a CEQA action. Demolition is not allowed unless property is determined to not be historic. Campbell Planning Commission Meeting Minutes – August 27, 2024 Page 3 of 4 Planning Commissioners were informed that it was thought at one point that the home may have been related in some form to the Kennedy family. Homeowners sometime during the 1970’s may have been informed or surveyed that they had the option to out if they attended a public hearing but there is no documentation that the homeowners during this period opted out or attended the meeting. Director Eastwood informed the Planning Commission that the department is trying to go through the process currently to record the Historic properties with the Recorders Office. Assistant Planner Lomen stated that the historic timeline doesn’t show that properties went through a specific path to approve alterations to a historic resource. Difficult to say whether the Planning Division at the time would’ve required Conditional Use Permits for alterations. Chair Zisser opened the Public Hearing for public comment. Applicant architect, Kirby representing applicant spoke and stated that with regards to this item the applicant hired an architect to look at property and the city hired its own architect. They both found that the property does not merit to be on the list. Two historical architects are saying that it should not be on the list. Expressed that the applicant requested fair representation during the HPB meeting to decide. When dealing with the public it is incumbent on the City to have a full body for fair representation. Did not find the findings of the Historic Preservation Board to be valid. The Historic Preservation Board did not listen to the architects on the report and did not have a full body present to decide. Chair Zisser stated that Campbell’s Planning Division and the Historic Preservation Board followed the rules of what needed to be done. The applicant spoke and stated that it is unrealistic to expect that real estate agents would do this type of investigation or research with zoning. In his experience as a realtor since 1962, the body known as the Historic Preservation Board has never been mentioned in a transaction. Does not plan to demolish the home and wants to remain living in Campbell. Wants to remove the property from the Historic Resource Inventory list because he does not what the property listed in perpetuity. Keith Applegate spoke and stated that there is some concern about inheritance. Curious as to why Historic Preservation Board denied the rescission but Campbell Planning staff were in favor the of the rescission. Chair Zisser closed the public comment Commissioners commented and stated that it does not make sense to keep the property on the list given the findings of the Historic Architect reports. Property has not been preserved in a way that would identify it as such. Clear case of approving the rescission. Understand why the Historic Preservation Board would want to preserve history but are concerned with board opposing the recommendations of the consultants. Would also like for the Department to look into having items like this bypass the Planning Commission and go directly to City Council so as to not create an unnecessary administrative burden on the applicant. Motion: Upon motion by Commissioner Krey, seconded by Commissioner Buchbinder, the Planning Commission motioned to recommend that the City Council approve the request of Glenn Kinsey to remove a Structure of Merit from the Historic Resource Inventory (HRI) commonly known as the Emile and May Friz House, on property located at 67 Sunnyside Avenue. Project File No.: PLN-2023-170, by the following roll call: AYES: Fields, Kamkar, Zisser, Krey, Buchbinder NOES: None ABSENT: Ostrowski, ABSTAIN: Majewski NEW BUSINESS 3. Report of the Community Development Director Campbell passed an Air Quality Ordinance to replace All-Electric Requirements from the 2022 Reach Code. Campbell is the second jurisdiction in the county to take the approach. Council approved an Inclusionary Housing Ordinance and Nexus Fee. No items on the horizon for September 10, 2024 Planning Commission. Commissioners discussed the City Councils decision to pass the ordinance. Director Eastwood state that there was a lot of socialization with City Council on the ordinance.
