PC Res 2025-09RESOLUTION NO. 2025-09 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL GRANTING APPROVAL OF A SIGN PERMIT (PLN-2025-30) TO ALLOW AN APPROXIMATELY 97 SQUARE-FOOT, 36-INCH-TALL WALL SIGN READING “DOLLAR TREE” LOCATED AT 148 N SAN TOMAS AQUINO ROAD IN THE CC-MU (COMMERCIAL CORRIDOR MIXED-USE) ZONING DISTRICT. After notification and public hearing, as specified by law and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. The Planning Commission did find as follows with regard to application PLN-2025-30: 1. The project site has a zoning district of CC-MU (Commercial Corridor Mixed-Use) and a General Plan designation of Commercial Corridor Mixed-Use. 2. The project site is located at 148 North San Tomas Aquino Road, the northeast intersection of Campbell Avenue and North San Tomas Aquino Road, in the San Tomas Plaza. 3. The project site is located within a Master Sign Program, which stipulates Planning Commission approval is required for signage over 36-inches tall and greater than 50 square feet in size. 4. The proposed project includes an approximately 97 square-foot, 36-inch-tall wall sign reading “Dollar Tree” to be placed above the leased tenant space. 5. The proposed project does not exceed 80% of the frontage length or 80% of the fascia height and is comprised of individual channel letters. 6. The tenant, Dollar Tree, is intending to relocate from 150 N. San Tomas Aquino to 148 N. San Tomas Aquino. The wall sign located at 150 N. San Tomas Aquino shall be removed, as conditioned. 7. CMC Section 21.30.030(C)(4), the Planning Commission shall approve increased sign area or increased sign height upon making a finding. 8. Applicable General Plan policies, goals, and strategies considered by the Planning Commission included, but were not limited to, the following: Policy LU-1.10: Maintain a variety of attractive and convenient commercial and office uses that provide needed goods, services, and entertainment for residents and visitors. 9. In review the proposed project, the Planning Commission also weighed the public need for, and the benefit to be derived from, the project, against any impacts it may cause. No substantial evidence has been presented which shows that the project, as currently presented and subject to the required conditions of approval, will have a significant adverse impact on the environment. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: Sign Permit Finding (CMC Sec. 21.30.030): 1. The signs otherwise allowed by this chapter would not be visible to the public due to issues of distance or obstructions that are beyond the control of the owner of the site on which the signs are or would be located. No sign shall be increased in size or height more than is necessary to allow the signs to be visible and intelligible to a person of normal sight; and in no event may any sign exceed forty-five feet in height or three hundred fifty square feet in area. Environmental Finding(s) (CMC Sec. 21.38.050): 2. The project is Categorically Exempt under Section 15301 (Class 1) of the California Environmental Quality Act (CEQA), pertaining to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of an existing private structure, such as on-premise signs. 3. No substantial evidence has been presented which shows that the project, as currently presented and subject to the required conditions of approval, will have a significant adverse impact on the environment. THEREFORE, BE IT RESOLVED that the Planning Commission grants approval of a Sign Permit (PLN-2025-30) to allow an approximately 97 square-foot, 36-inch-tall wall sign reading “Dollar Tree” located at 148 N. San Tomas Aquino Road, subject to the attached Conditions of Approval (attached Exhibit A). Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. COMMUNITY DEVELOPMENT DEPARTMENT PLANNING DIVISION 1. Approved Project: Approval is granted for a Sign Permit (PLN-2025-30) to allow an approximately 97 square-foot, 36-inch tall wall sign reading “Dollar Tree”, on a building located at 148 N. San Tomas Aquino Road. The project shall substantially conform to the Project Plans included as Attachment B in the May 27, 2025 Planning Commission Staff Report, except as may be modified by the Conditions of Approval contained herein. 2. Permit Approval Expiration: Any building permits or sign approvals issued by the City shall be valid for six months from the effective date of Planning Commission approval. Within this six-month period, the sign must be erected in compliance with the approval consistent with CMC 21.30.030 – Permit expiration. 3. Sign Maintenance: The signs shall be maintained in good condition at all times and shall be repaired or replaced as necessary. 4. Building Permits Required: The applicant shall obtain all necessary building and/or electrical permits from the Building Division prior to the installation of any new signs. 5. Applicability of Increased Sign Area and Sign Height Approval: The approved increased sign are and sign height shall be valid for subsequent signage for future tenants, provided that the sign consists of individual channel letters, does not exceed the maximum dimensions (32’-2” x 36’-0”), and abides by other aspects of the Master Sign Program. 6. Property Maintenance: The owner/operator of the subject property shall maintain all exterior areas of the business free from graffiti, trash, rubbish, posters and stickers placed on the property. Exterior areas of the business shall include not only the parking lot and private landscape areas, but also include the public right-of-way adjacent to the business. Trash receptacles shall be maintained within their approved enclosures at all times.
