Dear Deponent;
You are hereby notified that pursuant to the California Code of Civil
Procedure Section 2019 (e) your deposition is available for your review
at our office. Code Section 2019 (e) states:
(el Unless the parties agree on the record to another
procedure for reading, correcting, and signing the
original of the deposition, when the testimony is fully
transcribed the officer shall notify the deponent and
counsel in writing that the original of the deposition
is available for reading, correcting and signing at the
office of the officer. and shall remain so available
during busines hours of business days for a period of 30
calendar days following such notification. The examination
and reading of the transcribed testimony may be waived
by the wi tness and by the parties. Any changes in form
or substance which the witness desires to make shall be
entered upon the deposition. The deponent may correct or
approve or refuse to approve the deposition for a period
of 30 days following the notification prescribed in this
subdivision by means of a letter addressed and mailed or
delivered to the transcribing officer indicating any
changes to be made. approval, or refusal to approve the
deposition. Such changes, approval, or refusal to approve
the deposition, when made by letter. shall be equivalent
to personal changes, approval, or refusal to approve the
deposition. '
If the deponent fails to appear at the office of the
officer or notify him by letter as provided in this sub-
division within such 3D-day period, or if the witness so
appears or sends such letter but refuses to approve or
sign the deposition, the officer shall indicate on the
original the fact that the deponent failed to appear, or
the fact that the deponent refused to sign together with
any reason given therefor. Thereafter the deposition shall
have the same force and effect as though it had been read,
corrected and signed by the deponent, unless on a motion
to suppress under subdivision (d) of Section 2021 of this
code the court holds that the reasons given for the refusal
to sign require rejection of the deposition in whole or in
part.

WHEREAS, the City Council has been advised by the City Engineer
that all improvements in Tract No. 6138 have been completed in ac-
cordance with that agreement entered into July 19, 1977, concerning
said Tract; and
WHEREAS, the City Engineer recommends acceptance of Tract and

Due to a change in
th~ water requirements by the City, and breach of the agreement,
Plaintiff was forced to expend an additional $20,170.00.
On or
about August 18,1978, claimant deposited the additional monies
with the San Jose Water Works and notified the City, via a letter,
of said payments being made under protest.
On or about October 12,
1~78, claimant again became aware of a change in the water require-
ments plans which necessitated an additional expenditure of
$24,243.00.
Some portion of the above listed expenditures are
due to the City's breach of the implied covenant of good faith
and fair dealing, found in the agreement, by not permitting claim-
ant or claimant's agents to work on City streets between the
hours of 9:00 a.m. and 3:00 p.m~
Claimant, at this time, is ignorant if the above listed
,.
expenditures were caused by any negligence on the part of the
City's employees, but wishes to notify the City of such a theory
of recovery and to preserve said theory.
5.
Claimant's injuries consist
of the loss of $44,413.00.
6.
The names of the public employees causing claimant's
injuries are unknown at this time.

We are returning your permit request along with your plans
for your further consideration of the following items:
1. Moving the line in Union Avenue to the east. The proposed
location will require about three feet of additional pavement
replacement due to being close to but not at the edge of the
existing overlay. Also traffic control will be very difficult
at the proposed location.
2. Please indicate your plans in the areaoof the existing traffic
detector loops in Union Avenue at Campbell Avenue.
3. Please submit your plans for traffic control, including signing
and any detours planned. Please be aware that detours or lane
closures will not be allowed betweon 7 and 9 a.m. or between
3:30 and 6 p.m.
4. For your information. resurfacing requirements on Campbell
Avenue and Union Avenue will be 6" A.C. on 10" class 2 A.B.,
or 10" A.C. on native. Duncanville Court will require 4"
A.C. on 12" class 2 A.B., or 9" A.C. on native.

BEING A RESOLUTION APPROVING FINAL MAP
OF TRACT NO. 6138, DUNCANVILLE COURT,
AND AUTHORIZING THE MAYOR TO SIGN THE
PROPOSED AGREEMENT.
WHEREAS, there has been submitted to the City Council of the
City of Campbell a final map of Tract No. 6138, Duncanville Court,
for approval; and,
WHEREAS, an agreement, which covers conditions pertaining to the
approval of said map and acceptance of the dedicated streets, has been
presented; and,
WHEREAS, the City Engineer has approved the map to the effect
that it conforms;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Campbell that said map be and the same is hereby approved, and
that the streets, avenues and public ways and reservations shown
thereon be and the same are hereby accepted; and,
BE IT FURTHER RESOLVED that the Mayor be and he is hereby
authorized to execute said agreement on behalf of the City of
Campbell.

on April 29,1977 at the Main office of the Corporation at
627 East Taylor Avenue, Sunnyvale, California 94086. The
President called the meeting to order.

The President stated that the loan application for
the construction financing for the "Hidden Leaf"
Subdivision at Tyrella and ~vandale Avenues, City

of Mountain View, California was ready for submission
and that United California Bank requires that the
Board of Directors of the Corporation authorize an
officer of the Corporation to execute the necessary
documents to consumate the application and closing.
Upon motion duly made secondedand unanimously passed
the following resolution was adopted:

Sanchez, or T. E. Burke, be authorized and
directed to execute on behalf of the Del Monte
Developers any and all Letters of Committment,
Notes, Deeds of Trust, Escrow Instructions,
Building and Loan Agreements, Bonds and any and

connection with the financing and development
of any land purchase or loan, either individually
of any conbination of signatures necessary for
the completion of any loan, purchase or sale of
Real Estate in:Mhich Del Monte Developers may
have an interest. The authority granted in'this
resolution is effective immediately, and shall
run until revoked by the BoaIrlof Directors of
the Corporation.
There being no further business to come before the Board
