BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL ADOPTING THE SAN TOMAS AREA
NEIGHBORHOOD PLAN
WHEREAS, since 1979 there has been a strong concern expressed by
residents of the San Tomas Area to preserve the rural, low-density residential
character of the area.
WHEREAS, the City recognizes the San Tomas Area as unique in terms
of its rural character and since 1980 has main~ained a policy of:

Maintaining the area as low-density residential
Encouraging larger-than-minimum lot sizes
Encouraging the planting of trees, shrubs, greenery, and other
landscaping materials in new developments
Preserving existing trees and shrubs
Considering alternate street improvements in appropriate areas

WHEREAS, the City Council in 1982 took further action to preserve the
area by reducing the residential densities in many areas, as indicated on the
Land Use Element Map of the General Plan.
WHEREAS, the City Council authorized the San Tomas Study in
November 1991 to develop land use and transportation standards to
implement the general plan policies for the San Tomas Area.
WHEREAS, for the purposes of the San Tomas Study, the area was
divided into four neighborhoods and a Neighborhood Work Group
comprised of residents in each neighborhood developed goals and policies for
their neighborhood.
WHEREAS, the San Tomas Study Task Force reconciled the various
goals and policies and developed by each Neighborhood Work Group and
drafted the San Tomas Area Neighborhood Plan.
WHEREAS, the San Tomas Area Neighborhood Plan implements the
existing general plan policies for the San Tomas Area.
WHEREAS, the land use policies contained within the plan are
consistent with general plan policies for the San Tomas Area which promote
maintaining the low density characteristics of the neighborhood.

WHEREAS, the transportation policies and alternative street designs
contained within the Plan implement the general plan policy of encouraging
alternative street improvements to reinforce the rural character of the area.
NOW, THEREFORE, BE IT RESOLVED that the City Council of ~he City
of Campbell does hereby adopt the San Tomas Are Neighborhood Plan.

WHEREAS, during the past 25 to 30 years there have been several Improvement
Agreements between the City of Campbell and the property owners on Railway Avenue,
Dillon Avenue, Gilman Avenue and Sam Cava Lane, as shown on Exhibit A; and,
WHEREAS, these agreements deferred construction of the public improvements until
an area-wide project could be generated; and,
WHEREAS, the Dillon/Gilman Local Improvement District No. 30 was established
for the purpose of constructing theses public improvements, and they have been completed;
NOW, THEREFORE, BE IT RESOLVED that the Improvement Agreements for
the property listed on Exhibit A are no longer necessary and are released by the City of
Campbell; and,

BE IT FURlHER RESOLVED that the Director of Public Works is authorized to
execute the Notices of Release for those properties; and, that the City Clerk is directed to
record them.

CITY OF CAMPBELL
NOTICE IS HEREBY GIVEN concerning the real property located in the City
of Campbell, Santa Clara County, California, and described specifically as follows:
Recorded in Book 0942, Page 445 of Official Records on September 12, 1978.
That the undersigned City of Campbell granted conditional approval of
certain improvements on the above-described real property on March 10, 1966, pursuant
to a Deferred Street Improvement Agreement entered into between the City and the
Owner recorded in the official records of the Santa Clara County Recorders' office in
Book 7329, Page 511.
That Wayne Allen, et aI., Owner of said real property, executed a petition for
the formation of a special assessment district created pursuant to any special assessment
act as provided in the Streets and Highways Code of the State of California, and
participated and became a part of that special assessment district.
That special assessment district No. 30 entitled Dillon-Gilman LID #30 was
in fact created and included the real property described above.
That as a result of the creation of this special. assessment district, Owner will
not be responsible for, and is hereby released from, the construction and/or installation
of the street improvements delineated in the Deferred Street Improvement Agreement of
March 10, 1966, recorded in the Official Records of the Santa Clara County Recorders
Office at Book 7329 , Page 511.

That the City Council act upon the subject development at Emory Avenue
and Waldo Road in accordance with the policy set forth in Resolution No.
6002, adopted December 8, 1980, regarding street standards in rural areas.
A copy of Resolution No. 6002 is attached.
BACKGROUND:
On September 21, 1981, a tentative map for the purpose of creating two
lots from the existing lot on the southeast corner of Emory Avenue and
Waldo Road was approved by the Planning Director and the Public Works
Director, subject to certain conditions.
Among those conditions of approval was a requirement to construct street
impro~ements along the frontage of the new lots. Mr. Herbert Killmeyer,
a land surveyor who prepared the parcel map for Ms. Washington, the prop-
erty owner, objected to the requirement to construct the improvements on
the basis that the City Council had assured all of the property owners in
this area that they would nit have to install city improvements on their
streets after they were annexed through the MORGA proceedings. Mr.

Staff advised Mr. Killmeyer that the City Council had adopted Resolution
No. 6002 on December 8, 1980, which allowed modification of the standard
street improvements upon recommendation of the City Engineer and the
Planning Director. Mr. Killmeyer was also advised of the procedure
adopted by the City Council for neighborhood input at the Planning
Commission level when modifications were under consideration.

RESOLUTION NO. 6002
BEING A RESOLUTION MODIFYING TIlE STANDARD
SPECIFICATIONS AND DETAILS OF THE CITY OF
CAMPBELL
WHEREAS, the City Council of the City of Campbell has adopted the Standard
Specifications and Details for Public Works Projects by Resolution No. 319, on
June 18, 1955; and
WHEREAS, the City Council has determined that it may be appropriate to
provide for the utilization of alternative materials and surface treatments for
the construction of curbs, gutters and sidewalks in selected areas of the City,
upon recommendation of the City Engineer, and Planning Director; and
WHEREAS, the City Council has further determined that it may be appropriate
to provide for the installation of pedestrian walkways along curvilinear align-
ments on selected residential streets, upon recommendation of the City Engineer,
and Planning Director.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the Standard Specifications and Details of the City of Campbell are hereby
modified to allow the provisions hereinabove described.
