The Planning Commission meeting of March 22,2005, was called to order at 7:30 p.m., in the
Council Chambers, 70 North First Street, Campbell, California by Acting Chair Doorley and
the following proceedings were had, to wit:

APPROVAL OF MINUTES
Motion: On motion of Commissioner Rocha, seconded by Commissioner Roseberry,
the Planning Commission minutes of March 8, 2005, were approved as
submitted. (4-0-2-1; Commissioners Alderete and Gibbons were absent
and Commissioner. Francois abstained)

Commissioner Roseberry recused himself from Agenda Item No.1 as he resides within
noticing distance of this project site. He left the dais and chambers for the duration of
discussion on this item.
Acting Chair Doorley read Agenda Item No.1 into the record as follows:

Continued Public Hearing (from the Planning Commission meeting
of March 8, 2005) to consider the application of Mr. Dale
Lineburger for a Site and Architectural Review Permit (PLN2005-
04) to allow the construction of a new two-story single-family
residence on property owned by Greg and Sue Jones located at 1396
Westmont Avenue in an R-1-9 (Single Family Residential) Zoning
District. Staff is recommending that this project be deemed
Categorically Exempt under CEQA. Planning Commission decision
final, unless appealed in writing to the City Clerk within 10 calendar

Ms. Stephanie Willsey, Planner I, presented the staff report as follows:
. Advised that the applicant is seeking approval of a Site and Architectural Review Permit to
allow the construction of a new two-story single family residence on property located at
1396 Westmont Avenue.
. Informed that the existing single-story residence would be demolished.
. Described the project site as being zoned R-1-9. This project is consistent with required
heights, FAR and parking provisions. No trees are to be removed. Existing trees will be
protected during construction.
. Recommended the adoption of a Resolution approving this project subject to the revised
Conditions of Approval.
Commissioner Rocha presented the Site and Architectural Review Committee report as
follows:
. SARC reviewed this proposal on February 22, 2005, and was supportive with no
significant comments.
Acting Chair Doorley opened the Public Hearing for Agenda Item No.1.
Ms. Meg Stein:
. Identified herself as a representative of the San Tomas Neighborhood Association.
. Stated that she has heard no complaints or issues raised.
. Said that the proposal fits within the guidelines of the San Tomas Area Neighborhood Plan.

Ms. Patricia Nichols, 1430 Westmont Avenue, Campbell:
. Reiterated her concerns that she raised at the last meeting about the suitability of this two-
story home among the existing single-story homes in this neighborhood.
. Added that there is also the issue of ecological responsibility. The heating and cooling
needs are the single most expensive and extensive use of oil products. A 4,000 square foot
house is not ecologically responsible.
Acting Chair Doorley closed the Public Hearing for Agenda Item No. I.
Commissioner Francois:
. Reported that the Commissioners make it a point to take tours of sites under their
consideration.
. Added that he was in this particular neighborhood earlier today and found that there are
comparable sized homes in the area.
. Reminded that the San Tomas Neighborhood Association representative has said that this
house appears to be compatible.
. Advised that he would be supportive of this request.
Acting Chair Doorley:
. Reminded that the maximum height proposed for this home is actually several feet lower
than the maximum allowed.
. Said that the Commission is charged with addressing a changing community.
. Stated that this proposal meets City development requirements in every category and is
below the maximum allowable in many respects. The proposed home is architecturally
compatible and there is no reason not to support this request.
. Agreed that ecological impacts are important and may need to be addressed in future
General Plan updates.
. Reminded that a newer home would be much more energy efficient than the existing
structure on this parcel.
Commissioner Rocha:
. Said that the Commission does not create policy and that strict criteria for consideration of
such requests is in place. It is a thorough review process and the Commission is
constrained by policy. The Commission oversees that policy.
. Reminded that decisions of this Commission can be appealed to Council.
. Said that he too is sensitive to energy conservation issues and that the heavily insulated
homes that are being built today are more energy efficient.
. Stated that this project meets the requirements.
. Added that he lives on a flag lot himself and would love to live next to such a large lot as
this one.
Motion:
Upon motion of Commissioner Francois, seconded by Commissioner
Rocha, the Planning Commission adopted Resolution No. 3637 approving a
Site and Architectural Review Permit (PLN2005-04) to allow the
construction of a new two-story single-family residence on property owned

by Greg and Sue Jones located at 1396 Westmont Avenue, with the added
Condition of Approval to post a sign on the project site within public view
with contact information for the project contractor prior to issuance of
building permits, by the following roll call vote:

ABSENT: Alderete and Gibbons
ABSTAIN: Roseberry
Acting Chair Doorley advised that this action is final unless appealed in writing to the City
Clerk within 10 calendar days.

Public Hearing to consider the application of Ms. Sukkin Fong for a
Site and Architectural Review Permit (PLN2005-05) to allow the
construction of a new two-story single-family residence on property
owned by Ms. Sukkin Fong located at 1141 S. San Tomas Aquino
Road in an R-I-9 (Single Family Residential) Zoning District. Staff
is recommending that this project be deemed Categorically Exempt
under CEQA. Planning Commission decision final, unless appealed
in writing to the City Clerk within 10 calendar days. Project

Ms. Stephanie Willsey, Planner I, presented the staff report as follows:
. Advised that the applicant is seeking approval of a Site and Architectural Review Permit to
allow the demolition of a single-story residence and three detached accessory structures
and the construction of a new two-story residence on the rear lot (Parcel 2).
. Reported that the Community Development Director approved a Parcel Map in January to
split one lot into two residential lots. One is a standard lot (Parcell) and the other is a flag
lot (Parcel 2).
. Described the zoning as R-1-9 and stated that this project meets requirements of that
zoning. The new home is a two-story and includes a three-car garage. The home faces
Turner Way and is accessed by a private drive from San Tomas Aquino Road.
. Recommended the adoption of a Resolution approving this request.
Commissioner Roseberry presented the Site and Architectural Review Committee report as
follows:
. Reported that SARC reviewed this proposal at its meeting of March 8, 2005, and was
generally supportive.
. Said that SARC had requested that the proposed colors be toned down and that decorative
pavements be used for the driveway.

Said that these requirements have been incorporated into the Conditions of Approval and
SARC is supportive.
Planner Stephanie Willsey agreed that the changes recommended by SARC have been
incorporated into the Conditions of Approval.
Acting Chair Doorley opened the Public Hearing for Agenda Item No.2.
Ms. Meg Stein:
. Reminded that she is representing the San Tomas Neighborhood Association.
. Said this project is a great asset to the area and is architecturally great. It fits the lot well.
. Reported that she has received no comments or complaints.
. Stated that the project complies with the San Tomas Area Neighborhood Plan.
. Said this project is okay.
Acting Chair Doorley closed the Public Hearing for Agenda Item No.2.
Motion:
Upon motion of Commissioner Francois, seconded by Commissioner
Roseberry, the Planning Commission adopted Resolution No. 3638
approving a Site and Architectural Review Permit (PLN2005-05) to allow
the construction of a new two-story single-family residence on property
owned by Ms. Sukkin Fong located at 1141 S. San Tomas Aquino Road

Public Hearing to consider the application of Mr. Guillermo Prado,
on behalf of Ms. Candida Quiroga, for a Site and Architectural
Review Permit (PLN2004-142) to allow the construction of a new
single-family residence on property owned by Ms. Candida Quiroga
located at 1377 York Avenue in an R-1-9 (Single Family
Residential) Zoning District. Staff is recommending that this project
be deemed Categorically Exempt under CEQA. Planning
Commission decision final, unless appealed in writing to the City

Ms. Stephanie Willsey, Planner I, presented the staff report as follows:
. Advised that the current single-story home and detached garage on this property would be
demolished.
. Said that the zoning for the property is R-1-9 but that legal non-conforming lots are
allowed setback and coverage exceptions under the San Tomas Area Neighborhood Plan
and must meet the R-1-6 requirements.
. Reported that no trees would be removed and four trees would be added.
. Recommended the adoption of a Resolution approving this request.
Acting Chair asked about the FAR for R-1-6 and R-1-9.
Planner Stephanie Willsey replied that the FAR standard is the same for both zonIng
designations.
Commissioner Roseberry presented the Site and Architectural Review Committee report as
follows:
. Reported that SARC reviewed this project on March 8, 2005, and was supportive.
. Added that SARC had concerns regarding the large arched windows on the front elevations
and recommended that they be lowered by six inches. Additionally, SARC suggested that
a decorative paving material be used for the driveway.
. Advised that staff has added these changes to the Conditions of Approval.
Acting Chair Doorley opened the Public Hearing for Agenda Item No.3.
Ms. Meg Stein:
. Reported that no negative comments or complaints have been received.
. Said that York Avenue is pretty stable and not many new homes have been constructed in
the area.
. Stated that the project meets the San Tomas Area Neighborhood Plan requirements.
Acting Chair Doorley closed the Public Hearing for Agenda Item No.3.
Commissioner Roseberry:
. Said that this is a small lot for this zoning area.
. Pointed out that this is a single-story house using hipped roof that makes it look less
maSSIve.
. Expressed support for this application.

REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Ms. Sharon Fierro, Community Development Director, was accepted as
presented with the following additions:
. Reported that no items from the Council meeting on March 21,2005, were of interest to the
Commission.
. Advised that a Study Session was held to consider the Capital Improvement Program and
this CIP would be coming to the Commission on the next agenda to find consistency with
the General Plan and to make the required environmental assessment of the proposed
projects.
. Stated that the next agenda would consist of four items, including the continued hearing on
the sign for R. V Cloud.
