upheld the Planning Commission's conditional approval of your project at
201 E. Hamilton Avenue. This action upholds the Planning Commission's
Condition of Approval which required the installation of a boulevard
sidewalk treatment for this project, if the City Council adopts an interim
policy for such street improvements.

BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL APPROVING A REINSTATEMENT TO
A PREVIOUSLY APPROVED SITE AND ARCHITECTURAL
PERMIT (S 88-19) ON PROPERTY LOCATED AT 201 EAST
HAMILTON AVENUE, IN A C-1-S (NEIGHBORHOOD
COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR.
STANTON ELLIOIT. FILE NO. R 92-10 (S 88-19)
After notification and Public Hearing as specified by law on the application of
Mr. Stanton Elliott, for reinstatement to a previously approved Site and
Architectural Permit (S 88-19) on property located at 201 East Hamilton
Avenue, in a C-1-S (Neighborhood Commercial) Zoning District, as per the
application filed in the Planning Department on October 22, 1992; and, after
presentation by the Planning Director, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. R 92-10 (S 88-19).
Negative Declaration
1. No substantial evidence has been presented which shows that the project
as presented and subject to the required conditions, would have a
significant adverse impact on the environment.
2. No evidence has been presented which shows that the project will have
a substantial impact on plant or animal life.
Site and Architectural Approval
3. The proposed project with the conditions imposed is an appropriate scale
in relationship to the adjacent developed uses.
4. The project is well designed and architecturally blends into the
neighborhood.
5. The parking provided at 1:225 for leasable office space is considered
adequate for the proposed office space.
6. The proposed landscape buffer and building placement is designed to
minimize infringement on neighboring properties.
7. The provision of a separated sidewalk design along the street frontage is
consistent with previous Planning Commission approvals along major
arterial streets.

Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
1. The proposed project, subject to the conditions imposed, will be
consistent with the General Plan; and,
2. The proposed project, subject to the required conditions, will aid in the
harmonious development of the immediate area.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed, subject to the following Conditions of
Approval:
SITE AND BUILDING DESIGN
1. Approved Project: Approval is granted to construct a two and one-half
(2 1/2) story office building. The building designs shall substantially
conform to the project exhibits listed below, except as may be modified by
the Conditions of Approval. (Planning)
A. Site plan prepared by Stanton Elliott, stamped received January 7,
1993. (Planning)
B. Building elevations and floor plans prepared by Stanton Elliott,
stamped received January 7, 1993. (Planning)
2. Public Occupancy: Building occupancy will not be allowed until public
improvements are installed. (Public Works)
3. Landscaping: Submit a landscape and irrigation plan for approval by the
Site and Architectural Review Committee prior to issuance of building
permits addressing the following:
A. Screening of side elevations of the office building.
B. Preparation plan pursuant to standards of (WELS) policy.
4. Parking and Driveways: All parking and driveway areas to be developed
in compliance with Chapter 21.50 of the Campbell Municipal Code.

approved by the Planning Department prior to issuance of a building

PROPERTY MANAGEMENT /UTILmES
6. Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to
the Planning Department, prior to the installation of PG&E utility
(transformer) boxes and San Jose Water back-flow preventers, indicating
the location of the boxes and screening (if boxes are above ground) for
approval by the Planning Director. (Planning)
7. Utility Connections: Plans submitted to the Building Division for plan
check shall indicate clearly the location of all connections for
underground utilities including water, sewer, electric, telephone and
television cables, etc. (Building)
8. Utility Meters: One set of meters must be provided for each parcel per
City Ordinance. (Building)
9. Underground Utilities: Underground utilities to be provided as required
by Section 20.36.150 of the Campbell Municipal Code. (Public Works)
10. Property Maintenance: The applicant is hereby notified that the property
is to be maintained free of any combustible trash, debris and weeds, until
the time that actual construction commences. All existing structures
shall be secured by having windows boarded up and doors sealed shut, or
be demolished or removed from the property. Section 11.201 & 11.414,
1985 Ed. Uniform Fire Code. (Fire)
11. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code
stipulates that any contract for the collection and disposal of refuse,
garbage, wet garbage and rubbish produced within the limits of the City
of Campbell shall be made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings, mwtiple apartment
units, to all commercial, business, industrial, manufacturing, and
construction establishments. (Fire)
FIRE DEPARTMENT
12. The building shall be provided with supervised fire sprinkler protection
throughout. U.F.e. Section 10.507.
13. Exterior walls located within 20 feet of a property line shall be of one
hour fire resistive construction.

14. Exterior wall openings located within 10 feet of a property line shall be
protected as required in U.B.C. section 504 and Table 5-A.
PUBLIC WORKS DEPARTMENT
15. Submit plans, pay fees, post surety, and obtain an encroachment permit
for all work within the public right-of-way.
16. The arrows shown on the Hamilton Avenue driveway are backwards,
and should be reversed.
17. Show the distance from the street centerline to the Hamilton Avenue
property line.
18. Dedication must be made to the back of the proposed sidewalk to
accommodate the boulevard treatment on Hamilton Avenue.
19. Provide on-site grading and drainage plan for approval by City Engineer.
PLANNING DEPARTMENT
20. Mutual Access Easements: Applicant to provide evidence of mutual
access easements for ingress/egress to adjacent property, in the event that
the two properties are held under separate ownership.
21. Sidewalk Improvements: The applicant shall install, or agree to install,
street improvements (including sidewalks and landscaping) consistent
with adopted City Council policy for arterial streets, provided said
sidewalk standards are adopted within six months of the date of this
approval. If the City Council does not take action to adopt an arterial
street sidewalk policy within six months of this Planning Commission
approval, the applicant shall be obligated to install a 10 foot monolithic
sidewalk and street trees, consistent with City Standards.
22. Building Division Submitta~: Plans submitted to the Building
Department for plan check shall indicate clearly the location of all
connections for underground utilities including water, sewer, electric,
telephone and television cables, etc.
23. Signs: Sign application to be submitted in accordance with provisions of
the Sign Ordinance for all signs. No sign to be installed until application
is approved and permit issued by Planning and Building Departments
(Section 21.53 of the Campbell Municipal Code).

24. Applicant shall comply with all appropriate State and City requirements
for the handicapped.
25. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by

removed from the property. Sect. 11.201 & 11.414, 1979 Ed. Uniform Fire

26. Performance Bond: Applicant to submit a performance bond in the
amount of $10,000.00 or file a written agreement to insure installation of
landscaping, fencing and striping of parking area within 90 days of
project occupancy.

approval granted under this section shall expire one (1) year after the
date upon which such approval was granted, unless an extension or
reinstatement is approved.
Approval is effective ten (10) days after decision of approval of the
Planning Commission, unless an appeal is filed.

CONDITIONS OF APPROVAL - FILE n S 88-19

The applicant is hereby notified, as part of this application, that he/she is
required to meet the following conditions in accordance with the Ordinances of
the City of Campbell and the Laws of the State of California. Additionally,
the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California which pertain to this development and are not herein specified.
1. Revised elevations indicating revised stairway design to be submitted to
the Planning Department and approved by the Planning Director upon
recommendation of the Architectural Advisor prior to application for a
building permit.
2. Property to be fenced and landscaped as indicated and/or added in red on
the plans. Landscaping and fencing shall be maintained in accordance with
the approved plans.
3. Landscaping plan indicating type and size of plant material, and location
of irrigation system to be submitted to the Planning Department and
approved by the Site and Architectural Review Committee and/or Planning
Commission prior to issuance of a building permit.
4. Fencing plan indicating location and design details of fencing to be
submitted to the Planning Department and approved by the Planning Director
prior to issuance of a building permit.
5. Applicant to either (1) post a faithful performance bond in the amount of
$5,000.00 to insure landscaping, fencing, and striping of parking areas
within 3 months of completion of construction; or (2) file written
agreement to complete landscaping, fencing, and striping of parking areas.
Bond or agreement to be filed with the Planning Department prior to
appli~ation for a building permit.
6. Applicant to submit a plan to the Planning Department, prior to
installation of PG&E utility (transformer) boxes, indicating the location
of the boxes and screening (if boxes are above ground) for approval of the
Planning Director.
7. Applicant to submit a letter to the Planning Department, satisfactory to
the City Attorney, prior to application for building permit, limiting the
use of the property as follows: 6,324 sq. ft. leasable office space and
lunch room and lobby.
8. All mechanical equipment on roofs and all utility meters to be screened as
approved by the Planning Director.
9. Building occupancy will not be allowed until public improvements are
installed.
10. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
11. Underground utilities to be provided as required by Section 20.36.150 of
the Campbell Municipal Code.

12. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
13. Sign application to be submitted in accordance with provisions of the Sign
Ordinance for all signs. No sign to be installed until application is
approved and permit issued by Planni~g and Building Departments (Section
21.53 of the Campbell Municipal Code).
14. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single-family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
15. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire Department.
Unless otherwise noted, enclosure(s) shall consist of a concrete floor
surrounded by a solid wall or fence and have self-closing doors of a size
specified by the Fire Department. All enclosures to be constructed at grade
level and have a level area adjacent to the trash enclosure area to service
these containers.
16. Applicant shall comply with all appropriate State and City requirements for
the handicapped.
17. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from
the property. Sect. 11.201 & 11.414, 1979 Ed. Uniform Fire Code.
BUILDING DEPARTMENT
18. Retaining walls at property lines are limited to a height of 15 inches if
constructed of wood.
19. Office: B2 - One hour fire rated walls less than 20'0" to property line.
Garage: B1 - One hour fire rated wall between B1 & B2, and one hour
protection to property line. Lunchroom to have 2 exits. Elevators and
exit onto roof not acceptable.
FIRE DEPARTMENT
20. An approved fire sprinkler system complying with NFPA Standard #13 shall be
provided for the entire structure including all overhangs, canopies, and
trash enclosures within 10' of the building. Uniform Fire Code 10.308(a).
21. Three story B-2 occupancies shall be of 1-hour constructions. 3rd story
lunchroom/roof deck area may be classified as an A-3 occupancy requiring
Type I or Type II fire rated construction. UBC Table 5-D.
