Code Sec. 27383 (Space above this line for Recorder's Use) RECORDATION OF HERITAGE TREE DESIGNATION This Recordation is executed and delivered as of the 3rdday of FebruaIY 2oq1Jy the City of Campbell, having a business address of 70 North First Street, Campbell, California 95008 (hereinafter referred to as "City"), in favor of and for the benefit of the City of Campbell, having an address at 70 North First Street, Campbell, CA 95008 (who is hereinafter referred to as "City"). WITNESSETH: WHEREAS, the City of Campbell (hereinafter referred to as "Owners"), are the sole owners in fee of certain real property commonly known as 1405 Abbott Avenue, Campbell, California (Santa Clara County Assessor's Parcel Number 403-17-043), and more particularly depicted in Exhibit A attached hereto and made a part hereof (hereinafter referred to as the "Subject Property"); WHEREAS, on September 22, 2004, the Historic Preservation Board of the City adopted Resolution No. 2005 approving a Heritage Tree Designation for a fifty-six inch in diameter, one hundred year-old Valley Oak Tree on the Subject Property, the location of which is depicted on Exhibit B attached hereto and made a part hereof. WHEREAS; the Zoning Code requires the City to record the designation with the County Recorder's office and a copy shall be provided to the property owner and the Community Development Department. NOW, THEREFORE, PLEASE TAKE NOTICE: 1. The tree depicted on Exhibit B has been declared a Heritage Tree under Chapter 21.32 of the Campbell Municipal Code. 2. The designation set forth herein shall be appurtenant to and run with the land. 3. This Recordation shall be recorded in the Santa Clara County Office of the Recorder. 4. L RESOLUTION NO. 2005 BEING A RESOLUTION OF THE HISTORIC PRESERVATION BOARD OF THE CITY OF CAMPBELL BESTOWING HERITAGE TREE DESIGNATION (PLN2004-118) UPON A 56-INCH IN DIAMETER, 100 YEAR OLD OAK TREE ON PROPERTY OWNED BY CITY OF CAMPBELL LOCATED AT 1405 ABBOTT AVENUE IN A P-F/O-S (PUBLIC FACILITIES/OPEN SPACE) ZONING DISTRICT. APPLICATION OF CITY OF CAMPBELL. FILE NO. PLN2004-119. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Historic Preservation Board did find as follows with respect to application PLN2004-119: 1. This 56-inch diameter, 3100-year-old Oak tree is on the Historic Preservation Board Tree Survey, which was completed in 2002. 2. This 56-inch diameter, 100-year-old Oak tree represents an outstanding specimen of a desirable species. 3. This 56-inch diameter, 100-year-old Oak tree is one of significant age and/or girth in the City of Campbell. Based on the foregoing findings of fact, the Historic Preservation Board further finds and concludes that: 1. The Oak tree is unique and important to the Community; and 2. No substantial evidence has been presented ITom which a reasonable argument could be made that shows that the Heritage Tree Designation will have a significant adverse impact on the environment. NOW, THEREFORE, BE IT RESOLVED that the Historic Preservation Board bestows Heritage Tree Designation (PLN2004-119) upon a 56-inch diameter, 100-year-old Oak tree on property owned by City of Campbell located at 1405 Abbott Avenue. Meeting of September 22, 2004 PLN2004-119 City of Campbell Application for a Heritage Tree Designation (PLN2002-119) for a 556inch diameter, 100-year old Oak tree on property owned by the City of Campbell at 1405 Abbott Avenue in a P-F/O-S (Public Facilities/Open Space) Zoning District. STAFF RECOMMENDATION That the Historic Preservation Board take the following action: Adopt a resolution, approving the Heritage Tree Designation for a 56-inch diameter, 100-year old Oak tree at 1405 Abbott Avenue. DISCUSSION The applicant has submitted an application for a Heritage Tree Designation for a 56-inch diameter, 100-year old Oak tree, located at 1405 Abbott Avenue. The tree is located at Jack Fischer Park near Pollard Road. Oak tree, commonly called the Oak at Jack Fischer Park, is approximately 56-inches in diameter, 168-inches in circumference, 75-feet tall, and has a canopy spread of 60-feet. The Oak at Jack Fischer Park is indigenous to the area and is probably one of the oldest trees in the City of Campbell. The Parks and Recreation Commission reviewed this item at its meeting of September 1, 2004 and was supportive of Heritage Tree Designation for the Oak tree at Jack Fischer Park. If the Heritage Tree Designation is approved, the City shall record the designation with the County Recorder's office and a copy shall be provided to the property owner and the Community Development Department. A listing of designated Heritage Trees and their locations shall be listed on the Historic Resources Inventory and maintained by the Community Development Department. ANALYSIS Staff is supportive of the Heritage Tree Designation based on the following findings: 1. It is on the Historic Preservation Board Tree Survey, completed in 2002. 2. Community Development Department Memorandum Date: August 23,2004 To: Parks & Recreation Commission From: Melinda Denis Planner I Re: Heritage Tree Designation Background The Historic Preservation Board Subcommittee conducted an initial heritage tree survey study throughout the entire City during the Summer of 2001. The survey was revised during the Summer of 2002. A list of possible heritage tree designations located on private and public property was developed and reviewed by the Historic Preservation Board on October 23, 2002. Seven trees, located on public property or in a public right-of-way, were recommended for further study as possible heritage tree designations. Proposal After further study and review, City staff is recommending heritage tree designation of two trees located on public property, the Oak at Jack Fischer Park and the Son of the Roosevelt Redwood at the Campbell Community Center. Potential heritage tree designations are evaluated based upon the criteria set forth in Section 21.32.130 (Heritage Tree Designations) of the Campbell Municipal Code. A tree may be designated as a heritage tree upon a finding that it is unique and important to the community due to any ofthe following factors: a. It is an outstanding specimen of a desirable species; b. It is one of significant age and/or girth in Campbell; or c. It has cultural, educational, economic, agricultural, social, indigenous or historical heritage of the city. The two potential heritage trees are outstanding specimens of a desirable species and are one of significant age and/or girth in Campbell. The Oak at Jack Fischer Park is approximately 75-feet tall, 55.75-inches in diameter, has a 60-foot canopy spread, and is over 100 years old. The tree is indigenous to the area and is probably one of the oldest trees in Campbell. Parks & Recreation Comml~ In - Sevtember 1.2004 Paf!e 2 of 2 The Son of the Roosevelt Redwood is approximately 65-feet tall, 40-inches in diameter, has a 34- foot canopy spread, and is thirty-eight years old. The Son of the Roosevelt Redwood was grown from a burl from the original Redwood tree planted by President Theodore Roosevelt on May 11, 1903 to honor the construction of a new high school for the Campbell Union School District. The original Redwood tree was cut down to make way for the widening of Winchester Boulevard. Prior to cutting down the tree, Campbell Union High School superintendent Larry Hill had taken a burl off the original tree. He was able to produce a clone of the tree from a burl, which is a lumpy outcropping on the trunk of the tree.
