MICHAEL COBLER LOCATED AT 1777 S BASCOM A VENUE IN A P-D (PLANNED DEVELOPMENT) ZONING DISTRICT. FILE NO. PLN2004-12. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN20040-12: 1. The proposed project consists of the establishment of a 2,077 square foot retail store in an existing 18,596 square foot multi-tenant commercial building. 2. The development of the proposed project will result in a use that is consistent with the General Plan land use designation of Commercial/Professional Office/Residential for this area. 3. The proposed retail store is consistent with the P-D (Planned Development) zoning designation for the site with approval of a Use Permit. 4. The proposed use is located within an established commercial center and is compatible with the surrounding development and uses. 5. The existing parking will adequately meet the demands generated by the change in use, and will not be detrimental to the overall parking and circulation in the area. 6. The proposed operational hours of 8:00 a.m. to 9:00 p.m. Monday to Saturday and 10:00 a.m. to 6:00 p.m. on Sunday are typical of commercial uses in the vicinity. 7. The project qualifies as a Categorically Exempt project per Section 15301, Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA). Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and Zoning Ordinance. 2. The proposed project, as conditioned, will aid in the harmonious development of the immediate area. 3. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. The subject site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 7. There is a reasonable relationship between the use of the fees imposed upon the project and the type of development project. 8. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a Conditional Use Permit (PLN2004-12) to allow the establishment of a 2,077 square foot retail store in an existing building on property owned by Mr. Michael Cobler located at 1777 S. Bascom A venue in a P-D (Planned Development) Zoning District, subject to the following conditions: Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Conditional Use Permit Approval Expiration: The Conditional Use Permit approval shall be valid for one year from the date of final approval. Within this one-year period a building permit must be obtained and construction completed one year thereafter or the use must be established on the property (if no building permit is required). Revocation of Permit: Operation of the use in violation of the Conditional Use Permit or any standards, codes, or ordinances of the City of Campbell shall be grounds for consideration of revocation of the Conditional Use Permit by the Planning Commission. 5. Signa~e: No signage is approved as part of the development applications approved herein. No sign shall be installed until a Sign Permit is approved as specified in the Sign Ordinance. Applicant shall remove any modifications made to the existing multi-tenant freestanding sign that do not comply with the approved sign permit (SA 81-35). 6. Landscapin~: Applicant shall submit a landscape plan to address: a. Review and retrofit of the irrigation system and water management practices to ensure full coverage of landscape areas. b. Permits Required: A building permit application shall be required for the proposed tenant improvements to the existing commercial structure. The building permit shall include Electrical/PlumbinglMechanical fees when such work is part of the permit. 8. Construction Plans: The Conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 9. Size of Plans: The minimum size of construction plans submitted for building permits shall be 24 in. by 36 in. 10. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 11. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site-parking details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 12. Title 24 Energy Compliance: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Bascom Avenue, Unit C Page 2 of 3 DISCUSSION Applicant's Proposal: The applicant is requesting approyal of a Conditional Use Permit to allow the establishment of a retail store in an existing multi-tenant commercial building. The applicant would occupy 2,077 square feet or 11 % of the existing commercial building. No alteration to the exterior of the building is proposed as part of this application. Background: The subject building is currently developed with a single story multi-tenant commercial building constructed in 1979. The existing building consists of 18,596 square feet of retail and restaurant space. The proposed retail use would occupy an existing 2,077 square foot tenant space, previously occupied by a photocopy store. The project site is located on the northwest corner of Campisi Way and South Bascom Avenue and is surrounded by commercial and retail uses to the south and east, and office uses to the north and west. The project site takes access from Creekside Way, Campisi Way and South Bascom Avenue. ANAL YSIS General Plan Designation: The General Plan land use designation for the project site is Commercial/Professional Office/Residential. The proposed retail store is compatible with the land use designation of the site. Zoning Designation: The zoning designation for the project site is P-D (Planned Development). A Conditional Use Permit is required for a change of use within the P-D (Planned Development) zoning district. The proposed project will be consistent with the Zoning Ordinance with approval of a Conditional Use Permit. Use: The proposed retail store would occupy 2,077 square feet of the existing 18,596 square foot commercial building. The applicant's description indicates that the retail store would sell packaged low carbohydrate foods, diabetic friendly products and vitamin supplements. The retail store would have a total of two employees at one time. Landscaping: The landscaping was upgraded in 1990 when Erik's Deli was approved under UP 90- 11 and in 1996 when the Garrett Restaurant was approved under UP 96-11. The landscaping has significantly deteriorated since the previous approvals, and staff is recommending the submittal of a landscape plan to address the dilapidated irrigation and planting on site. Parking: Pursuant to the Campbell Parking and Loading Ordinance, one parking space is required for each 200 square feet of gross floor area for a retail use. The tenant space is 2,077 square feet and yields a parking requirement of 11 parking spaces. There are a total of 107 shared parking spaces on site. The establishment of a retail store at this location would not result in a disproportionate share of the existing parking spaces available on site. Signage: The existing multi-tenant freestanding sign is currently out of compliance with the Sign Ordinance and approved Sign Permit (SA81-35). West Valley Sanitation District Attachment 3 Castus Low Carb Superstore Overview Castus Low Carb Superstores are a specialty nutrient retail outlet for the sale of packaged low carbohydrate foods, diabetic fTiendly products and vitamen supplements. The store will offer counseling as to how to live a low carb lifestyle and explain the benefits it has on one's health. Low carbohydrate foods are recently gaining momentum in that there is scientific proof that these products help in the reduction of weight with minor modifications to your lifestyle. Low carbohydrate foods can also be used by diabetics to control their blood sugar levels. Castus's products consist of dietary nutrients and vitamins, low carb foods such as the Atkin's candy bars, cookies, breads, pastas, low-carb soft drinks and fTozen packaged ice cream. Literature on low-carb dieting will also be available for sale. There is currently no plan to sell meat products or vegetables. Everything is packaged goods. No food is prepared on-site, but boxes of goods may be opened and made available for sampling by customers. The expected average sales traffic is about 5 to 8 customers and 2 employees at one time. Parking should not be a problem since the previous tenant (Copy Connection) had an allocation of 11 parking spaces for this site. The store will be open every day, fÌ'om 9AM to 8PM on Mondays through Saturdays and lOAM to 6PM on Sundays.
