Dear Applicant:
The Planning Division has reviewed your building plan permit submittal for the construction of a single-
family addition of approximately 448 square feet located at 1097 Bent Drive. The property is presently
zoned R-I-6 and was reviewed based upon the development standards of the R-I-6 zoning district. The
proposed addition complies with the development standards. The following issues need to be addressed
prior to a clearance from the Planning Division for the issuance of a building permit:
1. Tree Protection Plan: Please provide a tree disclosure statement (enclosed) indicating that no
protected trees will be removed with the proposed addition. Protected trees include redwood, cedar,
oak or ash trees with a diameter of more than 12 inches.
Additionally, the Planning Division has been advised that a subdivision declaration exists that requires a
25 foot front yard setback. The City of Campbell does not enforce the subdivision declarations as a part
of its zoning review and clearance.

The Planning Division has received a request for a Building Permit to allow a residential addition
at the front of the residence located at 1097 Bent Drive. The subject property is located in a R-I-6
(Single-family Residential) which currently has a 15 foot front yard setback for buildings and a 25
foot front yard setback for garages.
In the updated zoning ordinance a 20 foot front yard setback is required for the building.
The proposed addition has a 21 foot front setback with a projecting bay window. The bay window
has a 2 foot depth and a 8 foot width. Consequently, the proposed addition would meet both the
current and proposed zoning requirements.
The Planning Division received a letter from Mr. George Depold, the adjacent property owner, at
1111 Bent Drive requesting that we impose a setback of 25 feet as recorded in a subdivision
declaration in 1957.
Jane Meyer Kennedy additionally had requested information regarding the setbacks and
development standards of this property.
I spoke to Bill Seligmann regarding the enforcement of the subdivision declaration. He indicated
that it would not be the responsibility of the City to enforce such a provision.
I was planning on advising the designer and the property owner that the proposed addition met our
zoning setbacks and that such a subdivision declaration existed but was not enforced by the City.
