FILE NO. PLN2003-119. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2003-119: 1. The proposed project consists of the establishment of a 1,680 square foot Tae K won Do studio in an existing 20,160 square foot industrial building. 2. The development of the proposed project will result in a use that is consistent with the General Plan land use designation of Research and Development for this area. 3. The proposed Tae Kwon Do studio is consistent with the C-M-S (Controlled Manufacturing) zoning designation for the site with approval of a Use Permit. 4. The proposed Tae Kwon Do studio, as conditioned, is compatible with the adjacent land uses and the surrounding neighborhood. 5. The existing parking will adequately meet the demands generated by the change in use, and will not be detrimental to the overall parking and circulation in the area. 6. The approved operational hours of 4 p.m. to 10 p.m. will not conflict with the industrial uses in the vicinity. 7. The project qualifies as a Categorically Exempt project per Section 15301, Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA). Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and Zoning Ordinance. 2. The proposed project, as conditioned, will aid in the harmonious development of the immediate area. 3. No substantial evidence has been presented from which a reasonable argument could be made that shows that the project, as currently presented and subject to the required Conditions of Approval, will have a significant adverse impact on the environment. The subject site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 7. There is a reasonable relationship between the use of the fees imposed upon the project and the type of development project. 8. There is a reasonable relationship and a rough proportionality between the Conditions of Approval and the impacts of the project. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves a Conditional Use Permit (PLN2003-119) to allow the establishment of a Tae Kwon Do studio in an existing 1,680 square foot tenant space of an existing industrial building on property owned by De Whitt Properties, LP, located at 1550 Dell Avenue, Unit K, subject to the following conditions: Where approval by the Director of Community Development, City Engineer, Public Works Director, City Attorney or Fire Department is required, that review shall be for compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations and accepted engineering practices for the item under review. Conditional Use Permit Approval Expiration: The Conditional Use Permit approval shall be valid for one year from the date of final approval. Within this one-year period a building permit must be obtained and construction completed one year thereafter or the use must be established on the property (if no building permit is required). Failure to meet these deadlines will result in the Conditional Use Permit being void. Revocation of Permit: Operation of the use in violation of the Conditional Use Permit or any standards, codes, or ordinances of the City of Campbell shall be grounds for consideration of revocation of the Conditional Use Permit by the Planning Commission. 5. Signs: No signage is permitted as part of the development application approved herein. New signage shall not be installed prior to approval of a sign permit as required by Chapter 21.53 of the Campbell Municipal Code. Buildine: Division: 6. Plan Preparation: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Site Plan: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. The proposed use is located in Unit K of Building #1. No alteration of the exterior of the building or the parking area is proposed as part of the application. Background: The subject building is currently developed with two single story multi-tenant industrial buildings constructed in 1976 under a Site and Architectural Permit (S 73-44). The existing buildings consist of 26,880 total square feet of industrial space. The proposed use would occupy 1,680 square feet of Building #lused as a Tae Kwon Do studio. The remaining 18,480 square feet of the building would be used as industrial and research and development space for the adjacent tenants. The project site is located on the south side of Dell A venue between Vandell Way and Division Street and is surrounded by industrial and research and development uses to the north, south, east and west. ANAL YSIS General Plan Designation: The General Plan land use designation for the project site is Research and Development. The proposed tae kwon do studio is compatible with the land use designation of the site. Zoning Designation: The zoning designation for the project site is C-M-S (Controlled Manufacturing). A Conditional Use Permit is required for the establishment of a Tae Kwon Do studio in the C-M-S zoning district. The proposed project will be consistent with the Zoning Ordinance with approval of a Conditional Use Permit. Use: The Tae Kwon Do studio would occupy 1,680 square feet of the existing 20,160 square feet of Building #1. The applicant's description indicates that the studio would have approximately 10 students and/or staff members participating in a class. Operational Hours: The applicant's description indicates that the operational hours would be 7:00 p.m. to 9:00 p.m. daily. The recommended Conditions of Approval require that the business hours not extend beyond 6:00 a.m. to 11 :00 p.m. Parking: Pursuant to the Campbell Parking and Loading Ordinance, one parking space is required for each 200 square feet of gross floor area for a retail use. The tenant space is 1,680 square feet and yields a parking requirement of 8.4 parking spaces where 108 parking spaces are provided. The increase in the parking demand in the evenings for the proposed classes will not affect the availability of parking because the parking demand for the other tenants is mostly during the day. The establishment of the Tae Kwon Do studio at this location would not have an impact on the necessary parking required for the site and, no additional parking is required for the project. Subject: Written Statement for Use Permit 1550 Dell Avenue is a concrete tilt-up, single story building with entries in the front and roll-up doors in the rear. Unit K is 1,680 Square Feet. Most ofthe units are built out with minimal office space and the remainder with open ceiling, concrete floor work space. The building has ample parking spaces for all the tenants and has good traffic flow around the perimeter. The Use Permit request is for this building located at 1550 Dell Avenue, Unit K. The use will be a Semi-private Tae Kwon Do Studio. This type of use is allowable with a Use Permit per section 21.30.030, paragraph B of City of Campbell Municipal Code. We feel the use permit should be granted because of the following reasons; 1. The hours of operation will be 7:00 P.M. - 9:00 P.M. These hours will not interfere with the other tenants in the building. In fact, because the hours of operation will be after "normal" business hours, there will be no parking or traffic flow problems for the building. The building has plenty of parking now. 2. The Studio will have approximately 10 students/staff memb.ers participating in the class. Unit K is located toward the rear of the building. This~here the majority of the parking is located. " 3. There will be no improvements done to the unit. It is currently built out in a useful, functional fashion for the studio. This use will not interfere with any of the other uses in the building or surrounding area. In fact, there are other uses similar to this in this area of Campbell. They have been in business for many years and have not interfered with their neighbors business. Because of the off hours use and low traffic it will be a good mix for the building. Subject: Written Statement for Use Permit 1550 Dell Avenue is a concrete tilt-up, single story building with entries in the front and roll-up doors in the rear. Unit K is 1,680 Square Feet. Most of the units are built out with minirnal office space and the remainder with open ceiling, concrete floor work space. The building has ample parking spaces for all the tenants and has good traffic flow around the perimeter. The Use Permit request is for this building located at 1550 Dell Avenue, Unit K. The use will be a Semi-private Tae Kwon Do Studio. This type of use is allowable with a Use Permit per section 21.30.030, paragraph B of City of Campbell Municipal Code. We feel the use permit should be granted because of the following reasons; I. The hours of operation will be 7:00 P.M. - 9:00 P.M. These hours will not interfere with the other tenants in the building. In fact, because the hours of operation will be after "normal" business hours, there will be no parking or traffic flow problems for the building. The building has plenty of parking now. 2. The Studio will have approximately 10 students/staff memb.ers participating in the class. Unit K is located toward the rear of the building. This'~here the majority of the parking is located. ,'\ 3. There will be no improvements done to the unit. It is currently built out in a useful, functional fashion for the studio. This use will not interfere with any of the other uses in the building or surrounding area. In fact, there are other uses similar to this in this area of Campbell. They have been in business for many years and have not interfered with their neighbors business. Because of the ofT hours use and low traffic it will be a good mix for the building.
