Dear Mr. Russ:
Thank you for your submittal of a Fence Exception application for a new fence located at 727 EI
Patio Drive. The Fence Exception provides for a fourteen-foot tall sound wall along the eastern
side property line where a six-foot fence is allowed.
The Community Development Director, upon recommendation from the Public Works Director,
has determined that the requested Fence Exception:
1. Will not impair vehicular or pedestrian safety;
2. Will result in a more desirable site layout from amaintenance and use standpoint;
3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of
the City; and
4. Will not be detrimental or injurious to property and improvements in the neighborhood or
to the general welfare of the City.
Therefore, your request for a Fence Exception has been approved. The Fence Exception is
granted subject to the following condition of approval:
1. The applicant shall obtain a building permit from the Campbell Building Division prior to
installation of the fence.

Subject: Fencing Exception For APN # 279-45-028
According to a study initiated by the Valley Transit Authority in January of 2002, the decibel readings for
this particular location is a very loud 76db. To mitigate the freeway noise from Highway 17, I am
requesting a fencing variance to allow for the placement of a fourteen foot high plywood sound wall.
The height and material specifications are based on the findings of MO' C Physics Applied, the firm
commissioned by the V.T.A. to do the noise impact study.
I have spoken with the California Department of Transportation (Chris Corwin 510-286-5630), the Valley
Transit Authority (Brandi Hall 408-952-4297) and the Santa Clara Valley Water District (Colleen Haggerty
408-265-2607 X 2322) regarding this situation and all have agreed that the placement of a sound wall, as
specified, would have no negative impact. As required by Ordinance 83-2, a permit application has also
been filed with the Santa Clara Valley Water District.
Essentially, the sound wall would simply replace the existing chain link fence (see photos) on the side
adjacent to the freeway and then follow the property boundaries into the utility easement. Full access to
the Santa Clara Valley Water District water pumping station would be maintained by placing the sound
wall on the south side of the existing cement retaining wall, perpendicular to current sixteen foot wide
chain link gate.
An additional 24 foot section would be placed along parcel 279-45-027, as the owners of the neighboring
rear property (Jon and Stacy Wolfe - 723 EI Patio Drive) have indicated that this will greatly help to
alleviate their own noise problems. They have been given copies of all pertinent documentation and are
in complete agreement with the proposed sound wall placement, although for personal reasons, were
reluctant to sign the enclosed Agreement Letter. Jon is willing to verbally confirm this agreement with the

feet for fences, walls, lattice, and screens when it is determined that:
1. The change would not impair pedestrian or vehicular safety;
2. Would result in a more desirable site layout;
3. Would not be detrimental to the health, safety, peace, morals, comfort or general welfare of
persons residing or working in the neighborhood ofthe change; and
4. Would not be detrimental or injurious to property and improvements in the neighborhood or
to the general welfare of the City.
Section 21.18060 of the Campbell Municipal Code requires a letter of consent from adjacent
property owners, or affected property owners directly across the public right-of-way from the
front yard and street yard fences, prior to approval of a Fence Exception. This statement must
accompany an application for a Fence Exception. Please fill-in the spaces, sign, and date the
document.

Ed,
We received an application for a fence exception at 727 E. Patio Drive. The applicant is
proposing a 14' -0" high sound wall along the eastern property line. I am referring this
application to you because there are several easements on this property and I want to make sure
the proposed sound wall will not conflict with any easements. The Santa Clara Valley Water
District and Santa Clara Valley Transportation Authority have provided written consent and have
no objections to the proposed sound wall. Please let me know if you have any questions. If you
could provide some feedback as soon as possible, it would be greatly appreciative as I am ready
to approve this application.
