Dear Applicant.
The Planning Division has reviewed the plan submittal for a new single-family home on your property at 1091
Lovell Ave. Your property is located in an R-I-6 Single Family Residential zoning district and the San Tomas
Neighborhood. A few items need to be revised on your building plans prior to issuance of building permits:
1. Side yard setback: This residential zoning district has side yard setback a minimum of 5 feet or one half the
height of the building wall adjacent to the property line. Your elevations depict an 18 foot wall height, thus
requiring a 9 foot setback. An 8 foot setback is shown along the eastern property line. Please revised the site
plan to accommodate the required setbacks.
2. On site trees: The San Tomas Neighborhood plan requires that new development provide on-site trees at a
ratio of one tree for each 2000 square feet in lot area. Please indicate the type and size of trees to remain or to
be removed as well as the replacement trees. Eight trees should be shown on the site plan to satisfy the
development standard.
3. Undergrounding Utilities: Any new utility services need to be undergrounded or a waiver to the
undergrounding requirement must be obtained. Please contact the Planning Division if you wish to pursue an
undergrounding waiver.
4. Window Size or Shapes: The proposed street elevation presents a significant wall plane facing the street. It is
recommended that you pursue a variation in window shape and size to provide a more interest façade. The use
of one larger window system at the living room or the introduction of a varied window shape at bedroom # 2
could provide visual interest. This is only a recommendation.

I have had a chance to research the other accessory structures in your neighborhood to see if they had obtained
Conditional Use Permits to have a secondary living unit. Here is a summary of the results:

The creation of a secondary living unit on your property requires a Conditional Use Permit approved by the
Planning Commission. Traditionally, as long as the architecture of the unit is acceptable and the placement of the
unit on the site conforms to the attached guidelines, secondary units have been approved. This is a process that
you will need to go through before your building permit is issued.
The Use Permit application for a secondary living unit involves a filing fee and, if approved, the payment of a
park dedication fee for a secondary unit. Additionally, the City requires a deed restriction on all secondary living
units which states that no more than one unit on the property shall be rented or leased. (The deed restriction is
filed with the County Recorder's Office after the Planning Commission approval of the second unit.)
The Planning Division fees due for a secondary living unit include:
Use Permit application fee: $1,692
Park dedication fee (secondary living unit) $5,635
(The Use Permit application fee is due at the time of filing and the park fees will be due prior to issuance of a certificate of
building occupancy.)

Please note that if you intend for this building to be used as a living unit, the building code requirements are
different than for an accessory structure that serves as a garage, storage, or workshop.
If you intend for the accessory structure to be used as a living unit, then you will need to apply for the
Conditional Use Pennit. Ifnot, then please submit the recorded deed restriction stating that the unit will not be
used as such.

Dear Mr. Fathali,
The Planning Division has reviewed your plan submittal for the relocation and addition to a detached accessory
structure on property at 1091 Lovell Ave. The plans were reviewed per the requirements of the San Tomas Area
Neighborhood Plan (ST ANP).
The creation of a secondary living unit on a property requires a Conditional Use Permit approved by the Planning
Commission and the payment of a park dedication fee of $5,635. Since you have indicated on the plans that this
detached structure will be used as a workshop and storage area, you will not need a Use Permit. However. the
City will ask you to file a deed restriction on the property to ensure that the detached structure is not utilized as a
secondary living unit (specifically, the structure cannot be used for sleeping purposes or contain any appliances
for cooking.)
Please find enclosed a draft deed restriction that should be filed with the Country Recorders Office prior to our
approval of this building permit. Please send proof of the recordation to my attention in the Community
Development Department.
