Due to the concern expressed by our neighbors and the City of Campbell we will no longer pursue this subject.

of Campbell by some of our neighbors as we like to be informed in a precise manner of their concerns and proceed

Thank you for your preliminary application for the establishment of a Large Family Daycare in
an existing single family residence located at 860 Springfield Drive. The site is located on
Springfield Drive between Darryl Drive and Marathon Drive and is surrounded by residential
uses to the north, south, east and west. The project description indicates the business would
accommodate 14 children Monday thru Friday and would include an outdoor play area in the
rear yard. The project site is located in the R-1-6 (Single Family Residential) Zoning District
and has a General Plan designation of Low Density Residential.
Your application was distributed to the Public Works Department, Building Division, Planning
Division and County Fire Department. Comments from the Building Division and the County
Fire Department are attached. Below, please find comments from the Planning Division. Please
note that these are intended as preliminary only and additional comments and requirements may
be forthcoming upon submittal of a Conditional Use Pennit application.
The proposed project would require approval of a Conditional Use Pennit by the Planning
Commission. In reviewing a Conditional Use Pennit application, planning staff and the
Planning Commission will evaluate such issues as traffic generation, noise, hours of operation,
adequacy of parking, drop-off facilities and overall compatibility of the use with adjoining
properties.
Parkinf?
Section 21.61.070.1 of the Campbell Municipal Code requires a minimum of three parking
spaces in addition to those required for a residential use. These three parking spaces shall be so
situated that they have access to a public right-of-way without passing over another parking
space. One of the proposed parking spaces does not have proper access to a public right-of-way
as it must pass over another parking space. Without modifying the driveway and curb cut, the
project site does not meet the minimum parking requirement of five on site parking spaces.

Noise
Staff is concerned about the noise impacts from the outdoor play area on adjacent residential
uses. No noise generated from the daycare use shall unreasonably offend the senses or obstruct
the free use of neighboring properties so as to unreasonably interfere with the comfortable
enjoyment of such adjoining properties. Staff has received complaints regarding the noise
generating from the existing small family daycare. Staff would not be supportive of the
proposed use as it will intensify the existing noise levels.
Traffic
Potential traffic and spillover parking may be an issue with this proposal. The City's Traffic
Engineer would require a detailed traffic analysis as part of the Conditional Use Permit
application. The analysis would identify the number of existing trips in the neighborhood to
determine if the large family daycare would generate additional daily trips that would impact
the neighborhood. The cost of the traffic analysis is approximately $100 per location and two
locations (one on each side of the residence) would need to be monitored to complete the traffic
analysis.
Neif!hborhood Compatibility
Preserving the nonnal residential surroundings and integrity of the residential neighborhood are
considered when reviewing an application for a large family daycare. After your application
was submitted, staff received a neighborhood petition with twenty-seven signatures opposing
the proposal of a large family daycare. The neighbors are particularly concerned about the
noise and traffic impacts associated with the proposed use. Based on the level of complaints on
the existing small family daycare, staff would recommend denial of the Conditional Use Pennit
to the Planning Commission for a large family daycare at this location.

Note: No building code issue has been reviewed at Development Review Committee; it will be reviewed in the
Building Permit process. Please be aware that building codes are changing constantly; plans submitted for
building permit shall comply with the code in effect at that time. Submit permit application together with
required documents to the Building Inspection Division to obtain a building permit. No construction can be
commenced without an appropriate building permit.
It is recommended that this item be forwarded to the Planning Commission for review, with the following
conditions.
TO THE SATISFACTION OF THE BUILDING DIVISION MANAGER/BUILDING OFFICIAL:
1.
PERMITS REQUIRED: A building permit application shall be required for the proposed
conversion of use from single family dwelling to large family day-care. The building pennit
shall include ElectricalJPlumbinglMechanical fees when such work is part of the pennit.
2.
CONSTRUCTION PLANS: The conditions of Approval shall be stated in full on the cover
sheet of construction plans submitted for building pennit.
3.
SIZE OF PLANS: The minimum size of construction plans submitted for building pennits shall
be 24 in. X 36 in.
4.
PLAN PREP ARA TION: This project requires plans prepared under the direction and oversight
of a California licensed Engineer or Architect. Plans submitted for building permits shall be
"wet stamped" and signed by the qualifying professional person.
5.
STRUCTURAL CONSIDERATIONS: This proposed project is subject to structural upgrades
predicated on the change in use from residential to commercial use. Project Architect/Engineer
shall verify the existing structure's ability to support commercial loading values, and where
necessary, shall call for structural improvements.

SITE PLAN: Application for building permit shall include a competent site plan that identifies
property and proposed structures with dimensions and elevations as appropriate. Site plan shall
also include site drainage details. Site address and parcel numbers shall also be clearly called
out. Site parking and path of travel to public sidewalks shall be detailed.

EXTERIOR WALL CONSTRUCTION: Project Architect/Engineer shall examine the existing
structure for locations of exterior walls in relationship to property lines. Wall construction
requirements for commercial uses are typically more restrictive that for residential uses. (Refer
to Table 5-A, of the Current Unifonn Building Code)
TITLE 24 ENERGY COMPLIANCE: California Title 24 Energy Standards Compliance fonDS
shall be blue-lined on the construction plans. Compliance with the Standards shall be
demonstrated for conditioning of the building envelope and lighting of the building.
SPECIAL INSPECTIONS: When a special inspection is required by U.B.C. Section 1701, the
architect or engineer of record shall prepare an inspection program that shall be submitted to the
Building Official for approval prior to issuance of the building permits, in accordance with
U.B.C Section 106.3.5. Please obtain City of Campbell, Special Inspection fonDS from the
Building Inspection Division Counter.

The City of Campbell, standard Santa Clara Valley Non-point Source Pollution Control Program
specification sheet shall be part of plan submittal. The specification sheet (size 24" X 36") is
available at the Building Division service counter.

TITLE 24 ACCESSIBILITY - COMMERCIAL: On site general path of travel shall comply
with the latest California Title 24 Accessibility Standards. Work shall include but not be limited
to accessibility to building entrances from parking facilities and sidewalks.

TITLE 24 ACCESSIBILITY - COMMERCIAL: Projects seeking to use the Title 24 Hardship
exemption clause shall blue-line completed, City of Campbell "20%" exemption fonD on
submitted construction plans. Fonn is available at Building Division service counter.
APPROV ALS REQUIRED: The project requires the following agency approval prior to
issuance of the building pennit:
a. West Valley Sanitation District
b. Santa Clara County Fire Department
c. Santa Clara County Department of Environmental Health
P.G.& E.: Applicant is advised to contact Pacific Gas and Electric Company as early as
possible in the approval process. Service installations, changes and/or relocations may require
substantial scheduling time and can cause significant delays in the approval process. Applicant

19, I recieved a petition with 24 signatures, opposing the large family daycare. The applicants are currently operating a small
daycare (maximum of 8 children) out of their home and the neighbors strongly oppose going to a large family daycare
(maximum of 14 children). They believe there are existing noise, traffic and quality of life issues and increasing the number

I am writing to let you know that I strongly oppose the pre-application and any subsequent
applications for a LARGE F AMIL Y Day Care Center at 860 Springfield Dr. in Campbell for the
following reasons.
NOISE: The noise level generated from this property over the past year has been unbelievably
frustrating and is affecting our quality of life. This is not normal noise generated by children
playing, but yelling, screaming, and screeching that goes on at least 5 days a week. The backyard
is L shaped with the majority ofthe play area adjacent to my fence. My kitchen and family room
windows face the fence. I have double paned windows, but the noise is so loud that we are unable
to watch TV at a normal volume, read or dine in our kitchen without this imposing noise disturbing
us. Prior to the day care, my backyard was a peaceful retreat to sit and read, enjoy my spa,
dine al fresco or to entertain, now virtually impossible to enjoy with the constant noise.
Additionally, I'm unable to open my windows for air circulation and must run the air conditioner at
an added expense. I'm retired and on a fixed income. I would like to enjoy the home I have lived in
for over 36 years, without our quality oflife being further compromised.
PERSONAL HEALTH ISSUES: I have health issues, along with my daughter who lives here
(information provided on request) and the noise does have adverse effects on our health (which can
be documented by doctors, if needed).
TRAFFIC: There has been two occasions, while pulling into our driveway, one of the day care
parents pulled out from the curb without looking and nearly hit our car. Another time, our
driveway was briefly blocked during the pick-up process. Many other neighbors have witnessed
cars consistently using several driveways as turn-around spots. If you allow them to increase the
day care to 14 children, this will only become worse.
PROPERTY VALUES: Two Realtors that have sold homes on this street have advised us that the
day care center has to be declared by law, when you sell your home. It is highly probable that the
resale value will be affected, in addition to a potential delay in how quickly the property could be
sold. This will affect all homes in the 800 block of Springfield Drive and W. Latimer Avenue. The
state prefers not to call it a commercial business, but that is exactly what it is, a very noisy
commercial business for profit. It is located in what is otherwise a very quiet residential R-l
neighborhood.
PERSONAL STATEMENT: I want you to know that my surrounding neighbors and I resent
that we have been put in this position. I do fear some retaliation. At one time we thought they were
caring for a few children, then they obtained a license to start a day care business watching 8
children, without advising neighbors as recommended by the licensing board. They now want to
increase this business to 14 children, yet have never shown common courtesy to any neighbor by
discussing this, nor have they cared how their business affects the rest of the homeowners lives by
the noise, traffic, & potential resale value. This is very difficult for me and others to understand.

Dear Ms Denis,
It has come to our attention that the residents of 860 Springfield Drive have submitted a "Pre-Application
to establish a large family daycare in their single-family residence". Our understanding of this daycare
center will allow the residents to care for up to fourteen children! This is almost double the current
approved number of up to eight children.
We are strongly opposed to this large family daycare for the following reasons:
Noise Factor: By their very nature, children create noise. They play hard, they challenge each other and
they are not always "happy". The noise generated by up to fourteen children across the fence can be
difficult to tolerate if one enjoys having the windows and doors open during lovely, warm days. To enjoy
gardening or reading a book in the garden is impossible! This is something we cherish, now that we have
reached retirement. While we do hear the children in the current daycare situation, we have chosen not to
complain, as we wish to be good neighbors. At times, it has been necessary to close the doors and windows
of our own home in order to allow our visiting grandchildren to nap in the afternoon.
Traffic and Parking: Springfield Drive is clearly an R-l residential zone, not a commercial, business
district. A "large family daycare center" for up to fourteen children would appear to be a business for profit
endeavor, not a single-family residence. The increase in traffic is unsafe and undesireable for neighbors
who have small children of their own and also appreciate a refuge from the South Bay traffic. Parents
seeking parking spaces on our street will promote congestion and unsafe conditions while numerous
children are getting in and out of cars.
Lot Size: The lot size at 850-860-870 Springfield Drive is 6Oxl00 feet. While allowing for the front yard and
the structure of the house itself, the remainder of the lot is not suitable for up to fourteen children. In addition,
a redwood fence does not buffer the sound generated by so many children on the other side. A house of
1465 square feet distributed between fourteen children and a number of adults should also be an important
factor.
Home Value: Two local realtors have confirmed that neighboring homeowners are required by law to
disclose the existence of a daycare center at the 860 residence. If this residence becomes a large family
daycare accommodating fourteen children with the resulting noise, traffic and parking concerns, it will create
an even greater risk in decreasing the sales price while increasing the length of time to sell the home.
Obviously, if a prospective homebuyer is looking at the back yard and the noise over the fence is disturbing,
the sale is lost!
Summary: Weare disappointed that the residents of 860 Springfield Drive have not discussed expanding their
daycare center with us or other homeowners in the neighborhood. This is nothing more than common
courtesy! We dislike being placed in the position in which we find ourselves, that is, defending the integrity
of our own home and that of our neighborhood. The increase in noise generated by so many children
clearly "offends the senses" and "intetferes with the comfortable enjoyment of adjoining properties". We have lived
in our home for thirty six years. Our three children grew up in and love visiting Campbell. This is not a
personal attack against children or daycare centers. It is simply an issue of the number of children in a small space!
Please consider our opposition and that of our neighbors while reaching your decision in this matter. Thank you.
