Winchester Blvd. Use Permit Request Dear Mr. Manashirov: Thank you for your re-submittal of a preliminary application for a Use Permit for the conversion of an existing Federal Express kiosk to a "walk-up" coffee kiosk at the above referenced address. The original pre-application was for a drive-through coffee kiosk and has been revised to a walk-up coffee kiosk. The pre-application was reviewed by the Planning Division, Building Division, Public Works Department, and the Santa Clara County Fire Department. In addition to the Planning Divisions comments contained in this letter, comments and preliminary conditions of approval fÌ'om the Building Division are enclosed. As proposed, staff is not supportive of the revised proposal and would recommend denial of a Use Permit for the conversion of the Federal Express kiosk to a walk-up coffee kiosk. Approval of a Use Permit at this site would necessitate some site modifications to accommodate the new use. In order for people to walk up to the coffee kiosk and purchase coffee via a service window, a new handicap accessible waiting area would need to be provided to ensure that patrons have a safe place to stand. The new waiting area would block off the northerly isle of the parking lot and necessitate the removal of at least 2 parking spaces to provide a new isle way. Please be aware that building codes are changing constantly; plans submitted for building permit shall comply with the code in effect at that time. Submit permit application together with required documents to the Building Inspection Division to obtain a building permit. No construction can be commenced without an appropriate building permit. It is recommended that this item be forwarded to the Planning Commission for review, with the following conditions. TO THE SATISFACTION OF THE BUILDING DIVISION MANAGER/BUILDING OFFICIAL: 1. PERMITS REQUIRED: A building permit application shall be required for the proposed conversion of use. CONSTRUCTION PLANS: The conditions of Approval shall be stated in full on the cover sheet of construction plans submitted for building permit. 3. SIZE OF PLANS: The minimum size of construction plans submitted for building permits shall be 24 in. X 36 in. 4. PLAN PREPARATION: This project requires plans prepared under the direction and oversight of a California licensed Engineer or Architect. Plans submitted for building permits shall be "wet stamped" and signed by the qualifying professional person. 5. SITE PLAN: Application for building permit shall include a competent site plan that identifies property and proposed structures with dimensions and elevations as appropriate. Site plan shall also include site drainage details. Site address and parcel numbers shall also be clearly called out. Site parking and path of travel to public sidewalks shall be detailed. 6. TITLE 24 ENERGY COMPLIANCE: California Title 24 Energy Standards Compliance forms shall be blue-lined on the construction plans. Compliance with the Standards shall be demonstrated for conditioning of the building envelope and lighting of the building. 7. SPECIAL INSPECTIONS: When a special inspection is required by U.B.C. It's highly unlikely people will walk up to the kiosk with the parking lot striped as it is now, Hence, traffic queues are still likely to back up into the driveway and onto West Parr Avenue. Just calling it a "walk-up" kiosk doesn't mean people will comply. 2. Without a concrete pad that is handicap-accessible, people standing in line would not be protected from moving vehicles especially in the rain or dark. Comments from the Planning Division are detailed below and comments and preliminary conditions of approval from the Public Works Department are enclosed. The Fire Department and Building Division did not have any comments at this time. The subject property is zoned C-2 (General Commercial) and is designated as Commercial on the city's General Plan Land Use Map. Section 21.24.030 (Uses Permitted with Use Permit) of the Campbell Zoning Code allows drive-up windows at restaurants, or similar facilities, after approval of a Use Pennit. The granting of a Use Pennit would require approval by the Planning Commission and would be decided upon at a Public Hearing. In order for the Planning Commission to approve the project the following findings must be made: 1. The establishment, maintenance, or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the city. 2. The proposed site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area. 3. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. Tf)[) 408.866,:2790 After reviewing the request and conducting a site inspection of the subject property, staff found that all four findings cannot be made and would recommend denial of a Use Permit for the conversion of the existing Federal Express kiosk to a drive-through coffee kiosk. Staff found that the proposed use and location of the structure is not compatible with the site. The peak hour demand that would be created by a drive-through coffee kiosk would likely generate a back up which would block the driveway that exits onto West Parr Avenue. Waiting cars would also block off the northern isle of the parking lot which would disrupt on-site circulation and necessitate the removal of at least 2 parking spaces to correct the circulation problem.
