Hamilton A venue Dear Mr. Takeuchi: As noted in our conversation on December 27, 2002, staff is unable to approve a Sign Permit for the painted wall sign on the side of the building at 295 E. Hamilton A venue because the Sign Ordinance requires wall signs to be installed on the "business frontage." The frontage is defined in Section 21.53.020 "Definitions" of the Sign Ordinance as "that portion of a building (normally where the main entrance is located) in which a business is located that faces a street, parking lot, pedestrian mall, arcade or walkway." Staff has determined that the painted wall sign is not located on the business frontage under this definition. Staff would not be supportive of an exception to the Sign Ordinance to allow the wall sign to remain. It is recommended that you submit a revised plan for a wall sign in the appropriate location. You must completely paint over the sign within two weeks, on or before Tuesday, January 21, 2003. Failure to abate this code violation will result in additional enforcement that may include fines, issuance of a citation, notice to appear and/or a recorded notice of non- compliance, which is placed on the title of the above-referenced property. Description of Violation: Wall sign with the name "Town Square Furniture" and a depiction of furniture painted on the western building wall perpendicular to East Hamilton A venue. Hamilton A venue Dear Mr. Takeuchi: I noted in my letter to you on October 1st that any new signage at 295 E. Hamilton A venue would require a sign permit. It has come to the attention of the Planning Division that a wall sign with the name "Town Square Furniture" and a depiction of fumiture has been painted on the western building wall perpendicular to East Hamilton Avenue without obtaining the required sign permit. The City's Sign Ordinance (enclosed) defines a "wall sign" as a sign that is painted on, attached to or erected against a wall of a building or structure. All new signage requires approval of a Sign Permit by the Planning Division and must comply with the requirements of the Sign Ordinance. Under the Sign Ordinance each business is permitted one wall sign and each commercial center or parcel is permitted one freestanding sign. The size of the wall sign is limited to one square foot of sign area for each linear foot of business frontage, on which the sign is proposed to be located. Although the eastern building wall measures 119' -6", the Sign Ordinance limits the maximum size of any wall sign to fifty square feet. Signs are required to be designed so as to be architecturally compatible with and suitable for the buildings with which they are associated as well as the surrounding area. Insofar as possible, freestanding signs shall be of similar design, proportion, materials and color as the associated building, so as to tie the two together. You must either paint over the sign or apply for a sign permit on or before Friday, December 20, 2002. It appears that the painted wall sign exceeds the maximum size of 50 square feet. The calculated area includes the image of the couch. In order for the sign permit to be approved, you must reduce the size of the sign to meet the maximum size of fifty square feet. Failure to abate this code violation will result in a code violation that will be referred to the City Attorney's office for review and possible legal actions, including citation.
