Dear Mr. Bowen,
The Planning Division and Public Works Engineer Division met with San Tomas Baptist
Church members at the site on June 5, 2003, to discuss the level of improvements associated
with the subdivision of this property. Based upon this visit the following item or deficiencies
were noted:
1) The parking area had been recoated with a slurry seal, however, appropriate drainage
and repair had not been provided. Additionally, the parking stalls had not been
designated. A minimum of 26 parking spaces needs to be provided with appropriate
markings.
2) The transition between the parking area and the sidewalk needs to be graded and
landscaped.
3) The transition between the. parking area and the new driveway approach is rather
abrupt. The grading and drainage plan depicts a more gradual transition or paving.
4) The reconstruction of the retaining wall along Elam A venue is not completed. Grading
has not been completed around the wall and railings have not been installed on the
stairs. Building Permits need to be issued for this on-site construction.
5) Landscaping, irrigation repair and grading of the landscaping areas has not been
completed. This includes both the park strip as well as on-site transitions to the new
sidewalk.
6) The fencing on the adjacent residential lots is open for vehicular access and is not
complete. Church members claim that it is not located on the property line.
7) Water meter relocation. It appears that the water meter for the church has been
relocated and a new connection to the church has been provided. Plumbing permits
need to be obtained from the Campbell Building Division for this work.

8) Church members indicated that the cover to the existing septic tank had been damaged
by construction equipment. The existing septic tank system needs to be serviced and
cleaned. If repair or replacement of this system is required, the connection of the
church to the new sewer lateral must be exercised and the existing septic system needs
to be abandoned and filled. Again appropriate permits need to be obtained from the
Campbell Building Division and West Valley Sanitation District.
9) Church Painting: Consistent with the letter dated April!?, 2001, the church exterior is
to be painted prior to the completion of the adjacent homes.
10) Generally, the area to the south of the church was littered with debris and weeds. This
area should be graded and cleaned up.

1. Landscape Plan: Projects in the San Tomas Neighborhood are required to provide new trees at a ratio
of one tree for each 2000 square feet in lot area. Please provide a revised landscaping plan illustrating
the installation of a minimum of four 15 gallon trees that will provide privacy to adjacent lots. It is
recommended that evergreen trees such as redwoods be used.
2. Decorative Pavement Treatment: Staff recommends that a decorative pavement treatment be used on
the driveway areas to reduce the expansive appearance of the concrete. Please provide a revised plot
plan illustrating a decorative driveway with the introduction of smooth banding as well as
textured/colored concrete.
3. Architecture: Staff finds that the proportion of the window opening to the dormer size is awkward
over the garage. Please reduce the size of the window relative to the dormer size.
Please be advised that at the time of building final, a park impact fee of $2,747.50 will need to be paid.
Additionally, please submit revised plans addressing the three items above.

The Planning staff has had an opportunity to review the elevations dated January 18, 2001 for the two
new residences proposed on Elam Avenue. The proposed residences comply with the development
standards for setbacks, lot coverage and floor area ratios. The following comments are offered
1. One plan indicates a shingle siding and the other indicates a horizontal board siding. Do these
materials apply to all four elevations and all wall areas? Is there a dimension and style description
of the board siding. It may be helpful to illustrate the siding pattern on the elevations.
2. Please provide color samples for the roof, walls and trim.
3. Please provide a landscaping plan for front yard areas. The San Tomas Neighborhood Plan
requires the installation of one on-site tree for each 2000 square feet in lot area. Pavement
improvements should also be shown on the landscape plan. Additionally, provide protection
details for retained mature trees.
4. Please provide a fencing plan indicating the location and details of fencing. Height, materials, and
design should be illustrated.
5. A decorative pavement treatment in the driveway area is recommended and
6. The conditions of approval required a separated sidewalk with a planting strip and street trees.
Please reflect this condition on the site plans.

Hi Tim,
From an architectural design standpoint, these homes are well done.
My only concern is that there are a few custom items shown that
typically
would be changed in a speculative home. The architect shows a round top
entry door on Lot 3, and custom 3 fold garage doors on all Lots.
Please
ascertain that these items will be included in the final construction
and not
substituted for flimsier units later on.. .they really make the houses
unique.
Production units would spoil the design sigificantly.

After notification and public hearing, as specified by law, and after presentation by the
Community Development Staff, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as follows with
respect to applicationPLN2000-84 (TS):
1.
The proposed density of 5.1 units per gross acre is consistent with the allowable
density permitted under the General Plan.
2.
The proposed map is consistent with the development standards (including lot size
and minimum lot dimension) of the R-I-6 Zoning District and the San Tomas Area
Neighborhood Plan (STANP) and the P-F{public Facilities) Zoning District.
3.

The proposed subdivision layout allows for access to sunlight.
Each new parcel created has access to a public right-of-way.
5.
An initial study was prepared for this project and no significant environmental
impacts were found.
Based on the foregoing findings of fact, the City Council further finds and concludes that,
subject to the imposed conditions:
1.
The proposed subdivision is consistent with the requested General Plan Amendment.
2.
The proposed subdivision does not impair the balance between the housing needs of
the region and the public service needs of the residents and available fiscal and
environmental resources.
3.
The site is physically suitable for the proposed density and type of development.
4.
The design of the subdivision provides, to the extent feasible, for future passive or
natural heating or cooling opportunities.

No substantial evidence has been presented which shows that the project, as-.

following conditions in accordance with the Ordinances .)f the City of Campbell and the State of

COMMUNITY DEVELOPMENT DEPARTMENT

Tentative Map Approval: Tentative Map approval is not effective until the
effective date of the general plan amendment and zone change. Map approval is

a registered civil engineer/land surveyor, as necessary, for the City's review and
recordation.

Easements: Prior to recordation of the Final Map, the applicant shall cause
Easements to be recorded for private utilities, private storm drains, reciprocal
ingress and egress, etc., as needed.

Monumentation for Final Map: Prior to recordation of the Final Map, the
applicant shall provide security guaranteeing the cost of setting all Monuments
shown on the map, as determined by the City Engineer.

Utilities: All new on-site Utilities shall be installed underground per Section
20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or
additions. Applicant shall comply with all plan submittals, permitting and fee
requirements of the serving utility companies.

Utility Installation Plan: Prior to issuance of building permits for the site, the
applicant shall submit a Utility Installation Coordination Plan and Schedule for
approval by the City Engineer for installation of street improvements and/or
abandonment of all utilities. Streets which have been resurfaced within the
previous five (5) years will require boring and jacking for all new utility
installations. Applicant shall also prepare pavement restoration plans for approval
by the City Engineer prior to any utility installation or abandonment.

Grading and Drainage Plan: Prior to issuance of any grading or building permits
for the site, the applicant shall conduct hydrology studies based on a 10 year storm
frequency, prepare an engineered Grading and Drainage Plan, and pay fees
required to obtain necessary grading permits. The plans shall comply with the
1998 edition of the California Business Code including Chapters 10, 11, 18, 33
and Appendix Chapter 33.
Storm Drain Area Fee: Prior to recordation of the Final Map, the applicant shall

RECOMMENDATION
The Planning Commission recommends that the City Council take the following
actions:
1. Grant a Negative Declaration for the proposed project; and
2. Introduce the attached ordinance approving a General Plan Amendment (PLN
2000- 74) of the property from Public/Semi-Public to Low Density Residential;
and
3. Introduce the attached ordinance approving a Zone Change (PLN 2000-75) from
P-F(Public Facilities) to R-1-6(Single Family Residential); and
4. Adopt a resolution, incorporating the attached findings, approving the subject
Tentative Subdivision Map(PLN 2000-84), subject to the conditions of approval.
ENVIRONMENTAL DETERMINATION
The City prepared an Initial Study for this project and it was determined that no
significant environmental impacts would be created as a result of the project. Based
upon the information provided in the Initial Study, the Planning Commission
recommends that the City Council grant a Negative Declaration for this project.
BACKGROUND
On May 2, 2000, the City Council authorized the applicant to proceed with a General
Plan Amendment on the project site. The applicant requested authorization to
proceed with the approval of a General Plan Amendment from a Public/Semi-Public
land use to Low Density Residential for the easterly portion of the existing church
site. The project site is located on the southeast corner of Harriet and Elam Avenues
and is currently developed with a church and its associated parking area.
ANALYSIS
General Plan Amendment: The General Plan designation for the site is currently

Public/Semi-Public. The General Plan Amendment is requested to change the land
use to Low Density Residential (less than six units per gross acre) for the easterly
half of the site. The Planning Commission found that the requested general plan
change establishes a desirable land use pattern and is consistent with the surrounding
residential densities.
Zone Change: The subject property is currently zoned P-F (Public Facilities). The
applicant has requested approval of a zone change to R-1-6 (Single family
residential) zoning district so that the zoning district is consistent with the requested
General Plan land use. The requesting zoning district is consistent with all
surrounding residential properties.
Tentative Subdivision Map: A five-lot tentative subdivision map is proposed. One
larger parcel is retained at the comer of Harriet and Elam Avenues to accommodate
the church, parking area and landscaping. The remaining portion of the site is
proposed as four single family lots, two of which are flag lots. All of the proposed
residential lots would take access from the Elam Avenue frontage. The proposed lots
satisfy the area and design requirements of the R-1-6 and P-F zoning districts and the
standards of the San Tomas Neighborhood Guidelines.
Planning Commission Action: At its meeting of September 12, 2000, the Planning
Commission took the following actions:
1) Recommended that the City Council Grant a Negative Declaration for this
project;
2) Adopted Resolution No. 3295 recommending approval of a general plan
amendment from Public/Semi-Public to Low Density Residential;
3) Adopted Resolution No. 3296 recommending approval of a zone change from P-

DISCUSSION
Applicant's Proposal: The applicant is seeking approval of a General Plan Amendment, a
Zone Change, and a Tentative Subdivision Map to create four (4) single-family lots and a
remainder lot for an existing church on property located at the southwest comer of
Harriet and Elam Avenues. The project site is currently developed with a church building
and parking area that occupies the westerly portion of the property.
Background: The City Council at its meeting of May 2, 2000, authorized the applicant to
proceed with a general plan amendment on the easterly portion of this site from the
present Public, Semi-Public Land Use to Low Density Residential (less than six units per
gross acre. The applicant at this time is advancing with this request as well as a Zone
Change and Tentative Subdivision Map. The existing church and its associated parking
would remain on the westerly portion of the site.

ANALYSIS
GENERAL PLAN AMENDMENT
The applicant is requesting that the Land Use Element General Plan be changed on the
easterly .78 acre portion of the site from Public, Semi-Public to Low Density Residential
(less than 6 units per gross acre). The requested land use change would establish a land
use designation that is consistent with land use of surrounding properties to the north,
south and east of the project site. The requested amendment is also consistent with the
San Tomas Neighborhood Plan that states that the proposed amendment should be at least
equal to the predominate general plan and zoning designation of parcels contiguous to or
direct across a public right-of-way from the subject site.
ZONE CHANGE
The applicant additional is requesting that the current P-F(Public Facilities) zoning be
changed to R-1-6(Single Family Residential) so that it is consistent with the requested
General Plan Amendment. This zone change would allow a zoning district that is the
same as surrounding residential properties.
SUBDIVISION
The proposed map divides the property into five individual lots. One larger parcel is
retained at the comer of Harriet and Elam Avenues and accommodates the church
building, landscaping and the parking area. This portion of the property would retain the
Public Facilities Zoning District. The resulting lot allows sufficient space for landscaping
and 26 parking spaces. The current seating arrangement of the church creates a parking
demand of 23 parking spaces.
The four residential lots are located on Elam Avenue, two of which are flag lots. The
flag lots are situated at the southwest comer of the site, each having their own fifteen-foot
minimum access to Elam Avenue.
All of the proposed lots satisfy the lot size and width standards of the R-1-6 and the P-F
(Public Facilities) Zoning Districts.
Street Design and Improvements: The subject property is located in the San Tomas Area
and is subject to the standards of the San Tomas Area Neighborhood Plan (STANP).
The applicant is required to construct standard street improvements as required by the
San Tomas neighborhood Plan along the street frontages of the project. These
improvements include curb, gutters and sidewalks on both Harriet and Elam Avenues.
Site and Architectural Approval: The design of the proposed new single family homes are
considered administratively by the Community Development Director in requested R-1-6
Zoning District, consequently architectural plans will not be considered by the Planning
Commission. Additionally, a condition of approval requires that the church property to
submit a plans for the Community Development Director's approval addressing parking

COMMUNITY DEVELOPMENT DEPARTMENT
1.
Project Approval: Approval is hereby granted for a 5 lot subdivision. Map
approval shall substantially comply with the Tentative Map, prepared by Brian
Kangas Foulk, dated 8-16-00.

Tentative Map Approval: Tentative Map approval is not effective until the
effective date of the general plan amendment and zone change. Map approval is
valid for 2 years from effective dated, unless a subsequent extension is granted.
3.
Church Improvements: Prior to recordation of the final map, the applicant/property
owner shall submit plans for improvement of the church site including the
following:
. Repainting the church
. Repairing and resurfacing the parking area and
. Repairing and refurbishing landscaping and irrigation systems associated
with the church site.

Tentative Map: The applicant shall complete the Tentative Map along the
frontages of Lot 5 in the same manner it has been completed for Lots, 2, 3 and 4,
prior to further processing.

Final Map: Prior to issuance of any grading or building permits for the project, the
applicant shall submit a Final Map for review by the City and recordation, upon
approval by the City Council. The current plan check fee is $1,450 plus $25 per
lot.

Preliminary Title Report: Prior to issuance of any grading or building pennits for
the site, the applicant shall provide a current Preliminary Title Report.

Proof of Ownership: Prior to issuance of any grading, drainage or building permits
for the site, the applicant shall provide a current grant deed.
Right-of-Way for Public Street Purposes: Prior to recordation of the Final Map,
the applicant shall grant additional Right-of-Way for Public Street Purposes along
the Harriet Avenue frontage to accommodate a forty-five foot half street right-of-
way. The applicant shall cause all documents to be prepared by a registered civil
engineer/land surveyor, as necessary, for the City's review and recordation.
9.
Public Service Easement: Prior to recordation of the Final Map, the applicant shall
grant a 10- foot Public Service Easement on private property contiguous with the
public right-of-way along the Elam Avenue frontage in accordance with utility
company requirements. The applicant shall cause all documents to be prepared by
a registered civil engineer/land surveyor, as necessary, for the City's review and
recordation.
10.
Easements: Prior to recordation of the Final Map, the applicant shall cause
Easements to be recorded for private utilities, private storm drains, reciprocal
ingress and egress, etc., as needed.
11.
Monumentation for Final Map: Prior to recordation of the Final Map, the
applicant shall provide security guaranteeing the cost of setting all Monuments
shown on the map, as determined by the City Engineer.
12.
Street Improvements: Prior to issuance of any grading permits, building permits or
recordation of the Final Map, the applicant shall execute a street improvement
agreement and shall cause plans for public Street Improvements to be prepared by
a registered civil engineer, pay fees, post security and provide insurance necessary
to obtain an encroachment permit for construction of the public improvements, as
required by the City Engineer. The plans shall include the following:

. Construct new curb and gutter at 35 from the centerline, detached sidewalk and
ADA compliant pedestrian ramp.
. Reconstruct pavement to centerline unless otherwise approved by the City
Engineer.
. Install street light(s) in accordance with the City street lighting policy.
. Construct tree wells, street trees and irrigation system at 40 feet on center.
. Install and relocate traffic control signs, stripes and related improvements.
. Relocate utilities as necessary.
. Construct conforms to existing public and private improvements.

. The existing driveway approach serving the church parking lot shall be
modified to comply with ADA requirements.
. Reconstruct pavement to centerline or install asphaltic concrete overlay, as
determined by the City Engineer.
. Install street light(s) in accordance with the City street lighting policy.
. Construct tree wells, street trees and irrigation system at 40 feet on center.
. Install and relocate traffic control signs, stripes and related improvements.
. Relocate utilities as necessary.
. Construct conforms to existing public and private improvements.

Water Meter(s) and Sewer Cleanout(s): Existing and proposed Water Meter(s) and
Sewer Cleanout(s) shall be installed on private property behind the public right-of-
way line.
14.
Soils Report: Prior to issuance of any grading or building permits for the site,
applicant shall provide a Soils Report prepared by a registered geotechnical or
civil engineer.
15.
Utilities: All new on-site Utilities shall be installed underground per Section
20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or
additions. Applicant shall comply with all plan submittals, permitting and fee
requirements of the serving utility companies.
16.
Utility Installation Plan: Prior to issuance of building permits for the site, the
applicant shall submit a Utility Installation Coordination Plan and Schedule for
approval by the City Engineer for installation of street improvements and/or
abandonment of all utilities. Streets which have been resurfaced within the
previous five (5) years will require boring and jacking for all new utility
installations. Applicant shall also prepare pavement restoration plans for approval
by the City Engineer prior to any utility installation or abandonment.
17.
Grading and Drainage Plan: Prior to issuance of any grading or building permits
for the site, the applicant shall conduct hydrology studies based on a 10 year storm
frequency, prepare an engineered Grading and Drainage Plan, and pay fees
required to obtain necessary grading permits. The plans shall comply with the
1998 edition of the California Business Code including Chapters 10, 11, 18, 33
and Appendix Chapter 33.
18.
Storm Drain Area Fee: Prior to recordation of the Final Map, the applicant shall
pay the required Storm Drain Area fee which is $2,000 per acre.

19.
Storm Water Pollution Measures: Prior to issuance of any grading or building
permits, the applicant shall comply with the National Pollution Discharge
Elimination System (NPDES) permitting requirements and the California Storm
Water Best Management Practices handbook prepared by the Storm Water Quality
Task Force, Santa Clara Valley Water District and the City of Campbell Municipal
Code regarding Storm Water Pollution Prevention.
FIRE DEPARTMENT REQUIREMENTS
20.
Review of Site Access and Water Supply: Review of this Development proposal is
limited to acceptability of site access and water supply as they pertain to fire
department operations, and shall not be construed as a substitute for formal plan
review to determine compliance with adopted model codes. Prior to performing
any work, the applicant shall make application to, and receive from, the Building
Department all applicable construction permits.
21.
Required Access to Water Supply (Hydrants): Portions of the structure(s) are
greater than 150 feet of travel distance from the centerline of the roadway
containing public fire hydrants. Provide an on-site fire hydrant OR provide an
approved fire sprinkler system throughout all portions of the building (note Lots 3
and 4).

Project Description:

The site plan consists of a church and parking area along the Harriet Avenue frontage and a vacant

The proposed project is requesting approval of a general plan change, a zone change and a
subdivision map to allow a four lot residential subdivision on the easterly half of the existing site.
Environmental Setting:
The subject property is located on the south side of Elam Avenue at its intersection with Harriet
Avenue. The site is located within an P-F (Public Facilities) zoning district and is currently
improved with a church building and parking area on the westerly portion of the site. The site is
surrounded by single-family residential uses to the north, south, east and west.

Notice is hereby given that the Planning Commission of the City of Campbell has set the time of
7:30 p.m., or shortly thereafter, on Tuesday, September 12, 2000, in the City Hall Council
Chambers, 70 North First Street, Campbell, California, for a Public Hearing to consider the
application of Mr. Bruce Bowen, on behalf of B&C Homes, for approval of a General Plan
Amendment (PLN2000- 74) to change the Land Use Designation from Public/Semi Public to

requested. The church floor plan was taken from field measurement. Unfortunately, Chris
Spaulding (the architect) was on vacation and although he has returned, he cannot get to the
building for another two weeks. As you know, we're anxious to get this subdivision
completed. I've done a quick calculation of the parking requirement:

BACKGROUND
The applicant, Mr. Bruce Bowen has an agreement with San Tomas Baptist Church to purchase the
easterly unimproved portion of the church site at the southeast comer of Harriet and Elam Avenues
and would like to construct single-family homes. The site is designated as Public/Semi-Public Land
Use on the General Plan and is zoned P-F (public Facilities). This designation and zoning allows the
operation of a church and other public facilities, generally upon approval of a Conditional Use Permit
by the Planning Commission, but does not allow residential uses.
Applicant's Proposal
The applicant is requesting authorization to proceed with an application for a General Plan
Amendment/Zone Change to allow the consideration of 3 or 4 single-family lots on the easterly
portion of the site that comprises approximately two thirds of an acre. Associated applications
include: a Zoning Map Amendment; a Residential Subdivision and Site and Architectural Permit
approval.
The General Plan Amendment would separate .6 acres from the 1.3 acre site, leaving. 7 acres for the
church building and parking lot.
Surrounding Uses:
The subject site is located in the San Tomas Area Neighborhood Plan area at the southeast comer of
San Tomas Aquino Road and Elam Avenue. Adjacent land uses are described below:

The separation of the rear unpaved parking area from the church site has been analyzed for its impact
on the required development standards for the church. The table below illustrates that the proposed
remaining church site will comply with ordinance requirements after the subdivision.

General Plan-Strategic Plan Consistency
The Public Facilities designation specifically allows the operation of the Church in this residential
area. The amendment of the General Plan Land Use Map from Public, Semi-Public to Low Density
Residential is appropriate since the church has declared the project site area as surplus and that the
surrounding land uses are consistent with the requested low density residential use. The applicant's
proposal is consistent with the policies of the San Tomas Area Neighborhood
General Plan Update Process
The City is currently preparing an update to the General Plan that will include a reassessment of land
use designations in areas where existing land use designations do not reflect current Land Use
policies and Strategic Plan goals.
Staff believes that the request to remove the subject site from Public Facilities designation prior to the
completion of the update process is appropriate since it is not anticipated that another public or quasi-
public use would be appropriate for the site due to increased parking demands and associated
increased noise issues.
FISCAL IMPACTS
Currently the Church does not pay property tax for this land. If the General Plan Amendment, Zone
Change and associated development are approved, the newly-developed single-family homes will
generate property taxes. While the services demanded by single-family homes are typically higher
than other land use categories, the tax generated is anticipated to cover the expenses generated.

like to provide additional information concerning the size of the facilities and
congregation. The assembly hall measures approximately 30'x 40' and totals
approximately 1,440 square feet. There are seats for 89 people, although there
are only 20 people in the congregation currently. The rear parking area can hold
26 cars as illustrated in the enclosed drawing. We feel that adequate parking for
the church can easily be provided on the property without the easterly unused
portion of land.
