A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE ISSUANCE OF A MULTI -YEAR
DOWNTOWN SPECIAL EVENT PERMIT FOR THE
CAMPBELL CHAMBER OF COMMERCE'S OKTOBERFEST
WHEREAS, in July 2025, the Campbell Chamber of Commerce (Chamber) applied
to the City of Campbell (City) for a Downtown Special Event Permit (Permit) that
would allow the Chamber to hold its Oktoberfest 2025 in Downtown Campbell from
Saturday, October 18, 2025, through Sunday, October 19, 2025; and
WHEREAS, the City's Downtown Special Event Policy (Policy) provides general
guidelines, as follows:
• The Special Event will not disrupt, to an unreasonable extent, the movement
of traffic_ or create any safety hazard as a result of such other traffic being
stopped or diverted;
• Sufficient Police service can be provided to assure proper traffic control,
security, and the orderly conduct of the special event;
• The streets and roads over which the Special Event will be conducted are
sufficient size and construction to safely accommodate the number of
participants and the size, height and weight of any vehicles or equipment
participating in the event;
• The Special Event will not interfere with any other public events to be
conducted on the same day;
• The Special Event is not likely to cause injury to persons or property or
create an unreasonable disturbance of the peace; and
• The cumulative impact of this Special Event will not create an undue strain
on public resources; and
WHEREAS, the Chamber has successfully held its Oktoberfest event in Downtown
Campbell for the past 29 years, and this event is a popular, family -oriented festival
that offers German food, music, arts and crafts, a kid zone, and beer and wine;
and
WHEREAS, through its work with City staff, the Chamber has been able to ensure
that its Oktoberfest is held in a suitable location; does not severely disrupt normal
business or residential traffic; operates in a manner that avoids health and safety
hazards; and includes sufficient Police Department sworn personnel to provide
proper traffic control and security, and to ensure the orderly conduct of organizers
and visitors alike; and
WHEREAS, the City Council has determined that based on the information the
Chamber has provided, the Chamber's Oktoberfest event meets all the
requirements to support the issuance of a Permit for Oktoberfest 2025; and
WHEREAS, each year the Chamber applies to the City for a Permit to hold
Oktoberfest with similar, if not the same footprint, activities, event hours, and
security; and, each year staff from the City Manager's Office, the Police
Department, Public Works, County Fire, and the local Alcoholic Beverage Control
office meet with the Chamber to discuss the proposed event activities; and
WHEREAS, once these meetings have occurred to the satisfaction of all City
departments, staff has historically supported the requests for a Permit; and
WHEREAS, to save the Chamber, the City Council, and the City staff time, staff
recommends the City Council approve the issuance of a 3-year Permit to the
Chamber for its Oktoberfest event subject to the Chamber's annual application for
a Permit for each event, the City Manager's and Chief of Police's annual review
and approval of the Chamber's application for each event, the Chamber's full
compliance with the Policy and any additional conditions set forth by the City
related to the event, and the Chamber's payment of any Permit fees due for each
event;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby authorize the issuance of a 3-year Downtown Special Event
Permit (Permit) to the Chamber for its Oktoberfest event, as follows:
The City Council approves the issuance of a Permit to the Chamber for its
2025 Oktoberfest, subject to the Chamber's acceptance of such conditions
that the City Manager and Chief of Police determine to be reasonably
necessary to:
o Ensure compliance with all provisions of the City's Downtown Special
Event Policy (Policy);
o Prevent any unreasonable disruption to the movement of traffic in the
vicinity of the event;
o Prevent any safety hazard as a result of traffic being stopped or diverted
for the event;
o Ensure that sufficient services can be provided to assure proper traffic
control and the orderly conduct of the event;
o Ensure that the streets on which the event is being conducted can
safely accommodate the number of anticipated participants;
o Avoid any interference with any other events;
o Prevent injury to persons or property or the creation of an
unreasonable disturbance of the peace; and
o Prevent an undue strain on public resources; and
The City Council approves the issuance of a Permit to the Chamber for its
2026 and 2027 Oktoberfest events, subject to:
o The Chamber's timely submission of a complete application for a Permit for
each event;
o The City Manager's and Chief of Police's approval of the application for
these events as complying with Chapter 5.50 of the Campbell Municipal
Code and the City's Policy;
o The Chamber's full compliance with the Policy;
o The Chamber's payment of any Permit fees due for each event; and
o The Chamber's acceptance of the City Manager's and Chief of Police's
Permit conditions for each event, as determined to be reasonably
necessary to satisfy the criteria set forth above for the 2025 event.
