DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Modification of a previously
approved Conditional Use Permit to allow the enclosure of an existing 748 square foot loading dock
area and a 336 square foot addition to an existing building for a total increase of 1,104 square feet.
In addition to providing new classroom space, this space would also consist of a new restroom,
reconfigured entry porch/foyer and drinking fountains. The interior of the building will have some
wall reconfiguration changes to create an office/copy area and reconfigured hallway/alcove and the
inclusion of an above-ceiling document storage space, which is accessible by an attic ladder. There
are no proposed architectural modifications to the exterior elevations with the exception of the small
addition to the rear of the site.
Background: The Planning Commissions adopted Resolution No. 3218 approving a Use Permit (UP
98-15) with a Condition of Approval limiting the school to 90 students for the first year. This matter
was appealed to the City Council, wherein the City Council on March 16, 1999, approved the
applicant's original request to allow a maximum of 120 students. The applicant is requesting
approval of a modification to this approval to allow an addition at the rear of the existing building.
There is no proposed increase in staff or the permitted 120 student limitation.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site was
Public/Semi-public when the previous use permit was approved. With the adoption of the update of
the General Plan in 2002 the designation was changed from Public/Semi-Public to Medium Density
Residential. The proposed addition is considered minor is compatible with the land use designation
of the site.
Zoning Designation: The zoning classification for the project site is R-2-S (Multiple Family
Residential). The site was previously zoned P-F (Public Facilities). The use remains an allowed use
under the R-2-S zoning with the issuance of a Conditional Use Permit.
Use: With the proposed addition an additional 20 additional students beyond the current student
may be allowed, however the total student census will not increase beyond that permitted by the
original use permit. Staff does not have record of any complaints since the approval of the school in
1999.
Landscaping: No changes are proposed.
Parking: No changes to the parking or circulation are proposed.
Operational Hours: The applicant's description indicates that the operational hours will be Monday
through Saturday, from 9:00 a.m. to 8:00 p.m. and Sunday from 10:00 a.m. to 6:00 p.m. The
recommended Conditions of Approval require that the business hours not extend beyond 6:00 a. m.
to 11 :00 p.m. daily.

RE: Proposed work at 90 E. Latimer Ave.
SCOPE OF WORK:
The proposed project at Casa di Mir Montessori Elementary School at the above
address consists of enclosing and existing loading dock of approximately 748 sf
and slightly expanding this area by 336 sf (total approximately 1104 sf) for use
as additional classroom space.
The existing school is ready for expansion within
the quota established by the Conditional Use Permit in 1999 and existing staff will
be sufficient to staff the propcsed new classroom. No change in parking is proposed.
Additionally, this new classroom will include a new children's restroom, reconfigured
entry porch/foyer and drinking fountains. Inside the building, modifications to

a new hallway/alcove is configured at the rear of the multipurpose room which will
provide circulation and exiting, and will have document storage above the ceiling
accessible by attic ladder. With regard to neighborhood impact, it is anticipated
there may be approximately 15 additional vehicles per day to serve an increase of

RESOLUTION NO. 3218
BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT (UP
98-15) TO ALLOW THE ESTABLISHMENT OF A PRN ATE SCHOOL ON
PROPERTY LOCATED AT 90 E. LATIMER AVENUE IN A PF (PUBLIC
FACILITIES) ZONING DISTRICT. APPLICATION OF CASA DI MIR
MONTESSORI ELEMENTARY SCHOOL. FILE NO. UP 98-15.
After notification and public hearing, as specified by law, and after presentation by the Community
Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows with
respect to application UP 98-15:
1.
The project site is located on property with a Public Facilities zoning designation and a
Public, Semi-Public General Plan designation.
2.
The proposed private school for children in Pre-Kindergarten, Kindergarten, and Grades 1-6
is a semi-public use permitted in the P-F (Public Facilities) zoning district with approval of a
Use Permit.
3.
During the first full school year of operation, the school is limited to a maximum enrollment
of 90 students; at the end of the first full school year of operation, the Planning Commission
may conduct a review of the Use Permit and increase the maximum enrollment up to a total
of 120 students.
4.
The hours of operation for office use are limited to the hours of 6 a.m. to 10 p.m., Monday
through Friday; the hours of operation for maintenance activities are limited to 8 a.m. to 8
p.m., and the hours of operation for school instruction, including before and after school
care, are 7:00 a.m. to 7:00 p.m., Monday through Friday.
5.
The school will occasionally occupy the site during evening and weekend daytime hours for
special events (i.e. school performances, Open House, science fair, clean up days, etc.) and
for parent/teacher and board meetings.
6.
The proposed additional landscaping will provide additional screening and a buffer between
the areas of the parking lot to be used for playground uses and the adjacent residential
properties.
7.
The proposed number of parking spaces will adequately serve the teachers and employees on
site during school instruction hours of operations; for occasional evening and weekend
events which require more parking than can be accommodated on site, the school will make
arrangements to provide additional off-site parking accommodations and will shall provide
shuttle service or other transportation to the facility.
. Planning Commission Resolution No. 3218
UP 98-15 - 90 E. Latimer Avenue - Casa di Mir Montessori Elementary School
Page 2
8.
The proposed school is anticipated to create some measure of noise audible from the
adjacent residential properties; however, the school will operate in a manner that will not
unreasonably disturb adjacent residents.
9.
The proposed on-site circulation plan is adequate to ensure that a safe and efficient student
drop-off and pick-up system will be implemented with the presence of an adult on-site
parking monitor to guide parents where to park and to keep cars moving efficiently.
10.
The project, as conditioned, is compatible with the surrounding residential neighborhood
and uses.
Based upon the foregoing findings of fact, the Planning Commission concludes that:
1.
The proposed use is consistent with the General Plan and Zoning Ordinance.
2.
The establishment, maintenance, or operation of the use will not be detrimental to the public
health, safety, peace, morals, comfort or general welfare of persons residing or working in the
neighborhood of the proposed use, or be detrimental to property and improvements in the
neighborhood or to the general welfare of the City.
3.
The proposed site is adequate in size and shape to accommodate the proposed private school
in order to integrate the use with uses in the surrounding neighborhood.
4.
The site, as conditioned, is adequately served by streets of sufficient capacity to carry the kind
and quantity of traffic such use would generate, with the adherence to the proposed on-site
circulation plan.
The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinance of the City of Campbell and the State of
California. Additionally, the applicant is hereby notified that he/she is required to comply with all

Proposal
The applicant is requesting approval of a Modification of a previously approved Conditional Use
Permit to allow the enclosure of an existing 748 square foot loading dock area with a 336 square
foot addition for a total increase of 1,104 square feet. In addition to providing new classroom

drinking fountains. The interior of the building will have some wall reconfiguration to create an
office/copy area and reconfigured hallway/alcove and the inclusion of an above-ceiling
document storage space, which is accessible by an attic ladder. There are no proposed
architectural modifications to the exterior elevations with the exception of the small addition to
the rear of the site.
The original Use Permit allowed for 90 students during the first year. A Condition of Approval
was included in Resolution No. 3218 to allow enrollment to increase to a maximum of 120

Re:
Modification of Use Permit
90 East Latimer A venue
Dear Mr. Gamble:
The Planning Di vision has reviewed your preliminary proposal for enclosure of the rear loading area of
approximately 1,100 square feet at Casa di Mir Montessori Elementary School. The school was established
at this location via a Conditional Use Permit (UP 98-15) in January 1999. The proposed modifications
would require approval of a modification to this prior approval. An application has been enclosed for your
consideration.
The establishment of the school at this location stimulated a significant participation by neighboring
property owners in the public hearing process. Please be prepared to address any unresolved issues of
traffic or noise that may arise with the introduction of these modifications.
Please do not hesitate to contact me at (408) 866-2144 or via email at timh@citvofcampbell.com to
schedule a meeting to discuss these comments or the application process.
