A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL TO
ACCEPT THE IMPROVEMENTS FOR THE JOHN D. MORGAN PARKING LOT
IMPROVEMENTS PROJECT NO. 23-DD AND DIRECT THE CITY ENGINEER TO
FILE THE NOTICE OF COMPLETION
WHEREAS, the City Council adopted Resolution No. 13212 approving the plans and
specifications, and authorizing the advertisement of bids for the John D. Morgan Parking
Lot Improvements Project No. 23-DD; and
WHEREAS, on November 4, 2024, the City received and opened two bid proposals from
Silicon Valley Paving, Inc. of San Jose and QA Constructors, Inc. of San Francisco with
base bid amounts of $156,800 and $246,292, respectively; and
WHEREAS, the low bid amount of $156,800 was $600 over the authorized construction
contract amount of $156,200; and
WHEREAS, on November 19, 2024, the City Council adopted Resolution No. 13229
authorizing an increased amount in the construction contract to Silicon Valley Paving,
Inc.; and
WHEREAS, the City awarded the project to Silicon Valley Paving, Inc. with construction
contract fully executed on December 12, 2024; and
WHEREAS, construction activities began on March 10, 2025; and
WHEREAS, the Project performed asphalt pavement dig outs to replace damaged
pavement and installed surface sealant, installed split -rail fence between the parking lot
and the existing pedestrian pathway, installed two (2) new collapsible bollards at the
entrance of the emergency pathway access point, and reconfigured the parking spaces
to a total of, seventy-two (72) parking spaces, three (3) of which are ADA compliant
spaces, and replaced the timber berms surrounding the tree planter boxes; and
WHEREAS, on April 17, 2025, the Project was completed in accordance with the
approved plans and specifications, and final job inspections were conducted by the City
Inspector and Engineer; and
WHEREAS, the City is withholding $8,600 in retention to ensure work is completed to
required standards; and
WHEREAS, on September 2, 2025, a Notice of Withholding of Contract Payments was
sent in accordance with Labor Code Section 1742 and 1771.6 to the prime contractor
advising an estimated maximum wage restitutions to workers, liquidated damages, and
penalties equal to $1,523.52 to be deducted and held from the retention amount as
security; and
WHEREAS, the actual use of funds for construction engineering was less than the
budgeted amount by $500; and
WHEREAS, the construction contract was completed with $480 remaining; and
WHEREAS, the remaining total project savings of $980 is, available; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby 1) accept the improvements for the John D. Morgan Park Parking Lot
Improvements Project No. 23-DD and 2) direct the City Engineer to file the Notice of
Completion.

Job Title: John D. Morgan Park Parking Lot Improvements Project No. 23-DD
Location: John D. Morgan Park parking lot along Rincon Ave adjacent to San Tomas Expressway.
Scope of Work: The project performed asphalt improvement measures including dig outs and applying OverKote over the
surface. A hammerhead style turn around was installed at the south end of the parking lot and a split rail fence &
collapsible bollards were installed along the edge shared with the pedestrian pathway on the eastern edge of the parking lot.
Striping and signage were installed in the parking lot.
