Dear Ms. Cumalt:
Thank you for your submittal of a Fence Exception application for a new fence located at 90 S.
Midway Street. The Fence Exception provides for a 6.875-foot tall fence along a portion of the
western and northern side property line, where a six-foot fence is allowed.
The Community Development Director has determined that the requested Fence Exception:
1. Will not impair vehicular or pedestrian safety;
2. Will result in a more desirable site layout from a maintenance and use standpoint;
3. Will not be detrimental to the health, safety, peace, morals, comfort or general welfare of
the City; and
4. Will not be detrimental or injurious to property and improvements in the neighborhood or
to the general welfare of the City.
Therefore, your request for a Fence Exception has been approved. The Fence Exception is
granted subject to the following condition of approval:
1. The development of the project shall substantially conform to the plans dated March 11,
2005, by Charles Cumalt, applicant, except as otherwise provided in this approval. Any
modifications to the plans shall be reviewed and approved by Staff.
2. The applicant shall obtain a building permit from the Campbell Building Division, prior
to installation of the fence.

Subj: Fence Exception request letter
Mr. Prosser,
I am requesting a Fence Exception to add lattice work above a solid fence to provide
additional privacy to our backyard. I was unaware of any City restrictions on the height
of a fence when the fence was built. The fence height is 82.5" high.
The height of the fence has been reduced from an earlier design and is actually lower than
some other fences in the immediate neighborhood that also have lattice work above the
fence structure. In regards to the set back, the fence is approximately 55' from the
crown of the street. This distance again far exceeds the set backs noted in other
immediate properties where the height of the fence exceeds the 6' height.
The fence provides privacy on the Arroyo Seco side of the corner lot. The fence was
replaced because the original fence was being shored up, by the existing shrubby that had
grown over the fence, as the existing fence posts were totally rotted out. A small
concrete step wall was constructed on the property line to retain dirt on our lot, as it is
slightly higher than our neighbors.
Mr. Jay Keesling, our immediate neighbor, who shares the fence has no issue with the
design and has signed the Fence Exception Consent Form.
I believe the fence with gate when fully painted and completed will enhance the overall
appearance of the property when viewed from the Arroyo Seco side.
I don't believe the fence structure will in any way be detrimental to the health, safety, or
welfare of the neighborhood or the City. In fact, replacing the rotted out fence has added
a significànt measure of security as well as safety.
