Dear Mr. Martiny:
The Community Development Director has conditionally approved your application for a Tree Removal
Permit (PLN2004-00120) to remove one (1) Modesto Ash tree 37 inches in diameter, located adjacent to
the common driveway on property located at 370-376 Union Avenue, subject to the following condition
of approval for tree replacement:
1. The applicant is required to plant one (1) 36-inch box Chinese Pistache tree in the common area
between building 372 and building 374/376 on the property on or before January 9,2005.
The Tree Removal Permit has been approved based upon the City's determination, with a supporting
recommendation by a Certified Arborist, that the Modesto Ash tree is posing a threat to the existing
utilities on site, thus creating potential property damage and cannot be controlled or remedied through
reasonable relocation or modification of the utility services.
It is recommended that the tree be removed by persons who are experienced and bonded for the removal
of trees, that the stumps be ground out, and the roots removed so there will not be re-growth of the tree.
This approval is final in 10 calendar days, unless an appeal is received in writing at the City of Campbell
City Clerk's Office, 70 N. First Street, Campbell, on or before Thursdav. December 9.2004 at 5:00 p.m.
The tree may not be removed until after the 10-day appeal period has passed and no appeals have been

ITEM I - Call to Order
The Board of Directors meeting was called to order by Chris Hall at 8:45 PM.
ITEM II - Action Items reviewed
(J A review of Community Management was conducted by Gary Martiny and
the members of the Board of Directors. Questions about who to contact at
CMS were answered as well as hours of operation, emergency hours and
contacts, and customer services, etc. Tim Perot said that he will be doing
light runs. His phone to report lights out is 371-4349.
0 The date for artwork submissions regarding the new logo has been
extended until December 1, 2004.
(J The HOA Annual Meeting was discussed. The meeting will be held on
January 1ih, 2005, at the offices of CMS. Proxys and the agenda will go
out to all homeowners no later than December 13, 2004.
0 The satellite policy for the complex was reviewed. The HOA has Comcast.
(J The issue of the tree removal was reviewed by the Board as well as the
projected asphalt slurry job and the curb repair project. Chris Hall
motioned to remove the Modesto Ash tree located adjacent to building
372. The motion was seconded by Joanne Mitani. Chris requested a vote
by the homeowners and the homeowners voted unanimously to remove
the tree.
(J Newsletter was reviewed. It will go out quarterly after the quarterly Board
of Directors meeting.
(J The reminder of "NO Parking" in front of the mailboxes was reviewed by
the Board. CMS and the Board to begin warning violators and towing
those vehicles that continue to violate the policy.

I'm sorry that I wasn't able to hear from you as to the reason that the tree is being removed. I can only say that I
do not want to see the tree removed, because it provides a major amount of privacy to my townhouse at Chalet
Woods (my property borders the tree) from the units in the complex that the tree is in. I would suspect that the
other owners in my complex whose property is near the tree, feel the same way. It also provides a great deal of
aesthetic beauty to the natural surroundings in a densely populated neighborhood and invites birds to the area.
I would appreciate hearing the reason for the proposed removal and the outcome. If you need any further
information, I would be happy to provide it.

located at 370-376 Union Avenue within the P-D Zoning District.
Your application has been deemed incomplete. The following additional information is required
to complete your application:
1. Application Information: The Tree Protection Regulations requires proof of a vote of the
homeowners association approving the tree removal in addition to the signature by a
representative for the homeowners association. The homeowners association meeting
minutes or another form of proof of a vote must be submitted to the Planning Division
before the Community Development Director may make a decision on the application.

NOTICE OF TREE REMOVAL APPLICATION
Notice is hereby given that the Community Development Director of the City of
Campbell has received an application for a Tree Removal Permit (PLN2004-00120) to
remove one (1) Modesto Ash tree 37 inches in diameter, located adjacent to the common
driveway on property located at 370-376 Union Avenue in an R-3-S (Multiple Family
Residential) Zoning District (see map on reverse).
The Community Development will be rendering a decision after 10 calendar days from
the date of this notice, on Fridav. September 24.2004. Questions or comments regarding

There are several Modesto ash trees that line the property at the north side of the campus.
The location of the tree recommended for removal is the second tree to the left as you
drive east into the driveway from Union avenue - directly across from building #372.
(marked by green on the provided map)
The tree in question is a Fraxinus velutina 'modesto, , modesto ash. The tree is 37 inches
in diameter at 4 feet above grade. Estimated height of the tree is 75 feet above grade.
The tree is an estimated 30 years old, and is moderately vigorous. There are no signs of
any: root rot, boring insects, conk fungus, or any other visible pathogens on or around the
tree. In general the tree is healthy.
The said ash tree is posing a threat to property. Visual damage is evident to the asphalt
along with the damage to the water utilities that service the sprinklers. Non visible
damage could be happening to the main drainage system near the location of the manhole
cover by another ash tree located just west of the one in question. Ash trees are notorious
for lifting in credible roots. Continued damage will happen as the tree grows. The larger
the crown the larger the root system.
As far as alternatives to taking down the tree, root cutting is not recommended on a tree
of this size. Though some trees are known to survive the removal of 50% of there root
system, the affects as far as structural integrity would be greatly compromised and
therefore pose a threat to life, limb and properties.
It is in my professional opinion as an 18A certified arborist that the previous mentioned
tree be taken down and stump ground. As per a replacement tree - a Chinese Pistache

not planted over the removed ash tree's buttress, limits the size and location at which the
tree could be planted. And on top of this is the location of the trash bins which further
complicate the process of locating another tree. The massive root system makes it
impractical to plant within close proximity to the base of the tree. It may be that the
replacement tree which has to be planted, be smaller (24 inch box) initially in order to
root successfully within such a small area.
Other trees located on the same campus would be drop crotched for crown reduction and
end weight reduction. This in turn will slow down the rate of root growth on the
remaining trees. All pruning cuts will be done in accordance with ISA standards. If you
