SUMMARY OF ORDINANCE N0: 2340 OF THE
CITY COUNCIL OF THE CITY OF CAMPBELL . .
EXTENDING URGENCY PROVISIONS RELATED
TO ACCESSORY DWELLING UNITS (ADUS)
AND JUNIOR ACCESSORY DWELLING UNITS
(JADUS) TO IMPLEMENT RECENT FEEDBACK
AND DIRECTION FROM THE CALIFORNIA,
DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT (HCD) AND RECENT
LEGISLATIVE UPDATES (SB 12n & AB 2533).
SECTION 1(SEVERABILITY): Adopts a severability .,
clause providing thatif:the California Department of '
Housing and Community. Development -finds any part.
of this interim ordinance non -compliant with state
law, the specified sections, subsections, sentences,.
clauses, or phrases will be invalidated to ensure the
ordinance remains consistent with State AIJU Law. .
The City Council asserts that it would have adopted.,
this interim ordinance and its compliant components
regardlesssof`any part being subsequently identified as
non -compliant.
SECTION 2 (CEQA): Confirms the ordinance is exempt
from CEQA review under Public Resources Code
Section 21080.17.
SECTION 3 (STATE LAW): Ensures the ordinance is
appliedconsistently with State ADU Law and overrides,
conflicting Municipal Code,provisions as needed during
its�0ective period.
SECTION 4 (PUBLICATION): The City Clerk shall .
cause this interim ordinance or a summary thereof
tobe published at least once in a newspaper of
general circulation within 15 days after its,adoption In
accordance with Government Code Section 36933
SECTION 5 (EFFECTIVENESS): Extends interim,
Ordinance No.2322, as prexiousl extended by Interim
Ordinance+No.2325 for a period of ten months -and
fifteen days, for an additional period of one year, or
until it is superseded by adoption of a,superseding
ordinance; wtiictievercomes first.
