Santa Cruz Ave., #6 Los Gatos, CA 95030 Re: File No: PLN2013-199 Address: 559 Kenneth Ave. Application: Administrative Site & Architectural Review Permit Status: Incomplete Dear Mr. Giannella, Thank you for your July 15, 2013 submittal of an Administrative Site & Architectural Review Permit application for construction of a new single-family residence located at the above referenced property. Based on a review of the application materials, the Campbell Municipal Code (CMC), and the San Tomas Area Neighborhood Plan (STANP), your application has been deemed incomplete. The following additional information and revisions to the plans are needed in order to continue processing of this application. PLAN REVISIONS 1. Project Data Table (Sheet A1.0): The following must be revised on the project data table: a. Provide a 'front yard paving coverage' value (the percentage of the 25-ft front yard setback area that is paved). b. Provide a Floor Area Ratio (FAR) value. The FAR should incorporate building square footage, excluding the covered porches, patios, and balconies. c. Provide a Lot Coverage value. The FAR should all include all building coverage, including cantilevered second-story elements. 2. Site Plan (Sheet A1.1): The following must be revised on the site plan: a. Revise the 'line of second floor'to reflect the terrace and balcony. b. The 10-ft, 5 '/2-inch setback to the second-story projecting window seat (right side) is substandard. Revise to conform to a 12-foot setback (equal to 60% the 20-ft plate height of the second-story). c. All existing and new on-site utilities (PG&E, Cable, Phone, etc.) shall be installed underground per CMC 21.18.140. Depict the proposed joint trench from the nearest utility pole to the residence and include the following in bold one inch text: "All new and existing utilities shall be placed underground with no exception." d. Page 2 of 3 3. Floor Plan (Sheet A2.5): Show the sprinkler shut off valve required by the residential sprinkler system (see enclosed Fire Department comments). This valve shall be located along the side of the house and recessed into the wall (preferably the garage side). 4. Elevations (Sheet A3.0): The following must be revised on the elevation sheet: a. Correct the scale; measurements are not accurate at 3/16th. b. The side railing of the rear balcony is not consistent with the floor plan which shows a solid barrier. c. Show the sprinkler shut-off valve required by the residential sprinkler system. d. Indicate materials/paint by manufacture, product name, and product number, corresponding to the submitted color/material board. e. Identify the finish floor elevation as 'existing/proposed' f. Include the following height measurement on all proposed elevations. Please note that all measurements must be in relative values (feet and inches) as well as elevation benchmark (AMSL) levels established by the topographic survey: (1) Maximum structure height as measured from existing grade. (2) Finished floors as measured from existing grade. (3) Plate heights as measured from existing grade(not finished floor). 5. Color/Material Board: Revise the color/material board to indicate the manufacture, name, and product number, of all colors and materials. DESIGN REVIEW This project is subject to the regulations set forth in the San Tomas Area Neighborhood Plan (available online at http://www.cityofcampbell.com/Planning/Resources/STANP.pdf). This Area Plan includes Design Guidelines that are designed to protect and reinforce the desirable characteristics of the San Tomas area. In staff's assessment, the proposal does not satisfy the design guideline requirements pertaining to compatibility (Pg. 11), scale and mass (Pg. 12), surface articulation (Pg. 13), and privacy impacts (Pg. 15). Specifically, the design of the house presents a heavy massing presence inconsistent with the neighborhood, the entry element accentuates the building's height, the uninterrupted roof lines lack articulation, and the second- story balconies present a potential privacy impact. Staff recommends the following revisions to address these concerns: • Eliminate the front second-story terrace to break up the second floor massing. • Eliminate, minimize, or shift the second-story bay window to reduce the perceived height of the entry way. • Eliminate the front door columns to reduce the perceived height of the entry way. • Reduce the linear length of the rear balcony (e.g., down to 25-feet) and perhaps also reduce the width by partially insetting the balcony into the house. These changes will diminish the balcony's privacy impact. SOILS REPORT: Two copies of a current soils report, prepared to the satisfaction of the Building Official, containing foundation and retaining wall design recommendations shall be submitted with the building permit application. This report shall be prepared by a licensed engineer specializing in soils mechanics. 6. SITE PLAN: Application for building permit shall include a competent site plan prepared by a licensed engineer or surveyor that identifies property and proposed structures with dimensions and elevations as appropriate. FOUNDATION INSPECTIONS: A pad certificate prepared by a licensed civil engineer or land surveyor shall be submitted to the project building inspector upon foundation inspection. This certificate shall certify compliance with the recommendations as specified in the soils report and the building pad elevation and on-site retaining wall locations and elevations are prepared according to approved plans. TITLE 24 ENERGY COMPLIANCE: California Title 24 Energy Compliance forms shall be blue- lined on the construction plans. 8% X 11 calculations shall be submitted as well. 9. Chapter 17,the architect or engineer of record shall prepare an inspection program that shall be submitted to the Building Official for approval prior to issuance of the building permits,in accordance with C.B.C Chapter 1, Section 106. (a)Any law,ordinance or governmental regulation(including but not limited to building and zoning laws,ordinances,or regulations)restricting,regulating,prohibiting or relating to(i)the occupancy,use,or enjoyment of the land;(ii)the character, dimensions or location of any improvement now or hereafter erected on the land;(iii)a separation in ownership or a change in the dimensions or area of the land or any parcel of which the land is or was a part;or(iv)environmental protection,or the effect of,any violation of these laws,ordinances or governmental regulations,except to the extent that a notice of the enforcement thereof or a notice of a defect,lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy; (b)Any governmental police power not excluded by(a)above,except to the extent that a notice of the exercise thereof or a notice of a defect,lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy. 2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy,but not excluding from coverage any taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without knowledge. 3. Defects,liens,encumbrances,adverse claims,or other matters: (a)whether or not recorded in the public records at Date of Policy,but created,suffered,assumed or agreed to by the insured claimant; (b)not known to the Company,not recorded in the public records at Date of Policy,but known to the insured claimant and not disclosed in writing to the Company by the insured claimant prior to the date the insured claimant became an insured under this policy; (c)resulting in no loss or damage to the insured claimant; (d)attaching or created subsequent to Date of Policy(except to the extent that this policy insures the priority of the lien of the insured mortgage over any statutory lien for services,labor or material or the extent insurance is afforded herein as to assessments for street improvements under construction or completed at date of policy);or (e)resulting in loss or damage which would not have been sustained if the insured claimant had paid value for the insured mortgage. 4. Unenforceability of the lien of the insured mortgage because of the inability or failure of the insured at Date of Policy,or the inability or failure of any subsequent owner of the indebtedness,to comply with the applicable"doing business"laws of the state in which the land is situated. 5. Invalidity or unenforceability of the lien of the insured mortgage,or claim thereof,which arises out of the transaction evidenced by the insured mortgage and is based upon usury or any consumer credit protection or truth in lending law. 6. Any statutory lien for services,labor or materials(or the claim of priority of any statutory lien for services,labor or materials over the lien of the insured mortgage)arising from an improvement or work related to the land which is contracted for and commenced subsequent to Date of Policy and is not financed in whole or in part by proceeds of the indebtedness secured by the insured mortgage which at Date of Policy the insured has advanced or is obligated to advance. 7. Any claim,which arises out of the transaction creating the interest of the mortgagee insured by this policy,by reason of the operation of federal bankruptcy,state insolvency,or similar creditors'rights laws,that is based on: (i)the transaction creating the interest of the insured mortgagee being deemed a fraudulent conveyance or fraudulent transfer; or (ii)the subordination of the interest of the insured mortgagee as a result of the application of the doctrine of equitable subordination;or (iii)the transaction creating the interest of the insured mortgagee being deemed a preferential transfer except where the preferential transfer results from the failure: (a)to timely record the instrument of transfer;or (b)of such recordation to impart notice to a purchaser for value or a judgment or lien creditor. 7.AMERICAN LAND TITLE ASSOCIATION LOAN POLICY-1992 WITH REGIONAL EXCEPTIONS When the American Land Title Association policy is used as a Standard Coverage Policy and not as an Extended Coverage Policy the exclusions set forth in paragraph 6 above are used and the following exceptions to coverage appear in the policy. Title Risks: *that are created,allowed,or agreed to by you *that are known to you,but not to us,on the Policy Date-unless they appeared in the public records *that result in no loss to you *that first affect your title after the Policy Date-this does not limit the labor and material lien coverage in Item 8 of Covered Title Risks 6. Failure to pay value for your title. 7. (b)Any governmental police power.This Exclusion 1(b)does not modify or limit the coverage provided under Covered Risk 5,6, 13(c),13(d),14 or 16. 2. Rights of eminent domain.This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8. 3. Utility Encroachment Permit: Separate permits for the installation of utilities to serve the development will be required (including water, sewer, gas, electric, etc.). Applicant shall apply for and pay all necessary fees for utility permits for sanitary sewer, gas, water, electric and all other utility work. 7. Additional Street Improvements: Should it be discovered after the approval process that new utility main lines, extra utility work or other work is required to service the development, and should those facilities or other work affect any public improvements, the City may add conditions to the development/project/permit, at the discretion of the City Engineer, to restore pavement or other public improvements to the satisfaction of the City. 8. Stormwater Pollution Prevention Measures: Prior to issuance of any grading or building permits, the applicant shall comply with the National Pollution Discharge Elimination System (NPDES) permit requirements, Santa Clara Valley Water District requirements, and the Campbell Municipal Code regarding stormwater pollution prevention. The primary objectives are to improve the quality and reduce the quantity of stormwater runoff to the bay.
