Dear Mr. Garza:
The Planning Division recently approved a business license for a hair salon in your commercial
building on the referenced property. A hair salon is considered a retail use of the property. This
approval is subject to the conditions as provided in the Planning Commission's Resolution No.
3508, regarding the establishment of a retail use on this property. More specifically, it is
important that you satisfy conditions regarding landscaping, relocation of the air conditioning
equipment, trash enclosure screening and compliance of sign approvals.
1. Mechanical Equipment: The existing elevated air conditioning units shall be relocated to
the ground and screened. Ground mounted equipment shall be screened with architecturally
compatible materials, subject to approval by the Community Development Director, prior to
the issuance of building permits.
2. Landscape and Irrigation Plans: The applicant shall submit detailed final landscape and
irrigation plans to the Planning Division for review and approval by the Community
Development Director indicating the replanting of landscape areas in the parking lot adjacent
to the building and the reintroduction of a planting area between the driveways adjacent to
the sidewalk at the base of the sign. Landscape and irrigation plans shall be consistent with
the City's Water Efficient Landscaping Standards.
a. All trees shall be a minimum 24-inch box size. All shrubs shall be a minimum of 5-gallon
size and ground cover shall be shown to provide 100 % coverage within 2 years of
installation.
b. All landscaping installed as required per the approved landscape plan shall be maintained
in good health.
3. Trash and Recvcling Enclosure: The applicant shall submit details regarding the design
and location of a trash and recycling enclosure(s) to the Planning Division for review and
approval by the Community Development Director prior to the issuance of building permits
for the project. Unless otherwise noted, enclosures shall consist of a concrete floor
surrounded by a six-foot high solid wall and have decorative self-closing doors. The

enclosure shall be constructed at grade level and have a level area adjacent to the trash
enclosure area to service the containers.
3. Signage: No signage is approved as part of the development applications approved herein.
The existing non-conforming freestanding sign shall be removed or modified to comply with
current sign regulations. No sign shall be installed until a Sign Permit is approved as
specified in the Sign Ordinance. Please insure that the conditions regarding the sign plan and
conditions of approval have been satisfied.

DISCUSSION
Applicant's Proposal: The applicant is requesting approval of a Modification to a previous
Conditional Use Permit to allow the establishment of a commercial day care center within an
existing commercial building. A continuance of this application is recommended so that the
applicant may submit revised plans addressing issues identified by the Site and Architectural
Review Committee during its review of the application as follows:
1. Provision of additional on-site parking for employees;
2. Provision of a landscape buffer between the proposed use and the adjacent residential use,
and;
3. Better definition ofthe outdoor play area.

DISCUSSION
Background: A Conditional Use Permit was approved in 1976 (UP 76-11), Resolution No. 1533, to allow
the conversion of a residence into offices. The building was originally used as an office, then as hair salon
for approximately 20 years and then again as an office beginning in 2001. The Planning Commission in
June 2003 approved either retail or office uses in this building via a Modification to the prior Conditional
Use Permit.
The applicant at this time is requesting approval of modification of the Conditional Use Permit to allow
the establishment of a day care use to accommodate up to 35 children in this commercial building.
The project site is located on the west side of Winchester Boulevard between Catalpa Lane and El
Caminito Avenue.
ANALYSIS
General Plan Designation: The General Plan land use designation for the project site is Central
Commercial. Prior to the recent General Plan Update in November 2001, this property was shown as a
Commercial land use designation. A day care use is consistent with the planned land use designation.
Therefore, the proposed project is consistent with the General Plan.
Staff Analysis
Land Use Compatibility: The proposed use of a day care center within the existing commercial building is
compatible with adjacent commercial and residential uses.
Parking: The site plan indicates the provision of 10 parking spaces. The parking ordinance requires the
provision of one space for each five students or 7 spaces for 35 students and one parking space per
employee. Three employees are anticipated consequently a total of 10 spaces would be required. The
applicant has indicated a significant number of their students are provided transportation to the day care
center via day care center transportation and consequently the 10 parking spaces is adequate.
The floor plan indicates the 4 classrooms areas with an outside play area of 2,625 square feet at the rear of
the building. The outdoor play area will operate within the hours of7:00 a.m. to 7:00 p.m.
Recommendation:
Staff does not have any other outstanding issues with the proposed project and is supportive of the proposed
use at this location. Staff will recommend a condition of approval requiring a more detailed landscape plan
at the time of building permit submittals.

We will have some play equipment at the back of the building and all play equipments
will be placed close to the building to respect the neighbors' privacy. We will also make
sure all play equipments are a lot shorter than the fence at the back of the property.

Between full time and part time, children age range is form 2 years to age to 13 years.
Full time children age is between 2 years to 5 years old.
Full time children will be cared for from 6 AM up to 3 PM and some stay up to
6 PM depending on the parents' schedule.
Part time (after school children) age is between 6 years to 13 years old.
Part time students are picked up ITom their school by our staff and brought to
our center around 3 PM.
For part time students we provide home work help and study time. For about 3
hours of their stay at our center most of their time is spent focusing on
educational activities.
We have been operating at our current business location for the last two years.
It is our number priority to keep noise level down in order to respect our
neighbors' privacy.

RECOMMENDATION:
Note: No building code issue has been reviewed at Development Review Committee; it will be reviewed in the
Building Permit process. Please be aware that building codes are changing constantly; plans submitted for
building permit shall comply with the code in effect at that time. Submit permit application together with
required documents to the Building Inspection Division to obtain a building permit. No construction can be
commenced without an appropriate building permit.
It is recommended that this item be forwarded to the Planning Commission for review, with the following

of a California licensed Engineer or Architect. Plans submitted for building permits shall be
"wet stamped" and signed by the qualifying professional person.
5.

We currently provide Large Family Child Care at our address: 208 Sunnyside Ave # I
Because of the large number of calls we get from parents in the area, we believe it is
necessary for us to grow our home day care to support our community need by expanding it to
commercial day care.
We are interested to locate our business to address: 2265 Winchester Ave. which we believe
has all the conditions and environment safe for the children we care for.
According to square footage, it has 2243 feet of total indoor space and we could use 1262 of
this space as a classroom, which could occupy 36 children that we suggest we should get a
permit for 36 children. Although we only project for about 30 children for the next five years

4. We take it serious to control noise generated by the children in order not to offend
neighboring properties. Weare able to achieve that for almost two years at our current
business location.
We use most of the children time by helping them with homework and mainly
focus in educational activities as majority of our customers are in after school
program.
5. Currently we have one employee and as the business grows there is a potential for at
least one more employees, depending on the business needs.
6. We do not plan to make any structural change to the building.
7. The property is fully handicap accessible
8. We have clear understanding of the size and number of signs we can place and also we
planed to comply with landscaping requirement.

Thank you for your submittal of a preliminary application for the establishment of a commercial
day care center in an existing commercial building on the referenced property. The subject
property is presently P-D (Planned Development) and is designated as a Central Commercial
Land Use on the City's General Plan Land Use Map.
The establishment of the proposed use is a permitted use in this zoning district subject to
approval of a Conditional Use Permit. This determination is based upon an interpretation that a
Conditional Use Permit is required for a Commercial Day Care in the General Commercial
Zoning District and the establishment of a new use in a P-D (Planned Development) Zoning
District requires a Conditional Use Permit.
Your application was distributed to the Public Works Department, Building Division, Planning
Division and County Fire Department. In addition to the Planning Division's comments
contained in this letter, please find enclosed comments from the Building Division. Please note
that these comments are meant to be preliminary. Conditions of approval from each department
will be developed when the formal application is submitted.
The Planning Division completed the review of your preliminary application and has the
following comments regarding your proposal:
1. Conditional Use Permit: The Conditional Use Permit approves the proposed use, site plan
and elevations for the subject property. The purpose ofthe Conditional Use Permit review is
to allow consideration of uses on a case-by-case basis. This approval process takes into
consideration the location of the use as well as on-site improvements. An application for a
Conditional Use Permit is enclosed. A processing time of 45-60 days is typical for a
Conditional Use Permit and requires consideration by the Planning Commission through a
public hearing process.

2. Building Permits: Tenant improvement plans will need to be submitted to the Building
Division after the Planning Commission's approval. Plans for a commercial occupancy need
to be prepared by a licensed Architect or Engineer.
3. Parking: Please refer to Table 3-1 that is enclosed.
4. Potential Noise: Your use permit application needs to address the operational hours of the
center as well as outdoor play times for the children. Please provide any relevant information
with your use permit application that will demonstrate how you will monitor and or restrict
noise levels generated by the day care use.
5. Landscaping: The project site is deficient in landscaping. Please anticipate the installation of
a planting area between driveways, adjacent to the building entrance and at the rear of the
parking area with your occupancy of the building.
6. Signing: Commercial uses are restricted to one freestanding sign and one wall mounted. The
permitted sign area is based upon the linear frontage of the business with an area ranging
from 20 to 50 square feet and a sign height limit of 14 feet for the freestanding sign.
