BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL AUTHORIZING INITIATION OF A GENERAL PLAN
AMENDMENT TO REDESIGNATE PROPERTY LOCATED AT 480
CHAPMAN DRIVE FROM "NEIGHBORHOOD COMMERCIAL" TO
"LOW DENSITY RESIDENTIAL (<4.5 UNITS PER GROSS ACRE),"
AND APPROVING A REDUCTION IN APPLICATION FEES TO $69000.
FILE NO. PLN-2026-21.
WHEREAS, the City Council adopted the current 2040 General Plan on April 18, 20231 by
Resolution No. 12963.
WHEREAS, the purpose of the City's General Plan is to guide decisions regarding physical
growth and development, provision of public services and facilities, and conservation and
enhancement of natural resources,
WHEREAS, the General Plan establishes a foundation upon which the City can base policy
decisions and a basis for judging whether specific development proposals and public projects
are in harmony with community desires,
WHEREAS, the General Plan is not static, but rather a dynamic and multi -faceted document
that defines and addresses the changing needs of the City,
WHEREAS, pursuant to Campbell Municipal Code Section (CMC) 21.60.020.A, an amendment
to the General Plan may only be initiated by the City Council by consideration of a preliminary
application, as required by CMC Sec. 21.41.02.A;
WHEREAS, the City Council's action to authorize ("initiate") an amendment does not bind or
otherwise require the City Council to approve a formal amendment application,
WHEREAS, the Land Use Element of the General Plan includes policies directing the City to
consider compatibility with surrounding residential neighborhoods when evaluating land use
changes, including potential effects related to scale, intensity, traffic, and noise,
WHEREAS, the subject property is located at the edge of a commercially designated corridor
and is adjacent to established residential uses, and the requested amendment would align the
property's designation with its existing residential use and surrounding neighborhood context,
WHEREAS, the City Council has determined that consideration of the proposed General Plan
amendment would be in the public interest,
WHEREAS, the City 's adopted fee schedule is intended to recover the cost of processing
applications, and the City Council may consider adjustments to fees on a case -by -case basis
where the scope and complexity of a request differs from typical applications; and
WHEREAS, the City Council has considered the limited scope of the proposed amendment and
the estimated staff time required to process the application in determining that a reduced fee is
appropriate.
NOW, THEREFORE, BE IT RESOLVED that the City Council grants authorization to proceed
with formal submittal of a General Plan Amendment to amend the General Plan Land Use Map
to redesignate property located at 480 Chapman Drive from "Neighborhood Commercial" to
"Low Density Residential (<4.5 units per gross acre)," subject to a formal application to be
submitted no later than May 21, 2027.
BE IT FURTHER RESOLVED that, in connection with the required General Plan Map
Amendment, Zoning Map Amendment, and Form -Based Zone Map Amendment, the City
Council approves a reduced application fee in the amount of $6,000, based on the limited scope
of the request and the estimated cost of processing the application.

To Whom It May Concern,
This letter is submitted to provide a justification for the proposed General Plan Amendment.
The applicant respectfully requests approval of a General Plan Amendment to change the land
use designation of the subject property from NC (Neighborhood Commercial) to LDR (Low
Density Residential), along with a corresponding rezoning from NC to R-1-10 (Single -Family
Residential).
The property has been designated Neighborhood Commercial since 1966. However, in nearly
60 years, no commercial development has occurred on the site. Additionally, a prior amendment
request was submitted in 1997, further demonstrating that the commercial designation is
unsuitable for the site. Since that time, there has been no interest or activity indicating that
neighborhood -serving commercial development is viable at this location.
The surrounding properties to the west are residential in both designation and use. Changing
the site to Low Density Residential would align it with the existing neighborhood character and
would not create a spot zoning condition. Instead, it would provide consistency with adjacent
residential development and reflect the established land use pattern in the area.
Additionally, the applicant respectfully requests a fee reduction and for the city to process this
application at an "at cost" basis given the limited scope of the amendment and the lack of new
commercial intensity.
Given the lack of commercial viability and the residential context of the surrounding properties,
the requested amendment is reasonable and appropriate. We respectfully request the City's
approval and consideration of reduced processing fees.
